A federal judge on Wednesday backed an initial legal challenge to the Federal Trade Commission’s ban on noncompete agreements, which is scheduled to take effect in September. Judge Ada Brown granted an injunction requested by several plaintiffs, saying the ban cannot be enforced against them pending a final ruling. But while the ruling is preliminary, she said that the F.T.C. lacked “substantive rule-making authority” with respect to unfair methods of competition and that the plaintiffs were “likely to succeed on the merits” of their challenge. Judge Brown, of U.S. District Court for the Northern District of Texas, said she expected to issue a final decision by the end of August.

London CNN —Facebook parent Meta has been accused of breaking Europe’s new digital competition rules over its “pay or consent” advertising model. Late last year, Meta (META) launched a service called “Subscription for no ads,” allowing European users of Facebook and Instagram to pay up to €12.99 ($14) a month for ad-free versions. The alternative is to accept versions with personalized ads. “’Subscription for no ads’ follows the direction of the highest court in Europe and complies with the DMA,” a Meta company spokesperson told CNN. “We look forward to further constructive dialogue with the European Commission to bring this investigation to a close.”This is a developing story and will be updated.

Germany Hopes to Head Off a Trade War With China

With billions of dollars in trade between China and the European Union at stake, Germany’s second-highest cabinet official called on Saturday for the two sides to engage in talks to try to resolve an escalating dispute over tariffs. Robert Habeck, who is Germany’s vice chancellor and minister for economic affairs and climate, said that he expected talks to begin soon between China and European officials. Still, he added that tariffs could be justified if the commission’s concerns about China’s subsidies for its electric car industry were not resolved. This month, the European Commission, the executive body of the European Union, proposed tariffs of up to 38 percent on electric cars from China, on top of an existing 10 percent tariff on imported cars. The commission said it found that China’s electric car sector was heavily subsidized by the government and state-controlled banking system.

A commission at the United Nations published a report on Wednesday detailing acts of violence in Israel and the occupied Palestinian territories, accusing both sides of war crimes and arguing that the immense loss of life in the Gaza Strip amounted to a crime against humanity. The report consisted of two parallel investigations, one focused on the Oct. 7 attack on Israel led by the armed Palestinian group Hamas, and the other on Israel’s military response. What did the report find? According to the report, 800 civilians were among the more than 1,200 killed by Hamas and other armed Palestinian groups involved in the Oct. 7 attack on Israel. More than 250 additional people — including 36 children — were taken hostage, the commission said.

The European Commission, the EU’s executive arm, launched the probe in October to establish whether Chinese EV prices are artificially low because of subsidies and so hurt European carmakers. Europe is the main destination for Chinese EV exports. The new EV tariffs are likely to kick off intense negotiations between Beijing and Brussels aimed at averting a damaging trade war. Many of them manufacture cars in China and then sell them in Europe, a set-up that will be more costly as a result of the higher tariffs. Alternatively, Beijing could pledge investment into EU countries and promise better market access in China for EU firms, the Rhodium analysts wrote.

When the judge presiding over Hunter Biden’s federal gun trial sentences him, she will have to weigh a number of unusual factors specific to his case. Mr. Biden was convicted on Tuesday of three violations that rarely go to trial — all stemming from his failure to disclose his use of illegal drugs when he bought a gun in 2018. The charges included illegally possessing a firearm, giving a false statement in buying it, and providing that false statement to a licensed gun dealer responsible for making sure guns are sold only to properly qualified customers. From 2019 to 2023, just 48 defendants were sentenced in a similar category as Mr. Biden, and 92 percent were sentenced to serve prison time with a median prison term of 15 months, according to the commission’s data. Around 8 percent of people in that category received probation or a fine.

New Jersey’s former attorney general, Gurbir S. Grewal, took the stand on Thursday afternoon in Senator Robert Menendez’s bribery trial, becoming the most prominent official to testify against the senator, a fellow Democrat. Mr. Grewal was expected to offer details about telephone calls from Mr. Menendez and a brief meeting the two had in September 2019 in the senator’s office in Newark. Being called as a witness in a criminal trial was an unusual role for Mr. Grewal, a former federal prosecutor who now leads the U.S. Securities and Exchange Commission’s enforcement division. Mr. Menendez turned to look directly at Mr. Grewal as he walked slowly to the stand. CNN —Astronomers were in for a surprise when NASA’s Lucy mission flew by an asteroid named Dinkinesh in November and spotted a contact binary — two smaller space rocks that touch each other — orbiting the asteroid like a moon. “Basically, the planets formed when zillions of smaller objects orbiting the Sun, like asteroids, ran into each other. The Lucy mission captured additional imagery revealing that the asteroid Dinkinesh’s moon is actually two space rocks that are touching one another. Too distant to be seen in detail with telescopes, the asteroids will get their close-up when Lucy reaches the Trojans in 2027. The mission borrows its name from the Lucy fossil, the remains of an ancient human ancestor discovered in Ethiopia in 1974.

London CNN —Mondelez, the maker of Oreo and Cadbury Dairy Milk chocolate, has been fined €337.5 million ($366 million) for hindering the trade of chocolate, cookies and coffee between European Union countries in order to keep prices high. Margrethe Vestager, the EU’s competition chief, said in a statement Thursday that Mondelez had illegally limited cross-border sales within the EU to maintain higher prices for its products. The European Commission, which started looking into the case in 2019, found that Mondelez International (MDLZ) had deliberately restricted cross-border trade and abused “its dominant position” in some national markets for the sale of chocolate bars. Mondelez made an accrual for the fine last year and no further measures will be necessary to finance it. In another case, Mondelez required a customer to charge higher prices for exports compared with domestic sales.

CNN —A delegation of Kenyan “command staff” has arrived in Haiti, according to a law enforcement source in the country, ahead of the long-delayed arrival of a Kenyan-led multinational security support force in the Caribbean nation. Members of the delegation are also expected to meet with US and United Nations officials in the country, sources said. The UN Security Council last year authorized a multinational mission to support Haiti’s National Police in battling deadly gangs that have seized control of much of the capital Port-au-Prince. But despite strong support from the US and other regional powers, the mission has been mired in uncertainty and legal challenges for months. The council said Tuesday that it met with top Haitian police brass to discuss the multinational mission.

A state ethics panel quietly dismissed a complaint last summer against the New York judge presiding over the criminal trial of Donald J. Trump, issuing a warning over small donations the judge had made to groups supporting Democrats, including the campaign of Joseph R. Biden. The judge, Juan M. Merchan, donated a total of $35 to the groups in 2020, including a $15 donation earmarked for the Biden campaign, and $10 to a group called “Stop Republicans.”Political contributions of any kind are prohibited under state judicial ethics rules. “Justice Merchan said the complaint, from more than a year ago, was dismissed in July with a caution,” the spokesman for the court system, Al Baker, said in a statement. A caution does not include any penalty, but it can be considered in any future cases reviewed by the state’s Commission on Judicial Conduct. A letter outlining the caution was not released because of the commission’s rules, and Justice Merchan did not make the letter available.

I can’t watch a basketball game on TV without seeing ads urging me to place a bet on one app or another. I can’t walk down the street in New York City without seeing ads about the latest lottery jackpot. And when I sit at my desk in the office, I spend hours studying another type of betting — trading in financial markets, where you can place wagers on companies, bonds, commodities and derivatives of all descriptions. Yet the most consequential betting of all — wagers on elections in the United States — may soon be shut down by regulators. And the commission’s proposed new rule would give it the power to block trading on a broad range of other subjects.
