In meetings with regulators after the October 2 incident, Cruise officials attempted to show a full video of the impact, shot from the car. Cruise commissioned the law firm of Quinn Emanuel Urquhart & Sullivan to investigate the incident and Cruise’s response to it. Immediately after the incident, Cruise employees were not, themselves, aware that the woman had been dragged, according to the report. Actually, the pedestrian was struck by a human-driven Nissan car first and that impact propelled her into the path of the Cruise car. The report attributed its failures in communication to a “myopic focus” in clearing Cruise of fault in the initial impact.

So, why is the price of bitcoin falling, even after investors got what they wanted? Part of the reason is likely a “buy the rumor, sell the news” mentality, according to Antoni Trenchev, co-founder of crypto lender Nexo. Interestingly, bitcoin ETF activity actually shows net buying. Greyscale’s fund is the largest bitcoin ETF, holding roughly $20 billion in assets. ETFs hold just a small portion of the bitcoin that’s traded, says Eric Balchunas, senior ETF analyst at Bloomberg Intelligence.

COLUMBIA, S.C. (AP) — The Southeastern Conference fined South Carolina $100,000 for its fans storming the court after the top-ranked Gamecocks' 79-62 win over No. The league announced the fine Wednesday, a day after South Carolina posted a win over its highest ranked opponent at home in 14 years. The league gave all members a clean slate so this counts as South Carolina's first offense. Among those celebrating on the court were women's basketball coach Dawn Staley and several members of her team. Kentucky players were gotten off the floor quickly and no such incidents were reported.

In a sea of income-generating exchange-traded funds, BlackRock 's actively managed Flexible Income ETF (BINC) seeks to stand out with a multisector approach that balances high quality and high yield. "The way we built this portfolio is marrying high yield, investment-grade credit, agency mortgages and securitized [products]," Rieder said in an interview. Rieder said he's investing more in European high yield these days because of the strong U.S. dollar. "That is really attractive — and European high yield is cheaper than U.S.," he said. In U.S. high yield, single-B-rated debt is the most attractive, the investor said.

Spotify said Wednesday it will update its iPhone app in Europe to allow users to buy in-app subscriptions and audiobooks. In most regions, Apple's App Store rules prohibit companies such as Spotify from billing users directly within the app. Apple says app makers should instead use Apple's App Store billing service, which takes a cut of up to 30%. Spotify said it will use the new regulation to allow users to subscribe to Spotify Premium, allow users to buy audiobooks, and run promotional campaigns, all within the app. The company will also allow iPhone users to directly download other Spotify apps from its website, such as Spotify for Artists, it said.

"Functionally, the SPAC target IPO is being used as an alternative means to conduct an IPO," Gensler said in a March 2022 statement on the proposed regulations. SPACs: Much more disclosures will be requiredThe new rules will: 1) Expand disclosure requirements regarding SPAC sponsors, SPAC sponsor compensation, conflicts of interest, dilution, and the target company. After a blank-check SPAC goes public, it will usually announce within two years the acquisition of a target company, which is known as a de-SPAC transaction. That in turn drives the share price even higher, creating further losses for short-sellers. The Archer-Daniels-Midland Co. (ADM) grain facility in Mendota, Illinois, U.S.Shares of Archer-Daniels-Midland plunged 24% on Monday, its biggest one-day drop since 1929, after CFO Vikram Luthar was placed on administrative leave as the company investigates accounting practices at its Nutrition segment. The probe brings more uncertainty to ADM's high-margin Nutrition segment, which is under pressure due to weak demand for meat alternatives and other products as well as downtime at a large soy processing facility. The Nutrition segment, however, has not performed well in recent quarters. "First and foremost, understanding the true scope of potential accounting irregularities and their impact on Nutrition segment revenues/margins will be critical," said Goldman Sachs analyst Adam Samuelson. Crypto skeptics aren't changing their tune just because they can now buy bitcoin exposure through an exchange traded fund, according to a Deutsche Bank survey. Since the launch of the ETFs on Jan. 11, bitcoin has fallen about 20% to roughly $39,000, according to FactSet. So far, institutions have been slow to adopt the new funds in portfolios and retail investors aren't entirely convinced they need to, London-based Deutsche Bank analyst Marion Laboure said in a note Tuesday. Looking at bitcoin specifically, Deutsche said 39% of survey participants think it will stick around in the coming years, while 42% anticipate it will disappear. "The crypto world is gradually moving towards greater institutionalization as traditional financial players (tradFi) enter the market," Laboure said.

Exxon Mobil filed a lawsuit against U.S. and Dutch activist investors in a bid to stop them from submitting climate proposals during the oil giant's annual shareholder meeting. An Exxon Mobil win in the proceedings could have a chilling impact on future shareholder petitions. The Securities and Exchange Commission, the U.S. financial regulator, has overseen a growing number of environmental and social shareholder proposals during the past two proxy seasons. In an emailed statement, Exxon Mobil said "the breakdown of the shareholder proposal process, one that allows proponents to advance their agendas through a flood of proposals, does not serve the interests of investors."

Microsoft 's hacking disclosure could be a challenge for its $20 billion-a-year cybersecurity franchise but bullish news for fellow portfolio name and rival Palo Alto Networks. Microsoft stock was trading modestly lower Monday but has climbed more than 5% since the start of 2024 following last year's 56% gains. Microsoft's cybersecurity incident doesn't leave us any less bullish on the mega-cap name. While its cybersecurity business pulls in about $20 billion in annual sales, Microsoft's revenue jumped 7% in 2023 to nearly $212 billion. The Securities and Exchange Commission's (SEC) new disclosure rules around cybersecurity attacks could be another catalyst for Palo Alto, Jim added.

Cryptocurrency investors spent much of 2023 waiting for good news. By the time news broke on Jan. 10 that 11 new bitcoin ETFs would begin trading, crypto investors were taking a victory lap, having bid the coin's price up by 155% in calendar year 2023. "They don't have the ability to put these bitcoin ETFs into client discretionary portfolios, yet," Sigel says. Expect more new crypto ETFs, too — and in different flavors. Experts say these might be as simple as portfolios that combine bitcoin exposure with mainstream investments, such as those in the S&P 500.

The U.S. Securities and Exchange Commission said on Monday that a SIM swap attack was to blame for the breach of its official account on X (formerly Twitter) earlier this month. With access to the phone number, the unidentified individual then reset the account password. "While multi-factor authentication (MFA) had previously been enabled on the @SECGov X account, it was disabled by X Support, at the staff's request, in July 2023 due to issues accessing the account," the SEC said in the statement. The agency had the ability to switch two-factor authentication back on for their X account and were not reliant on X to do so. Exchange-traded fund experts anticipate spot bitcoin ETFs, which debuted this month, to spark a new wave of crypto products. Cboe Global Markets' Catherine Clay believes options are a natural progression for bitcoin ETFs. The Cboe, the largest U.S. options exchange, filed with the SEC on Jan. 5 to offer options linked to bitcoin exchange-traded products. "Folks who might not have been traditionally speculating on crypto directly in the crypto ecosystem are now going to have something to play with." Federal prosecutors on Friday announced charges against a German businessman, alleging he scammed investors out of more than $150 million in a crypto fraud scheme. But in actuality, Jicha and two unnamed co-conspirators, both USI Tech executives, lured and defrauded investors in a "multilevel marketing scheme," prosecutors allege. Around the spring of 2017, Jicha and his co-conspirators began "aggressively promoting" USI Tech, prosecutors said. In 2018, as regulators began scrutinizing USI Tech, prosecutors alleged that Jicha terminated the company's U.S. operations, preventing investors from withdrawing their money. Since then, around $150 million of that money has been transferred to accounts controlled by Jicha, prosecutors said Friday.

Musk appeared to give Tesla's board an ultimatum on Monday, saying he wants 25% voting control at Tesla or he'll stop growing AI development at the electric-car maker. One way of getting that would be via a dual-class stock structure. This isn't uncommon and could mean Musk wouldn't necessarily get more shares but that the ones he held would deliver more voting power. The company's dual-class stock structure provides Zuckerberg and select executive managers and directors with them. "Zuckerberg probably wouldn't have gone public without a dual-class structure," White said.
