If departures causing family separation were not substantially likely as to at least some Rule-eligible aliens, the agency would not have claimed that the Rule would prevent that separation.

The other class of Rule-eligible aliens are stepchildren of U.S. citizens, who must have been present in this country un- lawfully since June 17, 2024.
