U.S. House of Representatives Speaker Mike Johnson did not say that a woman’s duties include giving birth to able-bodied workers, according to his spokesperson, despite posts online sharing the quote. The quote attributed to Johnson in a post on Instagram (archived), reads: “Every Woman has a duty to birth at least one able-bodied worker.” A similar quote was shared on Facebook (archived). In a May 2022 House Judiciary Committee hearing, Johnson did suggest that abortion deprives the national economy of potential “able-bodied workers”, during a discussion of the Supreme Court’s anticipated overturning of Roe v. But if Chief Justice John Roberts is hoping to deflect partisan attacks on the Court, it’s likely to be a bad political bet. The critics are already calling the code inadequate and see it as proof that the Justices will bend to political pressure. The code of conduct’s first good deed is putting the Supreme Court in its proper context, which is atop a judiciary that the Constitution makes a coequal branch of government. Sen. Sheldon Whitehouse and other Democrats want Congress to dictate detailed “ethics” procedures to the High Court.

In recent months, Justices Elena Kagan and Amy Coney Barrett have publicly supported the adoption of an ethics code. The most glaring defect of the new code is its complete lack of any enforcement power. And yet the absence of any discipline or enforcement was the central flaw that led to calls for an ethics code in the first place. “A justice should not allow family, social, political, financial or other relationships to influence official conduct or judgment.” Well, sure.
