The Supreme Court ruled today that states do not have the power to disqualify a presidential candidate from running for office under the 14th Amendment, an authority Colorado, Illinois and Maine had tried to use to bar Donald Trump from their ballots. The court had been widely expected to reject the challenges to Trump’s ballot eligibility. Though the justices provided different reasons, none took a position on whether Trump had engaged in an insurrection — which the states said made him ineligible under Section 3 of the 14th Amendment. All nine said that states could not bar candidates from federal office, while five went further, arguing that Congress must act to give Section 3 force. In an interview on a conservative radio program, Trump said he was pleased by the outcome.

The United States estimates Russia has a stockpile of up to 2,000 tactical nuclear warheads, some small enough they fit in an artillery shell. But the detonation of any tactical nuclear weapon would be an unprecedented test of the dogma of deterrence, a theory that has underwritten America’s military policy for the past 70 years. Possessing nuclear weapons isn’t about winning a nuclear war, the theory goes; it’s about preventing one. If Mr. Putin dropped a nuclear weapon on Ukraine — a nonnuclear nation that’s not covered by anyone’s nuclear umbrella — what then? Many in the administration believed the Kremlin’s dirty bomb ploy posed the greatest risk of nuclear war since the 1962 Cuban missile crisis.

CNN —The Supreme Court will likely produce thousands of words when it decides this year whether former President Donald Trump may claim immunity from special counsel Jack Smith’s election subversion charges. Every time the Supreme Court grants an appeal it settles on a specific legal question to resolve. In the immunity matter, the court didn’t embrace Trump’s framing – nor the question Smith posed when he sought review on the same issue in December. “The question implicitly rejects Trump’s position of absolute immunity because of that language ‘whether…and to what extent,’” Eisen said.
