☆ Supreme Court to Hear Case on Trump’s Eligibility for Another Term

The Supreme Court will hear arguments on Thursday in an extraordinary case that could alter the course of the presidential election by deciding whether former President Donald J. Trump’s conduct in trying to subvert the 2020 race made him ineligible to hold office again. Not since Bush v. Gore, the 2000 decision that handed the presidency to George W. Bush, has the Supreme Court assumed such a direct role in the outcome of a presidential contest. The sweep of the court’s ruling is likely to be broad. It will probably not only resolve whether Mr. Trump may appear on the Colorado primary ballot, but it will also most likely determine his eligibility to run in the general election and to hold office at all. The case is just one of several involving or affecting Mr. Trump on the court’s docket or approaching it.

American CEOs are finally feeling more upbeat about the US economy, with the mood turning more positive for the first time in two years. WASHINGTON (AP) — The top vote-getter in Tuesday’s Republican presidential primary in Nevada wasn’t former U.N. Instead, Nevada voters mounted a ballot-box protest and gave the most votes to “None of these candidates,” a ballot option required by state law. At the time the race was called, “None of these candidates” led with about 60% of the vote. Initial returns showed “None of these candidates” leading in seven counties that Trump carried in his 2016 Nevada caucus win. The Nevada Republican Party opted to hold a presidential caucus Thursday to award delegates and has essentially disavowed the primary.

☆ CVS fined in Ohio for understaffing pharmacy, risking staff and patient safety

The investigation found that the store was seriously short staffed, pharmacy phones were not working properly and the AC unit was broken. A follow-up visit by agents revealed that the pharmacy was over a month behind in filling prescriptions, according to the agency’s report. In addition to the fine, regulators also put the 7292 Fulton Drive CVS store on probation for at least three years during which it will be subject to enhanced monitoring. The issues being investigated range from hundreds of prescriptions allegedly being past due, pharmacy staffing shortages, clutter and unsafe working conditions and concerns about maintaining adequate medications safety inside the pharmacy. These concerns led some pharmacists to walk out of CVS and Walgreens stores pharmacies last fall and ignited a national push to unionize pharmacy workers.

CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. Jim Justice is planning to auction off land at a sporting club located at the governor’s posh resort. But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court and result in further delays. The judges gave Trump until February 12 to ask the Supreme Court to pause the ruling. The appeals court took center stage in the immunity dispute after the Supreme Court in December said it was at least temporarily staying out of it, rejecting a request from Smith's team to take up the matter quickly and issue a speedy ruling. Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. The cases are entirely separate – this is a criminal prosecution against Trump, and the upcoming Supreme Court case is a civil attempt to remove Trump from state ballots. Further, the appeals court’s findings and explanations in Tuesday’s ruling are not binding on the Supreme Court.

Circuit Judge Consuelo Callahan, another Bush appointee, dissented, saying the state had not shown a likelihood of success on appeal. Plaintiffs challenging the law in court included Kim Rhode, who has won three Olympic gold medals in shooting events, and the California Rifle & Pistol Association. California voters had in 2016 approved a ballot measure requiring gun owners to undergo initial background checks to buy ammunition, and pay $50 for a four-year ammunition permit. CNN —Philadelphia 76ers superstar Joel Embiid is set to undergo surgery to deal with a left knee issue, the team announced on Sunday. “Joel Embiid will have a corrective procedure this week to address an injury to the lateral meniscus in his left knee. Embiid has spent time out of the Philadelphia lineup this season as result of persistent injury issues and has missed 14 out of the 76ers’ 48 games. The Cameroonian was recently named to his seventh career All-Star team, but it appears that he will miss this month’s festivities in Indianapolis. Embiid can only miss three more games before he becomes ineligible for an award, meaning that his injury essentially takes him out of MVP contention.
