KFC sues Church’s over ‘Original Recipe’

Last week, KFC accused Church’s Texas Chicken of violating its trademark rights when its fried chicken competitor began using the words “Original Recipe” in its advertising and promotions. KFC claimed in a lawsuit that beginning September 30, it noticed Church’s “abruptly” began using the phrase and ignored KFC’s October 24 letter objecting to the ads. In the disputed promotions, Church’s posted photos of its fried chicken deals with text above reading: “our original recipe is back.”The phrase, which KFC has been using for over half a century, “is likely to create confusion in the marketplace and dilute the ORIGINAL RECIPE® Mark,” the lawsuit, which was filed in US District Court in Texas, said. But when it comes to fried chicken, KFC also has to compete with Church’s Texas Chicken, Popeyes, Raising Cane’s, Zaxby’s and more. KFC’s “Original Recipe” trademark, which it says is a secret blend of 11 herbs and spices, has long been part of the company’s branding.

TOKYO — Mount Fuji has finally gotten its iconic snowcap, meteorologists in Japan said Thursday, more than a month later than it did last year and the latest of any year in 130 years of record-keeping. The previous record was in 2016, when Mount Fuji’s first snowfall arrived on Oct. 26, while last year the first snow was on Oct. 5. Mount Fuji, a national symbol of Japan, is a pilgrimage destination and UNESCO World Heritage site that attracts hikers from all over the world. New York CNN —Elwood Edwards, a behind-the-scenes graphics and camera operator at local Cleveland television station WKYC whose voice was propelled to worldwide fame after he recorded AOL’s email greeting, ‘You’ve Got Mail,’ has died, according to his former employer. More than 30 years ago, Edwards recorded four iconic lines for what was then a little-known company called America Online. His wife, Karen, worked at Quantum Computer Services, which eventually became AOL, Edwards said in an AOL YouTube video in 2012. She volunteered her husband, and Edwards recorded the phrases on a cassette deck in his living room. “I didn’t enjoy being on camera as much as I enjoyed being behind the scenes,” Edwards said on the podcast.

That will soon become a reality in Texas with a new restaurant that unites the two chains under the same roof. Dine Brands, which owns the two restaurants, announced that the combined Applebee’s-IHOP restaurant will open approximately 35 miles west of San Antonio early next year, marking the first time the company has brought the concept to the United States. Plans for the dual-branded restaurant were announced earlier this year as part of Dine Brand’s plan to grow the two restaurants, which both reported lackluster earnings Wednesday. The idea is to maximize revenue with the same footprint of a traditional restaurant. That’s because the two restaurants’ menus encompass all parts of the day (pancakes and eggs Benedict for breakfast and steak and wings for dinner) and will have staff trained to work with both.
