The judge presiding over the civil fraud trial of Donald J. Trump on Wednesday signaled that he might again punish the former president for violating a gag order that bars Mr. Trump from attacking court staff. The judge, Arthur F. Engoron, has already fined Mr. Trump for comments he made about his law clerk, Allison Greenfield, whom the former president was barred from discussing after he attacked her on social media in the opening days of the trial. During a break in the trial on Wednesday, Mr. Trump called Justice Engoron partisan — which is allowable under the order — but then continued by saying “with a person who’s very partisan sitting alongside him. Perhaps even much more partisan than he is.”After the break, the judge said he was concerned that the overheated environment in the courtroom could result in real danger.

"This judge is a very partisan judge," Trump was quoted by the AP as saying, "with a person who is very partisan sitting right beside him, perhaps even more partisan than he is." Engoron's principle law clerk, Allison Greenfield, sits some three feet to the judge's right. The gag was necessary, the judge explained at the time, because Trump had repeatedly "disparaged" the law clerk on social media, falsely calling her "Schumer's girlfriend."

The defense plans to call three witnesses, as well as Bankman-Fried, to after it begins presenting its case to the jury in Manhattan federal court on Thursday. Bankman-Fried has pleaded not guilty to seven counts of federal fraud related to the collapse of his cryptocurrency empire, FTX, nearly a year ago. For the past three weeks, jurors have heard damning evidence from prosecutors that cast Bankman-Fried as a criminal mastermind behind a multibillion-dollar fraud. Several witnesses, including his ex-girlfriend and other members of his inner circle, have cooperated with the prosecution and pleaded guilty in the hopes of receiving a lighter punishment.

Judge Arthur Engoron said the website’s retention of the post was a “blatant violation" of his Oct. 3 order requiring Trump to immediately delete the offending message. “I’ll take this under advisement," Engoron said after Kise explained the mechanics of how Trump’s post was able to remain online. The judge ordered Trump to delete the post, which he did, and warned of “serious sanctions” for violations. Before Trump deleted the post from his Truth Social platform, as ordered, his campaign copied the message into an email blast to supporters. That email, with the subject line “ICYMI," was automatically archived on Trump’s website, Kise said.
