A federal judge issued an injunction Tuesday partially blocking the enforcement of a New Hampshire law that bars some transgender students from competing on school sports teams that align with their gender identity. Last month, two transgender teenage girls and their families sued New Hampshire education officials, arguing that the measure violates Title IX civil rights rules, which prevent sex discrimination in federally funded education programs and activities. The Biden administration expanded Title IX rules in April to include protections for students on the basis of sexual orientation and gender identity. Moreover, the expansion of the Title IX rules is temporarily blocked in at least 10 states and faces ongoing court challenges in roughly 10 others. Chris Sununu, a Republican, took action on two separate bills affecting the state’s trans community in July, in addition to the sports measure.

Former President Donald Trump repeated his false claim that children are undergoing transition-related surgery during their school day, worsening fears among some conservatives that educators are pushing children to become transgender and aiding transitions without parental awareness. What the hell is wrong with our country?” Trump said Saturday at a campaign rally in Wisconsin, a vital swing state. About half the states ban transition-related surgery for minors, and even in states where such care is still legal, it is rare. The law limits the instruction of sexual orientation and gender identity in school and has been replicated in states across the country. Half of all teachers polled, including 62% of elementary school teachers, said elementary school students should not learn about gender identity in school.

At the 2016 Democratic National Convention in Philadelphia, Rep. Patrick Maloney, D-N.Y., was met with thunderous applause as he proudly introduced transgender advocate Sarah McBride. “She is right now the first trans person ever to address a national convention,” Maloney boasted. But at this year’s Democratic convention in Chicago, trans people were notably absent from the stage. To some trans Americans, the omission did not go unnoticed. The Republican Party platform, updated last month for the first time since 2016, appeared to shift away from the party’s long-held opposition to same-sex marriage. We will end policies that punish families.”Many took this to mean the party was softening its stance on gay nuptials in a nod to growing public support for same-sex marriage, even among Republicans. The Republican National Committee did not return multiple requests for comment regarding whether the language in the new platform is inclusive of same-sex couples. and the richest college athletic conferences joined with plaintiffs’ lawyers on Friday to enter a $2.8 billion settlement agreement of their class-action antitrust lawsuit. The filing outlines in some detail how schools would be allowed for the first time to pay college athletes directly. N.C.A.A., and two companion lawsuits would open the door to a new model for college athletics. As soon as a year from now, schools could begin to spend up to slightly over $20 million a year to pay athletes, a ceiling that would rise along with college athletics revenues. The settlement agreement sidesteps addressing Title IX, which among other things bars colleges from treating men’s and women’s sports unequally.

Sacramento, California CNN —Justice Elena Kagan on Thursday defended the code of conduct the Supreme Court created last year, but conceded there needs to be a way to enforce the rules for it to be more effective. “I think that the rules that we put out are good ones,” Kagan said at a judicial conference in Sacramento. “I think that the thing that can be criticized is, you know, rules usually have enforcement mechanisms attached to them. Read previewDonald Trump has long regarded the student loan forgiveness measures rolled out under the Biden administration as a stunt to garner "publicity for the election." At a campaign event in late June, Trump called Biden-era student debt relief measures "vile," suggesting that student loan borrowers shouldn't count on forgiveness under a second Trump administration. A recent Supreme Court ruling striking down the Chevron doctrine has already weakened the Education Department. Biden-era student loan forgiveness measures, as well as his new income-driven SAVE repayment plan, are making their way through court challenges led by conservative groups, which are not likely to be resolved before 2025. The Biden administration’s new Title IX regulations that expanded protections for L.G.B.T.Q. students have been temporarily blocked in four states after a federal judge ruled that the Education Department overstepped its authority. The plaintiffs argued that the Biden administration’s interpretation of Title IX betrayed the law’s original purpose of prohibiting discrimination on the basis of sex. The new rules, which the Education Department released in April, disallow discrimination or harassment of students based on their gender identity, enshrining stronger protections for transgender students. However, the rules skirted some of the most divisive questions, stopping short of requiring schools to grant transgender students access to single-sex dorms or sports teams.

CNN —The Biden administration announced a new rule Friday expanding safeguards against potential discrimination of gay and transgender Americans seeking medical care, in a reversal of Trump-era limitations that nixed federal health protections for members of the LGBTQ+ community. In a set of expansive new rules unveiled by the Department of Health and Human Services, the department moved to advance civil rights protections for patients by barring health providers and insurers receiving federal funding from discriminating against those seeking care on the basis of gender identity or sexual orientation. The HHS rule restores Obama-era protections for transgender patients that the Trump administration rolled back in 2020 — a move that was condemned by LGBTQ+ advocacy and human rights organizations. The finalized rule comes as access to gender-affirming care for transgender youth has been tangled in political controversy, with more than 20 states in recent years attempting to restrict youth access to such care. The Biden administration in 2021 announced its intention to protect transgender Americans from health care discrimination through Section 1557 and Title IX regulations, citing a 2020 Supreme Court ruling that affirmed federal civil rights law bars discrimination against gay, lesbian and transgender workers.

The Food and Drug Administration on Friday approved Pfizer 's treatment for a rare genetic bleeding disorder, making it the company's first-ever gene therapy to win clearance in the U.S. The agency greenlit the drug, which will be marketed as Beqvez, for adults with moderate to severe hemophilia B who meet certain requirements. Without that protein, called factor IX, patients with hemophilia B bruise easily and bleed more frequently and for longer periods of time. The gene therapy will compete with Australia-based CSL Behring's Hemgenix, a similar treatment that won FDA approval for hemophilia B in 2022. The Biden administration issued new rules on Friday cementing protections for L.G.B.T.Q. students under federal law and updating the procedure schools must follow when investigating and adjudicating cases of alleged sexual misconduct on campus. The new rules, which take effect on Aug. 1, effectively broadened the scope of Title IX, the 1972 law prohibiting sex discrimination in educational programs that receive federal funding. They extend the law’s reach to prohibit discrimination and harassment based on sexual orientation and gender identity. And the administration took steps to roll back some of the more rigid campus sexual assault policies issued during the Trump administration, which drew condemnation from Democrats, including Mr. Biden, for being overly deferential to students accused of sexual violence.

CNN —A federal appeals court ruled Tuesday that West Virginia cannot enforce its anti-transgender sports ban against a 13-year-old girl, dealing a blow to one of nearly two dozen such laws enacted by GOP-led states in recent years. We hold it cannot,” Circuit Judge Toby Heytens wrote in the decision, which was joined by Judge Pamela Harris. Signed into law by West Virginia Republican Gov. The court’s majority said the law violates Pepper-Jackson’s rights under Title IX, a federal law that prohibits discrimination on the basis of sex at schools that receive federal aid. The federal judge who initially blocked the law in 2021 reversed course last year and sided with state officials.

Louisiana State University also rebranded its diversity office after Jeff Landry, a Trump-backed Republican, was elected governor last fall. Its Division of Inclusion, Civil Rights and Title IX is now called the Division of Engagement, Civil Rights and Title IX. And at the University of Oklahoma, the diversity office is now the Division of Access and Opportunity. In what appears to be an effort to placate or, even head fake, opponents of diversity and equity programs, university officials are relaunching their D.E.I. offices under different names, changing the titles of officials, and rewriting requirements to eliminate words like “diversity” and “equity.” In some cases, only the words have changed.
