Harvey Weinstein pleaded not guilty Wednesday to a new sex crime charge in New York, as he awaits retrial in his landmark #MeToo case. Prosecutors revealed last week that Weinstein had been indicted on additional sex crime charges that weren't part of the case that led to his now-overturned 2020 conviction. While bracing for the new charges, Weinstein also is awaiting retrial after New York state's highest court this spring overturned his 2020 conviction on rape and sexual assault charges involving two women. Weinstein, who also was convicted in 2022 in a Los Angeles rape case, remains behind bars while awaiting his New York retrial.

CNN —Harvey Weinstein has pleaded not guilty to one count of a criminal sex act in the first degree after he was indicted by a grand jury earlier this month. The indictment was unsealed after it was initially announced during a court hearing last Thursday. An attorney for the woman whose grand jury testimony served as the basis of the new indictment said she intends to testify at trial. Prosecutors in New York began presenting the case to the grand jury in August. His conviction was overturned by the New York Court of Appeals in April, citing violation of Weinstein’s constitutional rights at trial.

CNN —A critical witness in the original trial of disgraced Hollywood producer Harvey Weinstein has announced she will testify in his upcoming retrial on criminal charges. After Weinstein’s conviction was overturned earlier this year, Mimi Haley, a former production assistant on The Weinstein Company’s “Project Runway,” said she wasn’t sure if she wanted to go through it all again. Haley alleged that Weinstein had pinned her down and forced her into a sex act in 2006 at his Manhattan apartment. Last week, he was indicted in Manhattan in connection to new sexual assault allegations, according to prosecutors. If he is cleared to attend the hearing, Weinstein is expected to be arraigned on the new indictment.

CNN —A Manhattan grand jury has indicted Harvey Weinstein on new sex crime charges, according to his attorney Arthur Aidala. “The grand jury has indicted Mr. Weinstein,” prosecutor Nicole Blumberg said during a court hearing on Thursday. It could include sexual assault allegations from three women, prosecutors said at a separate hearing last week. One alleged assault occurred at a residential building in lower Manhattan in the winter months between 2005 and 2006. Harvey Weinstein had heart surgery Monday after he complained of health issues and was moved from a New York City jail to a hospital, a representative for the disgraced movie mogul said. Weinstein, whose 2020 rape conviction was overturned in April, remained in recovery at the intensive care unit at Bellevue Hospital on Monday night, said the representative, Craig Rothfeld. Weinstein was moved from Rikers Island jail to the hospital after complaining that he didn’t feel well and had experienced significant weight gain from medication, Rothfeld said. He underwent pericardiocentesis surgery Monday morning to alleviate a significant amount of fluid from his lungs and heart, Rothfeld said. In July, Weinstein was hospitalized for a “myriad of health conditions” and tested positive for Covid-19 and double pneumonia, his representative said.

CNN —Harvey Weinstein was “rushed” to Bellevue Hospital in New York on Sunday night “due to several medical conditions,” according to representatives for the disgraced former movie producer. “We can confirm that Mr. Weinstein had a procedure and surgery on his heart today,” Weinstein’s spokesman Juda Engelmayer and prison consultant Craig Rothfeld said in a statement to CNN on Monday. “As we have extensively stated before, Mr. Weinstein suffers a plethora of significant health issues that need ongoing treatment,” they added. Weinstein has experienced a number of health problems in recent years and has appeared in court in a wheelchair. He was sentenced to 23 years in prison, but his conviction was overturned on appeal in April.

And now it wants Microsoft and the cybersecurity firm that caused the problem to compensate it for at least some of its losses. Delta has hired high-profile attorney David Boies’ law firm to seek damages from cyber security firm CrowdStrike and Microsoft for the massive service issues it suffered last week following a badly flawed software update caused problems in a key computer program. The hiring of the firm of Boies Schiller Flexner, first reported by CNBC, was confirmed to CNN by a person familiar with the decision. Delta’s costs could total between $325 million to $475 million, according to a note published Tuesday by Savanthi Syth, airline analyst for Raymond James. Boies and his firm won $290 million in 2023 from JPMorgan Chase for Jeffrey Epstein’s sexual abuse victims.

The stock fell as much as 13% on Tuesday alone after heavily-hit Delta reportedly hired a lawyer. No suit has been filed, but Delta plans to seek compensation from CrowdStrike, CNBC said. The continued fallout comes after CNBC reported that Delta hired attorney David Boies — chairman of Boies Schiller Flexner — to seek compensation for outage-related damages, according to CNBC. CrowdStrike shares fell tumbled 11% on Tuesday to their lowest level of the year following a report that Delta Air Lines hired prominent attorney David Boies to seek damages from the security software vendor. CrowdStrike fell $28.98 to $228.83 as of early afternoon trading. Late Monday, CNBC's Phil Lebeau reported that Delta hired Boies, chairman of Boies Schiller Flexner, to seek compensation from CrowdStrike and Microsoft . No suit has been filed, Lebeau reported, and Delta didn't respond to a request for comment. The Department of Transportation said last week that it's investigating Delta due to the widespread flight disruptions and service failures.
