Summoned to Detroit Lions coach Dan Campbell’s office on a late-October Tuesday in 2022, Goff feared the worst, and with good reason. CNN —The morning after Donald Trump was reelected president, Justices Samuel Alito and Elena Kagan began jousting more than usual. More than other justices on their respective sides, conservative Alito and liberal Kagan are sharp-tongued strategic questioners. As usual, Alito and Kagan began referring to each other’s questions but with barely a glance toward the other at their elbow. Skeptical of the litigants’ case, Alito asked their lawyer Deepak Gupta why Huang would have put out financial information that could be quickly exposed as wrong. Then Alito said, “Well, I don’t want to derail … Justice Kagan had a number of hypotheticals, but I don’t want to interrupt that.”Kagan seemed miffed, but only slightly.

The former New York City mayor was in federal court in Manhattan on Tuesday to discuss his continuing failure to give up nearly $11 million worth of personal assets. The forfeiture was meant as a down payment on the $148 million Mr. Giuliani owes to two Georgia election workers for defaming them by claiming, without evidence, that they had helped to steal the 2020 presidential election. But first, Judge Lewis Liman allowed Mr. Giuliani’s lawyers to withdraw from the case. “I’m sorry it came to this,” Kenneth Caruso, one of the Mr. Giuliani’s lawyers, said before he and his co-counsel left the hearing. In a statement on Tuesday, Mr. Caruso said that there had been “a difference of opinion” with Mr. Giuliani but they wished his new counsel “every success.”

The federal elections case led to a Supreme Court ruling granting a president limited immunity for official acts. This is likely to reinforce Trump’s belief that he will have almost unchecked authority and will therefore reverberate through the next four years and generations to come. And by voting the way they did, Americans effectively exonerated him in the federal cases — on charges that could have landed him in jail. In today’s edition, senior politics reporter Alex Seitz-Wald breaks down the long-standing Democratic truisms that were challenged by the results of the 2024 elections. Here are five of the party’s core assumptions that have been challenged by the 2024 election outcome:1. Higher turnout benefits Democrats: Democrats have long taken for granted a simple truism: The more people who vote, the better for Democrats. NBC News exit polls show Trump won voters without college degrees 56%-42%, while he narrowly won voters with family incomes of $30,000 to $100,000 annually. But Trump won both the Electoral College and popular vote this year as Harris’ performance fell in those Democratic bastions.

WASHINGTON — Special counsel Jack Smith filed motions to drop all federal charges against President-elect Donald Trump regarding his mishandling of classified documents and his effort to overturn his 2020 presidential election in the lead-up to the deadly Jan. 6 attack on the U.S Capitol. But the circumstances have," the special counsel added. Special counsel regulations require Smith to file a report to the attorney general explaining his charging decisions before he steps down. In a decision that legal experts widely criticized and that Smith vowed to appeal, Cannon found that Smith had not been properly appointed as a special counsel. Trump spokesman Steven Cheung said in a statement, “Today’s decision by the DOJ ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law.

Will Trump’s former defense lawyer protect the Justice Department from Trump? Justice Department attorneys now hope that Trump’s pick for the critical No. 2 position at the department — Todd Blanche, the president-elect’s defense lawyer — can help protect the department’s career civil servants from Trump. Blanche served as Trump’s lead criminal defense lawyer in the Stormy Daniels hush money case brought by Manhattan District Attorney Alvin Bragg. Both cases against Mr. Trump — for his attempt to overturn the 2020 election and his later hoarding of classified government documents and obstruction of efforts to retrieve them — were short-circuited by the fact that he won the 2024 election before they could be definitively resolved. Jack Smith, the special counsel who brought both cases against Mr. Trump, asked courts on Monday to shut them down. The result is not just that Mr. Trump appears set to escape any criminal accountability for his actions. (Mr. Smith left the door open to, in theory, refiling the charges after Mr. Trump leaves office, but the statute of limitations is likely to have run by then.) It also means that two open constitutional questions the cases have raised appear likely to go without definitive answers as Mr. Trump takes office.

CNN —Even before special counsel Jack Smith formally asked that his criminal cases against Donald Trump be dismissed, it was already guaranteed the president-elect would never see a jury. “I would fire him within two seconds.”In the end, though, Trump didn’t need to sack the special counsel to kill the two cases. Attorney General Merrick Garland is expected to publicly release it, as he has with past special counsel reports. What to do next in the case will be a question for the incoming Trump Justice Department. But a new chapter has already opened for several members of the Trump legal team who have already been rewarded with plum positions in his incoming administration.

CNN —Special counsel Jack Smith is dropping the federal election subversion and the mishandling of classified documents cases against President-elect Donald Trump, seeking the cases’ dismissal in court filings Monday. Trump has said he would fire Smith once he retook the office, shattering previous norms around special counsel investigations. In the election case Trump faced in Washington, DC, Smith charged the former president over his efforts to overturn his 2020 election loss, a plot that culminated in the January 6, 2021, Capitol attack. “The Government’s position on the merits of the defendant’s prosecution has not changed,” Smith said in the filing. In the documents case brought in Florida, Trump was indicted for allegedly taking classified national defense documents from the White House after he left office and resisting the government’s attempts to retrieve the materials.

The real verdict on Donald Trump will be issued by the American people. That was the familiar rejoinder to those frustrated by the inability of the legal system to hold Trump accountable for the crimes he was charged with, against the American government and against its people. Instead of facing a jury of 12, Trump would face a jury of 160 million, give or take. It was the most democratic manner in which to handle this unique and imminent threat to democracy. Trump will spend the next four years (at least) as the most powerful man in the world and without fear of a federal indictment while in office.

Gabbard and another contentious Trump pick — Pete Hegseth, who has been tapped to lead the Defense Department — came under sharpened scrutiny Sunday as the spotlight shifted from Matt Gaetz, Trump’s toppled choice to be attorney general. Trump’s pick of Hegseth is also facing uncertainty after the release last week of a 2017 police report detailing an alleged sexual assault in California. But the withdrawal of Gaetz — who was already widely disliked in Congress — may leave senators feeling they owe the president-elect on his other highly controversial choices. Trump’s new selection for attorney general, Pam Bondi, is meanwhile being welcomed by many Republicans, suggesting she’ll have an easier path to confirmation than Gaetz. But that would still leave the question of who is acceptable to Trump while being confirmable in the Senate.
