Woodyard had pleaded not guilty to charges of reckless manslaughter and criminally negligent homicide in connection with McClain’s death. The officer remains suspended from the department without pay, pending the outcome of the trial. Prosecutors initially declined to bring charges against the officers and paramedics involved in McClain’s death, but the case received renewed scrutiny following the nationwide Black Lives Matter protests in the spring of 2020. Jared Polis appointed a special prosecutor to reexamine the case, and in 2021 a grand jury indicted Woodyard, two other officers and two paramedics in McClain’s death. Two paramedics who treated McClain, Jeremy Cooper and Peter Cichuniec, are set to go on trial in the coming weeks.

CNN —A federal judge struck down California’s ban on firearm magazines holding more than 10 rounds Friday as unconstitutional, “arbitrary and capricious.”The ban, which was adopted through a 2016 proposition, had gone through various appeals until the US Supreme Court sent the case back to lower courts following its 2022 ruling in New York State Rifle and Pistol Association vs. Bruen. Gavin Newsom in a statement called the decision “politics, pure and simple,” noting Benitez’s record for rolling back gun control legislation. California Attorney General Rob Bonta filed a notice of appeal, vowing to “fight for our authority to keep Californians safe from weapon enhancements designed to cause mass casualties.”The injunction on the ban will be stayed for 10 days, according to the decision. The president and general counsel for the California Rifle & Pistol Association, Chuck Michel, whose group originally filed the case along with several private gun owners, praised the ruling, saying “the clock is ticking” on “absurdly restrictive laws” that violate the Constitution. Billy Clark, litigation attorney at Giffords Law Center, told CNN he was confident the decision will be overturned and called large capacity magazine regulations “commonsense and constitutional.”

CNN —The suspect accused of killing CashApp founder Bob Lee was cited last year by police for misdemeanor battery, the San Francisco Chronicle reported exclusively Thursday. Lee, who cofounded the mobile payment service provider Cash App, was stabbed to death in the Rincon Hill neighborhood of San Francisco early in the morning of April 4. Momeni was taken to the San Francisco County jail last week, where he was booked on one charge of murder. Dispatch records show she told police Momeni “grabbed her arm & pulled it, pushed her physically,” the paper reported. Police officers “indicated they cited and released Momeni on suspicion of battery almost an hour after the call came in,” the Chronicle said.
CNN —The US Coast Guard is suspending its search for three missing Americans last heard from on April 4 near Mazatlán, Mexico, according to a Coast Guard news release. The search was suspended “pending further developments” after Mexican Navy and US Coast Guard responders “conducted 281 cumulative search hours covering approximately 200,057 square nautical miles” with no sign of the missing vessel or passengers, the release said. Kerry O’Brien, Frank O’Brien and William Gross are all “experienced sailors,” according to an earlier joint statement from their families. “An exhaustive search was conducted by our international search and rescue partner, Mexico, with the U.S. Coast Guard and Canada providing additional search assets,” said Commander Gregory Higgins, command center chief of Coast Guard District 11. Winds potentially over 30 knots and seas 15 to 20, maybe more, feet at the time of their voyage,” Higgins told CNN’s Fredricka Whitfield on Saturday.
Andrew Lester faces two felony charges – assault in the first degree and armed criminal action – in the April 13 shooting of Ralph Yarl. While he was hospitalized, Ralph told police he did not pull on the door, according to the document. Charlie Riedel/APLester opened the interior door and “saw a black male approximately 6 feet tall pulling on the exterior storm door handle,” Lester told police. While the teenager was still on the ground, the man then fired again, shooting him in the arm, Ralph told police. Crump likened Ralph’s shooting to the shootings of 17-year-old Martin in Florida and 25-year-old Arbery in Georgia.
CNN —The moments following the San Francisco stabbing attack of Cash App founder Bob Lee were captured on surveillance video and in a 911 call to authorities, according to a local Bay Area news portal. The driver of the Toyota pulls the car away and Lee collapses to the ground. Lee manages to get up and walk a bit further before he collapses in front of an apartment building. “No one who commits a violent crime, or who’s a repeat offender are receiving overly lenient plea deals.”Her comments appear to be in response to Twitter’s new owner, billionaire Elon Musk. In total, there were 56 homicides in San Francisco in 2022, the same as in 2021.
Gavin Newsom signed a bill into law Tuesday that gives the state’s energy commission oversight power on oil companies to determine potential price gouging and impose corresponding penalties. If their office determines price gouging occurred, they will be able to impose a penalty on oil companies. The law will give needed transparency into the state’s petroleum market and how the oil companies are coming up with pricing, according to state legislators who worked on the bill. “California has sent a clear message to the oil industry – open your books and prove that you’re not price gouging. Last November, Newsom called a special session on a potential “price gouging penalty” after previously calling on the legislature to enact a windfall tax on oil companies.
