The investigation was launched after the Justice Department issued a second sentencing memo for Stone called for a prison sentence “far less” than the 7-9 year recommendation his trial team initially put forward. Stone was sentenced to 40 months in prison, but that sentence was ultimately commuted by Trump. However, the inspector general found in Wednesday’s report that even career department lawyers believe “reasonable minds” can disagree on whether the initial sentencing recommendation for Stone was too high. “Thus, we found that Barr had articulated his position about the sentencing recommendation both before and shortly after the first sentencing memorandum was filed, and before the President’s tweets,” the inspector general said. The comments during these deliberations formed a “substantial basis” for Zelinsky’s congressional testimony, the inspector general said.

The Justice Department’s in-house watchdog found no evidence of political interference in the reduction of a prison sentence proposed for the longtime Trump ally Roger Stone in 2020, attributing the stunning reversal to “ineffectual” leadership, according to a report released on Wednesday. The report concluded a four-year investigation into the decision by Attorney General William P. Barr in February 2020 to reduce Mr. Stone’s proposed sentence to about three years, after initially recommending seven to nine. The episode incited accusations of political interference and prompted four prosecutors in the case to resign. He denounced the sentencing recommendation as a “miscarriage of justice.”But the inspector general, Michael E. Horowitz, concluded that Mr. Barr had argued that the more stringent sentence was unreasonably harsh before Mr. Trump expressed those sentiments. Mr. Barr was blindsided by a subordinate who had led him to believe the department would request a lesser prison term, Mr. Horowitz wrote.

Michail Chkhikvishvili, a 21-year-old man from the Republic of Georgia, was indicted on four charges, including soliciting hate crimes and acts of mass violence, according to a statement from the US Department of Justice. In November 2023, Chkhikvishvili began planning a “mass casualty event” for New York City on New Year’s Eve, prosecutors said. “The scheme involved an individual dressing up as Santa Claus and handing out candy laced with poison to racial minorities and children at Jewish schools in Brooklyn,” the Department of Justice statement said. He “drafted step-by-step instructions to carry out the scheme” and shared with the undercover officer “detailed manuals on creating and mixing lethal poisons and gases,” the statement said. “For example, and among other things, the handbook encourages its readers to commit school shootings and to use children to perpetrate suicide bombings and other mass killings targeting racial minorities,” the Justice Department statement said.

As negotiations to end the long legal brawl between Julian Assange, the WikiLeaks founder, and the United States reached a critical point this spring, prosecutors presented his lawyers with a choice so madcap that a person involved thought it sounded like a line from a Monty Python movie. Mr. Assange, who feared being imprisoned for the rest of his life in the United States, had long insisted on one condition for any plea deal: that he never set foot in the country. The U.S. government, in turn, had demanded that Mr. Assange plead guilty to a felony for violating the Espionage Act, which required him to appear before a federal judge. The Supreme Court’s decision on Friday that prosecutors had misused an obstruction law in charging hundreds of rioters who attacked the Capitol is the latest example of the persistent challenges the Justice Department has faced in grappling with the consequences of Jan. 6, 2021. By and large, the department has succeeded over the past three years in moving against members of the pro-Trump mob who sought to disrupt the certification of President Biden’s victory on Jan. 6, and in winning convictions on seditious conspiracy charges against members of two far-right groups that were instrumental in stoking the violence that day, the Proud Boys and the Oath Keepers. But lacking any established legal blueprint for addressing an assault on the foundations of democracy, prosecutors sometimes got creative with the law. And that has left them vulnerable to second-guessing by the courts on how they have pursued criminal cases both against the rioters and against former President Donald J. Trump, and contributing to a long series of challenges and delays. The court’s new ruling on the obstruction law will hardly cripple the Justice Department’s ability to go after the rioters, but it will constrain prosecutors by restricting the use of an important tool they have relied on to seek accountability against the most disruptive members of the mob.

CNN —Judge Aileen Cannon wants to hold additional hearings on Donald Trump’s attempts to challenge key evidence in his classified documents case and will allow the former president’s lawyers to question witnesses about the investigation and search of Mar-a-Lago. Those issues were argued in hearings on Tuesday, but Cannon did not rule on the matters. The judge did not say when additional hearings would be held. The special counsel’s office has strongly opposed the need for additional hearings and Trump’s attempts to cut out parts of the case. Cannon has not set dates for the additional hearings yet.

Julian Assange, the founder of WikiLeaks, agreed to plead guilty on Monday to a single felony count of illegally obtaining and disclosing national security material in exchange for his release from a British prison, ending his long and bitter standoff with the United States. Mr. Assange, 52, was granted his request to appear before a federal judge at one of the more remote outposts of the federal judiciary, the courthouse in Saipan, the capital of the Northern Mariana Islands, according to a brief court filing made public late Monday. It was a fitting final twist in the case against Mr. Assange, who doggedly opposed extradition to the U.S. mainland. The islands are a United States commonwealth in the middle of the Pacific Ocean — and much closer to Mr. Assange’s native Australia, where he is a citizen, than courts in the continental United States or Hawaii. Shortly after the deal was disclosed, WikiLeaks said that Mr. Assange had left London.

New York CNN —Prosecutors are urging the US Justice Department to file criminal charges against Boeing for safety issues surrounding its 737 Max, although top Justice Department officials haven’t made a final decision, a source familiar with the development tells CNN. And this month a group of those family members wrote a letter to the Justice Department urging Boeing be hit with the maximum possible $24.9 billion fine. The charges against Boeing don’t mean any Boeing executive will face charges as an individual. It has posted core operating losses of $31.9 billion since the start of the 20-month grounding of the 737 Max that followed its second fatal crash in 2019. But if the company faces criminal charges, a new settlement is the most likely outcome.

Going After the Middleman

They’ve zeroed in on what may sound like a nerdy legal theory, but one that could have huge implications: the tyranny of the intermediary, middleman companies that abuse their role by squeezing out competition or creating artificially expensive moats. The Justice Department has already made one high-profile strike along these lines, suing to break up Ticketmaster and Live Nation. It is reportedly investigating at least two others. One is RealPage, a property management company that uses artificial intelligence to suggest prices and has already been sued by renters accusing it of facilitating a new type of collusion. The second is UnitedHealth Group, the health care conglomerate that owns a cobweb of businesses that include an insurer and another unit that employs about 10,000 physicians in the United States.

Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

CNN —The House Ethics Committee announced Tuesday that it will continue to investigate certain allegations surrounding Rep. Matt Gaetz, including whether the Florida Republican engaged in sexual misconduct, while ending other portions of the probe. In a rare statement updating its work, the bipartisan committee stated some of the allegations against Gaetz “merit continued review” and it has “also identified additional allegations” that warrant investigating. But McCarthy has repeatedly denounced those accusations and has said Gaetz worked to oust him because of the ethics probe. In late 2020, under Trump-appointed Attorney General Bill Barr, the Justice Department opened an investigation into allegations Gaetz may have had sexual contact with a minor. A source familiar with the House panel’s work previously told CNN that the Justice Department’s decision not to bring charges against Gaetz does not impact what the committee will and won’t investigate.

Sony Pictures Entertainment is acquiring Alamo Drafthouse Cinema and will manage its 35 locations, a rare example of a traditional Hollywood studio’s owning a theater chain. The deal, announced Wednesday, followed the Justice Department’s decision in 2020 to rescind the so-called Paramount consent decrees — movie distribution rules dating to 1949 that forced the largest Hollywood studios to sell off their theater holdings. Those rules were intended to prevent studios from controlling the film business, from creation to exhibition. In recent years, Netflix, the leading streaming company, has bought theaters to show films. Alamo, the seventh-largest theater chain in North America, operates theaters in 25 metro areas across the United States and has invested in distinctive programming and food offerings in an attempt to lure in moviegoers away from major multiplexes.

Former President Donald J. Trump and his Republican allies have sought to delegitimize criminal investigations into his actions by declaring that Democrats have “weaponized” the justice system. That claim only intensified after a jury convicted Mr. Trump last month of 34 felonies in a hush-money case. Of course, Hunter Biden had the right to go to trial; it was his liberty at risk. Hallie Biden is the widow of Beau Biden, Hunter’s deceased brother. Testifying about intimate family matters must have been an enormous emotional trauma for her, as well as for Hunter Biden and his family. Western-trained pilots can teach Chinese military personnel everything from air combat tactics to how to land on an aircraft carrier, according to a US official. Former western pilots — which number at least in the dozens — are training Chinese military officials who then return to China and, in turn, train more pilots there, this person said. An indictment in 2017 alleged that Duggan trained Chinese pilots while he was still a US citizen, between November 2009 and November 2012. That same month, the UK Ministry of Defense issued a security alert after several of its military pilots were also found to have been training the PLA Air Force. Last August, two US Navy sailors were arrested for allegedly sending sensitive military information to Chinese intelligence officers.

The sophisticated scheme boosted revenue flowing into the coffers of The Epoch Times, the Justice Department said. In one year, revenue at the Trump-boosting outlet ballooned 410%, jumping from $15 million to about $62 million, the Justice Department added. But, when CNN asked for further comment on Tuesday, The Epoch Times brass chose to stay mum. The indictment said there was an entire group at The Epoch Times that took part in the alleged money laundering scheme.
