The White House decided to delay by two years tariffs on graphite, a key metal in EV lithium-ion batteries that helps them store energy. But a senior Biden administration official said during a call with reporters that some tariffs would kick in in 2026 to allow battery supply chains to transition. However, those batteries can still source graphite from China until at least 2027 under the Biden administration's policy. Beyond graphite, other tariffs that Biden slapped on China's green tech are mostly symbolic. But steeper taxes on batteries this year could affect US automakers such as Ford and Tesla, which import from China.

Jean Carroll have asked a federal appeals court to expedite Donald Trump’s appeal of the verdict in their first trial in which a jury awarded Carroll $5 million in damages after finding Trump liable for defamation and battery in May 2023. The motion with the 2nd US Circuit Court of Appeals filed Tuesday cites Trump’s numerous attempts to delay both trials with Carroll as a signal that he’s likely to drag out the appeal. The jury in the second trial held in January determined Trump should pay Carroll $83.3 million in damages for defaming her. Her lawyers also asked the appeals court to consider the author’s progressing age. Carroll is an 80-year-old woman who has struggled mightily to obtain justice for almost five years,” the filing says.

Trump Media & Technology Group filed a notice to the US Securities and Exchange Commission on Wednesday that it would delay its quarterly filing, just days after the regulator charged its former auditor with fraud. Former US President Donald Trump’s media company said it was unable to complete the review of its financial statement for the quarter ended March 31 due to the timing of its appointment of Semple, Marchal & Cooper as the new auditor. The company dismissed previous auditor BF Borgers, after the SEC charged the accounting firm with “massive fraud” earlier this month. The stock has since then cut its gain to about 5%, giving it a market value of about $7 billion. Truth Social’s revenue was $4.13 million last year, up from $1.47 million in 2022.

Automotive and trade experts say the increased tariffs are a near-term protectionism act that may delay, but won't stop, Chinese automakers from coming to the U.S. with EVs. The EV tariffs, including other increases regarding battery materials, were among new tariff rates on $18 billion worth of Chinese imports. The quality and build of vehicles by Chinese automakers have gotten significantly better in recent years, as the Chinese government has subsidized their operations to grow domestic production. GM and others have found it hard to compete against budget and mainstream Chinese vehicles, including EVs.

CNN —The world will have to wait at least another week before the highly anticipated first crewed mission of Boeing’s Starliner spacecraft. Starliner teams traced the leak to a flange on a single reaction control system thruster, where helium is used to allow the thrusters to fire. Both Boeing and NASA are developing tests and solutions for the leak, the release said. Meanwhile, Boeing’s rival under NASA’s commercial crew program — SpaceX — has become the go-to transportation provider for the space agency’s astronauts. The valve has since been replaced, but the new issue with the helium leak on the Boeing spacecraft that sits atop the rocket is causing further delay.

Wilmington, Delaware CNN —The federal judge overseeing Hunter Biden’s gun case in Delaware refused on Tuesday to delay the June 3 trial date despite pleas from lawyers for the president’s son who said they would not be prepared in time. “I trust everyone can get done what needs to be done,” US District Judge Maryellen Noreika said during a status conference in Wilmington. Hunter Biden’s lawyer Abbe Lowell argued the defense team would not be able to accomplish all that needs to be done in under three weeks. “I don’t need to be your scheduling secretary,” Noreika said, telling Lowell to work out new filing deadlines with the prosecution ahead of the trial date. Tuesday’s decision from the judge came after Hunter Biden’s latest attempts to throw out the case were rejected in back-to-back rulings last week from the 3rd US Circuit Court of Appeals and Noreika.

CNN —Former Trump adviser Steve Bannon should begin serving a four-month prison sentence now that a federal appeals court has upheld his contempt-of-Congress conviction, the Justice Department told a federal judge Tuesday. US District Judge Carl Nichols, who presided over Bannon’s trial, had paused Bannon’s sentence while an appeal of his conviction played out. He has given Bannon until Thursday to respond to the DOJ’s request. Circuit rejected defendant’s appeal on all grounds, including the primary argument on appeal: the requisite mental state required for a contempt of Congress violation,” the Justice Department wrote. The timing of when Bannon will be expected to report to prison is still unclear.
