Trump’s lawyers are urging the full panel of appellate judges to rule on the constitutionality of the gag order, people familiar with the matter say. Previously, Trump’s lawyers asked an appeals court judge to take emergency action and stop the trial so they could appeal the gag order. After hearing oral argument, the appeals court judge denied the request and both sides were ordered to file written briefs. Trump’s attorneys are now asking the appellate panel to expedite their ruling on whether the gag order is constitutional. Judge Juan Merchan has found Trump has violated the gag order 10 times and fined him $10,000 for public statements Trump made about certain witnesses and the jury.

The Georgia Court of Appeals will hear an appeal of a ruling that allowed Fani T. Willis, the district attorney in Fulton County, to continue leading the prosecution of former President Donald J. Trump on charges related to election interference, the court announced on Wednesday. The decision to hear the appeal, handed down by a three-judge panel, is likely to further delay the Georgia criminal case against Mr. Trump and 14 of his allies, making it less likely that the case will go to trial before the November election. The terse three-sentence announcement reopens the possibility that Ms. Willis could be disqualified from the biggest case of her career, and one of the most significant state criminal cases in the nation’s history. At issue is a romantic relationship she had with Nathan Wade, a lawyer she hired to handle the prosecution of Mr. Trump. Defense lawyers argued that the relationship amounted to an untenable conflict of interest, and that Ms. Willis and her entire office should be removed from the case.

Judge Aileen Cannon on Tuesday delayed Donald Trump's classified documents case indefinitely. AdvertisementUS District Judge Aileen Cannon handed former President Donald Trump yet another legal win when she delayed his classified documents case indefinitely on Tuesday. It's just the latest legal win for Trump in the classified documents case handed to him by Cannon. Ty Cobb, a former Trump White House attorney, told CNN on Tuesday that Cannon's latest decision was "a combination of bias and incompetence." In light of Cannon's latest delay, Kalir said it was not surprising given her prior actions on the case.

The independent Oversight Board that hears appeals about content decisions on Facebook and Instagram said Tuesday it would consider whether the pro-Palestinian phrase "from the river to the sea" violates the platforms' rules including their ban on hate speech. In each of the three cases, other Facebook users reported the phrase, saying it violated platform rules on hate speech, incitement or violent organizations. The users opposed to the phrase then appealed to the Oversight Board. One of the Facebook posts being reviewed by the Oversight Board received about 8 million views, the board said. In one of its most significant decisions, the Oversight Board in 2021 upheld the suspension of former President Donald Trump from Meta's platforms but ruled that it was inappropriate to make the ban indefinite.

Ms. Daniels could take the stand to testify against Mr. Trump as early as this week. Her presence would let Mr. Trump’s defense lawyers attack Ms. Daniels as an extortionist and question her credibility. Nor can she testify about the plan for Mr. Trump to hide his reimbursements to Mr. Cohen by characterizing them as legal fees. Mr. Trump’s lawyers contend that he did not know that the checks he signed for Mr. Cohen were not for legal fees, and that Mr. Cohen and Mr. Trump’s employees were responsible for any false records. “He has never thought that the little man, or especially women, and even more, women like me, matter,” Ms. Daniels said.

He learned late Tuesday afternoon that Judge Aileen Cannon, whom he appointed, indefinitely postponed a trial in his classified documents case in Florida. She told the jury Tuesday about a $130,000 hush money payment she received from Cohen before the 2016 election. But prosecutors allege Trump falsified business records to hide it and to mislead voters in an early bout of election interference. The judge complained that the ex-president was “cursing audibly” during Daniels’ testimony and was shaking his head. “Am I correct that you hate President Trump?” Necheles asked.

TikTok sues to block prospective US app ban

If it loses, TikTok could be banned from US app stores unless its Chinese parent company, ByteDance, sells the app to a non-Chinese entity by mid-January 2025. But Virginia Democratic Sen. Mark Warner, an advocate for the TikTok legislation, said in remarks on the Senate floor in April that the briefings provided critical insight into the risk TikTok poses. US policymakers have described the law at issue as a forced divestiture of TikTok, not an outright app ban. Some US officials have been trying to ban TikTok from the United States since 2020, when former President Donald Trump moved to block the app by executive order. (Trump has since reversed his position, saying a TikTok ban would only help Meta, a company Trump blames for his 2020 election defeat.)

TikTok is suing the US government over its new law that forces a sale or ban of the app. AdvertisementTikTok promised to fight its ban in the US — and now the social-media giant has made it official. TikTok has denied both of these claims, and the US government has yet to present evidence that either action has occurred. Legal scholars told Business Insider that well-articulated First Amendment arguments tend to prevail in court, but Congress' national-security concerns could ultimately win out. Hans, an associate clinical professor of law at Cornell Law School and associate director of its First-Amendment clinic, told BI.

New York CNN —A group of 13 conservative US federal judges are vowing to not hire Columbia University law students or undergraduates because of how the school has handled pro-Palestinian demonstrations on its campus in recent weeks. “As judges who hire law clerks every year to serve in the federal judiciary, we have lost confidence in Columbia as an institution of higher education. CNN has reached out to Columbia University for comment. They typically hire law school graduates for clerkships that can eventually lead to high-paying and prestigious jobs. If not, employers are forced to assume the risk that anyone they hire from Columbia may be one of these disruptive and hateful students,” the judges wrote.

Circuit, argues that the bill, the Protecting Americans from Foreign Adversary Controlled Applications Act, violates constitutional protections of free speech. Now, legal proceedings will pause that timeline, meaning it could be years before a ban goes into effect. Tuesday's lawsuit is the latest development in what has become a multi-year effort by the U.S. government to effectively ban TikTok. Efforts to rein in the popular video-sharing app have persisted since 2020 under both the Trump and Biden administrations. Customers shop at the new Apple Store at the World Trade Center shopping mall in New York City. The manager of an Apple Inc retail store in Manhattan violated U.S. labor law by asking an employee whether he supported a union campaign, a federal labor board has ruled in its first decision involving the tech giant. The Democrat-controlled board also affirmed the judge's ruling that Apple illegally barred workers at the World Trade Center store from distributing union flyers. At least two Apple stores in the U.S. have unionized since 2022, and unions are working to organize several other locations including the World Trade Center store. The ruling requires Apple to post notices at the store informing workers that it violated the law and informing them of their legal rights.

Israel's military on Monday said it has begun evacuating Palestinians from parts of Gaza's southern city of Rafah, ahead of an expected military operation where roughly half of the enclave's entire population is sheltering. "The IDF will act with extreme force against terrorist organizations in your areas of residence, as it has done so far. Anyone who is close to terrorist organizations puts his life and the life of his family at risk," the post said. Some legal observers believe the Weinstein decision could prove relevant as the hush money trial against former President Donald Trump unfolds in Manhattan. Judge Juan Merchan, who is overseeing the trial and making day-by-day decisions about what evidence is allowed in court, is bound to the same guidelines as the Weinstein trial judge. Stephen Gillers, professor of law at New York University, said the Weinstein ruling will certainly be important to Merchan. Judge Madeline Singas dissented from the Weinstein appeals court ruling, saying the information was needed for the jury to consider. Gillers said the Weinstein decision is not just weighing on the judge’s mind.

President Biden traveled on Thursday to North Carolina, a possible swing state in the fall election, to promote his efforts to replace toxic lead pipes as part of his administration’s program to expand and upgrade the nation’s network of roads, airports and other critical infrastructure. “Until the United States of America, God love us, deals with this, how can we say we’re a leading nation in the world?” he told a crowd of supporters at the Wilmington Convention Center. “For God’s sake, we’re better than this.”Mr. Biden has committed to replacing all lead pipes across the nation within a decade. Lead exposure can affect brain development in children, damage kidneys and interfere with the production of red blood cells that carry oxygen. The administration estimates that more than nine million homes, schools, day care centers and businesses still receive water through lead pipes, particularly in communities of marginalized people.

CNN —When a Manhattan jury found movie mogul Harvey Weinstein guilty of sex crimes in 2020, the verdict seemed to herald a new era of accountability. I was not shocked by the reversal, nor do I view this as the demise of sex crimes prosecution. New York's highest court overturned his sex crimes conviction last week. Another important innovation is the use of sex crimes experts to educate the jury — and in high-profile cases, the public. The Louisiana secretary of state has ordered that the congressional map be finalized by May 15. Even so, they said, it was evident that creating a second district with a majority of Black voters was lawmakers’ overarching objective. But in the map drawn by the Republican-controlled Legislature, only one of the six congressional districts had a majority Black population. The ruling reaffirmed the Voting Rights Act of 1965, which had been diminished over the years by the court’s conservative majority. Critics of Tuesday’s ruling argued that the repercussions in Louisiana could extend beyond a single election, or even partisan divisions.

Harvey Weinstein will be retried in New York, the Manhattan District Attorney's Office said on Wednesday, a week after the state's highest court threw out his 2020 rape conviction. Weinstein, 72, had been serving a 23-year sentence in a prison in upstate Rome, New York. The conviction included charges of first-degree sexual assault and third-degree rape. The court’s ruling upended the case against Weinstein, whose downfall stood as a symbol of the success of the #MeToo movement. The appeals court ordered that Weinstein receive a new trial. Yet #MeToo has had mixed success in the courtroom, and this is the second high-profile case to be overturned on appeal. Tanger CEO Stephen Yalof told CNBC's Jim Cramer on Wednesday why it can be more valuable to replace tenants instead of renewing leases. "We've traditionally, at least over the last couple of years, have renewed existing tenants at a rate of about 95%," Yalof said. He added that not renewing a tenant's lease doesn't mean Tanger is getting rid of them completely. Yalof also explained how Tanger appeals to luxury brands. Because "the customer is aspirational," he said outlets draw in new clientele that may not have considered these high-end brands otherwise.
