CNN —Hunter Biden is requesting a new trial in his federal gun case, with his lawyers claiming that there was a procedural issue in the timing of the early June trial that resulted in a guilty verdict against him. His lawyers claim that the trial court did not have jurisdiction over his case because of appeals that he had filed challenging his prosecution. The defense team says that the conviction must be wiped away because, even though the appeals court had rejected the appeals by the time the trial started, it had not issued what’s known as a “mandate” – the procedural maneuver that effectively notifies a lower court of ruling made by a higher court in an appeal. Biden’s lawyers are pointing to the absence of a mandate sending the case back to the trial court after the 3rd US Circuit Court of Appeals handed down rulings rejecting two of his appeals in late May. “The Third Circuit, however, did not then and has not yet issued its mandate as to the orders dismissing either appeal,” his lawyers wrote.

CNN —McDonald’s is pulling the plug on artificial intelligence ordering technology it was testing at more than 100 restaurant drive-thru systems in the US, a possible hiccup in the rapid rollout of AI in the fast food industry. The company had worked with IBM to develop and test AI-driven, voice-automated ordering at some of its restaurants. McDonald’s says this is not the end of its AI efforts. McDonald’s is not the only fast-food chain experimenting with AI. Other companies like White Castle tested out an automated drive-thru ordering system in 2021, and Wendy’s expanded its partnership with Google Cloud to roll out its own AI ordering tool in May last year.

There have been 13 other market selloffs during the second year of a bull market since 1946, Belski noted. AdvertisementFollowing its 2021 pullback, the S&P 500 finished the second year of its bull market up 22.6% and 11.5% higher than its nadir. Valuations are still historically high, and mega-cap growth companies continue to make up a disproportionately large share of the S&P 500. Since Belski thinks this bull market has legs, he doesn't want to forgo future upside. These firms have higher earnings growth than the median S&P 500 name and also have lower price-to-earnings (P/E) and P/E-to-growth (PEG) ratios — a recipe for success.

The so-called SMID-cap cohort lagged its larger peers again in the first quarter, posting a solid 7.6% total return, while the S&P 500 surged 10.6%, including dividends. New Jersey moved a step closer last week toward overhauling its unique-in-the-nation election ballots, in a decision that could reshape party politics in the state for years to come. On Saturday, the federal judge who ordered the redesign, in response to a lawsuit filed in February by three Democratic candidates, said in a statement that only the Democratic primary, which includes the race to replace Senator Robert Menendez, would have to use the new ballot. The Republican ballot, he wrote, can stay the same, though he said his order did not prohibit Republican leaders from choosing to alter their party’s ballot. The clarification is the latest twist in a long legal battle in New Jersey to shift the balance of electoral power away from party-backed candidates and open the door for newcomers in both parties. “If this decision holds, it will completely upend New Jersey politics.”

It's been three weeks since a cyberattack on an under-the-radar but critical technology company caused the payments that flow between healthcare providers and insurers to grind to a halt nationwide. The US healthcare system has been crippled by the cyberattack on Change Healthcare, the company owned by UnitedHealth Group that connects healthcare providers and pharmacies to insurers and facilitates 15 billion transactions each year. And some patients can't afford their prescriptions because pharmacies can't process drug coupons. For many healthcare providers, UnitedHealth and the federal government's response to the ongoing crisis has fallen short. Industry groups including the American Hospital Association and American Medical Association urged the federal government to provide emergency financial support to healthcare providers.

Many Republicans plan to skip the House GOP retreat as they grumble about both the location and the idea of spending time with one another, with tensions still running high inside the party in the wake of their unprecedented speakership drama. Fewer than 100 Republicans have RSVP’d to attend the retreat, which is less than half of the entire conference, according to a GOP source familiar with the attendance sheet. GOP Rep. Ultimately, it’s very high leverage,” Tomasz Piskorski, a finance professor at Columbia Business School, tells me. Even a year after that exact thing happened — Silicon Valley Bank failed after depositor demand eclipsed the value of its assets — regulators haven’t addressed the core leverage issue. The most obvious answer is one the banking industry hates: Increase the amount of money a bank is required to hold in reserve. And their go-to argument against such regulations is that they force banks to curtail loans to customers, hurting folks in the real economy. The upshot: Despite the banking industry’s protest, banks can handle much higher capital requirements (at least, according to Piskorski et al).
