Progressive Elites and Their Sins - The New York Times
  + stars: | 2024-06-06 | by ( David Brooks | ) www.nytimes.com   time to read: +1 min
The center of progressive energy moved from the working class to the universities, and not just any universities, but the elite universities. By now we’re used to the fact that the elite universities are places that attract and produce progressives. Today, we’re used to the fact that elite places are shifting further and further to the left. “Opinions of student writers at elite universities” in 2000, he found, “weren’t all that more progressive than those at nonelite ones.” But by 2023, opinions at The Crimson had grown about two and a half times more progressive than they were in 2001. More generally, Berman concluded, “Opinion sections at elite universities have gotten significantly more progressive, and they’ve outrun their nonelite counterparts.”

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority. Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue. Cannon’s signal of willingness to entertain challenges to the special counsel comes in the same week Republicans are bearing down on Attorney General Merrick Garland for his use of special counsels. A third group says the Department of Justice’s use of a special counsel should be upheld. Cannon still agreed to the hearing Trump wanted.

The indictment alleged that Trump was a part of an illegal conspiracy to undermine the integrity of the 2016 election. While hush money payments are not illegal in themselves, each charge was tied to a specific allegedly false entry among the financial records of the Trump Organization. Trump has argued that the payments to Michael Cohen, his former fixer who paid Daniels, were correctly labeled as legal expenses. Trump railed against the gag order every day during the trial and again on May 31 when he spoke at Trump Tower the day after the verdict. And the Georgia election interference case is in legal limbo while Trump and several of his co-defendants try to disqualify the Atlanta-area prosecutor who brought the charges.

Investor Steve Eisman of "The Big Short" fame expects Apple to capture epic gains from the artificial intelligence boom. "I think Apple is actually the hidden AI play," he told CNBC's " Fast Money " on Tuesday, less than 24 hours before chip giant Nvidia reports its fiscal first-quarter results. "When there will be apps that the consumer can use, they're going to want to use it on their phone," Eisman said. "I have a new iPhone, and I know for sure that when all those apps come on my phone, I'll need a new phone, and I'll need a new iPad and I'll need a new laptop." He suggests investors will have to be patient because the AI-driven apps need time to be developed.

TikTok sues to block prospective US app ban
  + stars: | 2024-05-07 | by ( Brian Fung | ) edition.cnn.com   time to read: +9 min
If it loses, TikTok could be banned from US app stores unless its Chinese parent company, ByteDance, sells the app to a non-Chinese entity by mid-January 2025. But Virginia Democratic Sen. Mark Warner, an advocate for the TikTok legislation, said in remarks on the Senate floor in April that the briefings provided critical insight into the risk TikTok poses. US policymakers have described the law at issue as a forced divestiture of TikTok, not an outright app ban. Some US officials have been trying to ban TikTok from the United States since 2020, when former President Donald Trump moved to block the app by executive order. (Trump has since reversed his position, saying a TikTok ban would only help Meta, a company Trump blames for his 2020 election defeat.)

The Justice Department is expected to announce the indictment of longtime Rep. Henry Cuellar, D-Texas, on Friday, two sources familiar with the matter told NBC News. It wasn't immediately clear if the indictment was related to the 2022 raid. A year after the raid — which had not previously yielded arrests or charges — Cuellar told the Texas Tribune: "There has been no wrongdoing on my part. Despite the raid, Cuellar narrowly defeated a progressive challenger, Jessica Cisneros, in his 2022 primary and went on to win re-election to his seat that November. A member of the centrist Blue Dogs and New Democrat Coalition, Cuellar was first elected to the House in 2004.

Norfolk Southern Chief Executive Alan Shaw testifies during a Senate Commerce, Science and Transportation Committee hearing titled "Improving Rail Safety in Response to the East Palestine Derailment" in Washington, U.S., March 22, 2023. Norfolk Southern -invested unions and pension funds should back activist Ancora's full seven-director slate at the railroad's shareholder meeting later this month, two different Institutional Shareholder Services proxy advisory services said. Neuberger Berman said earlier that it would support Ancora's case for change at Norfolk Southern, while Canadian asset manager EdgePoint also reaffirmed on Thursday that it would be voting its shares with the activist. (EdgePoint was initially partnered with Ancora's campaign at Norfolk Southern but dissolved that arrangement months earlier.) Activist Ancora on Thursday won the support of the BMWED Teamsters in the investor's efforts to oust Norfolk Southern CEO Alan Shaw and a majority of the railroad's 13-person board. The labor group said it would back the activist's seven director nominees over Norfolk Southern management, a significant endorsement in an industry unusually dependent on union support. The support from the BMWED Teamsters, whose members build and maintain the track infrastructure that keeps Norfolk Southern trains moving, amounts to a sharp rebuke of Shaw and Norfolk Southern's board. Norfolk Southern and Ancora have been locked in a proxy contest for several months. Neuberger Berman, for example, is backing the activist and said that Norfolk Southern had a history of poor governance and that a boardroom change was needed.

New federal rules say travelers deserve cash refunds when inconvenienced by their airline – not vouchers or travel credits. The rules require the fees to be automatic and prompt: Within seven days for a credit card refund and 20 days for other forms of payment. Surge in complaints in 2022The Biden Administration proposed its change to the refund rules in 2022 after a surge in complaints about refunds when the coronavirus brought air travel to a standstill. More than half of the complaints involved flight disruptions or refunds. A federal law allows Congress to unravel recently implemented executive branch rules.
