First openly transgender lawyer to argue at Supreme Court

An American Civil Liberties Union lawyer will make history in December as the first openly transgender attorney to argue before the U.S. Supreme Court, opposing Tennessee’s Republican-backed law banning gender-affirming medical care for transgender minors. The Supreme Court on Monday ordered that the argument time for the ban’s challengers be divided between the Justice Department and attorneys representing the original plaintiffs who sued the state. Several plaintiffs — including two transgender boys, a transgender girl and their parents — sued in Tennessee to defend the treatments they have said improved their happiness and wellbeing. The Supreme Court has confronted several cases in the past decade implicating LGBTQ rights. In 2020, it ruled that a landmark federal law forbidding workplace discrimination protects gay and transgender employees.

WASHINGTON — The Supreme Court on Monday rejected disbarred lawyer Michael Cohen’s last-ditch effort to revive a civil rights claim against his former boss Donald Trump. But constitutional claims against individual federal officials are notoriously difficult to bring as a result of a line of Supreme Court rulings. In a 2022 case called Egbert v. Boule, the Supreme Court effectively put “Bivens claims” on life support in a ruling that tossed out allegations against a Border Patrol agent. A federal judge in New York and the 2nd Circuit U.S. Court of Appeals both highlighted the Supreme Court’s recent ruling in throwing out Cohen’s claims. Unless Congress passes legislation to allow a form of Bivens claims, there are few legal avenues to seeking accountability when federal officials, including thousands of law enforcement officials, commit unlawful acts.

The Biden administration is proposing a rule that would provide women with private insurance access to over-the-counter birth control pills and other contraceptives at no cost, the White House said on Monday. “This rule, once finalized, will expand contraception coverage for 52 million women of reproductive age with private health insurance,” White House Gender Policy Council Director Jennifer Klein said during a briefing. “For the first time ever, women would be able to obtain over-the-counter contraception without a prescription at no additional cost, and health plans would have to cover even more prescribed contraceptives without cost sharing,” she said. Perrigo Co.’s Opill is currently the only daily birth control pill approved for sale without a prescription by the Food and Drug Administration, but the proposed rule covers other forms of over-the-counter contraceptives, including emergency contraception such as morning after pill Plan B, spermicides, birth control sponges, and condoms. The rule will also require that health plans cover all FDA-approved contraceptive drugs and some devices, including IUDs, without cost sharing in many cases.

Ron DeSantis penned the cease-and-desist letters sent by Florida’s health department threatening to criminally prosecute local TV stations over their airing of an abortion rights ad, the department’s former general counsel said in court documents. “I did not draft the letters or participate in any discussions about the letters prior to October 3,” Wilson wrote. Spokespersons for DeSantis and the Florida Department of Health did not immediately respond to CNN requests for comment. Wilson’s allegations come after local TV stations began airing an ad by Floridians Protecting Freedom, the group behind the state’s “Yes on 4 Campaign,” promoting a ballot measure seeking to overturn the state’s six-week abortion ban by enshrining abortion rights in the state’s constitution. CNN —In the year and a half following the Supreme Court Dobbs decision that revoked the federal right to an abortion, hundreds more infants died than expected in the United States, new research shows. They found that infant mortality was higher than usual in the US in several months after the Dobbs decision and never dropped to rates that were lower than expected. In the months that infant mortality was higher than expected – October 2022, March 2023 and April 2023 – rates were about 7% higher than typical, leading to an average of 247 more infant deaths in each of those months. She was not involved in the new study, but does research abortion trends in the US. Abortion bans may affect access to and willingness to seek prenatal care and broader support systems, she said, and the barriers compound.
