Those rules were designed to prevent a repeat of the abuses of Richard Nixon, who improperly used the Justice Department to punish his political enemies. A new president appoints roughly 300 senior Justice Department officials, including the U.S. attorneys who run offices across the country. All 300 must be confirmed by the Senate, but multiple former Justice Department officials said they fear Trump would install partisans willing to do his bidding. Justice Department officials have risen to the occasion and defied presidential overreach in the past. Republican presidential nominee and former U.S. President Donald Trump speaks during a rally at Madison Square Garden, in New York, U.S., October 27, 2024. Andrew Kelly | ReutersRepublican presidential candidate Donald Trump headlined a rally at New York's Madison Square Garden on Sunday that began with a series of vulgar and racist remarks by allies of the former president. Danielle Alvarez, a senior adviser to the Trump campaign, told Reuters that the joke about Puerto Rico "does not reflect the views of President Trump or the campaign." Harris's campaign in an email said the Madison Square Garden rally was "mirroring the same dangerously divisive and demeaning message" as Trump. Trump's 2016 presidential opponent, Democrat Hillary Clinton, has accused him of "re-enacting" a pro-Nazi rally that was held at Madison Square Garden in 1939 on the eve of World War Two.

The 2020 campaign may have also suffered from a lack of imagination about how big the turnout would be and what Democrats were doing in the courts to expand the vote, a Trump campaign adviser said. Other familiar names from 2020 election lawsuits have been spotted this year too. One is Karen DiSalvo, who after the 2020 election helped force an audit in Lycoming County, Pennsylvania. The RNC and Trump campaign have focused what they call their election integrity effort on 18 states including the key swing states. An RNC lawsuit in Michigan challenging voter registration procedures is one of the cases the firm has worked on.

Between the time it takes to process mail ballots and deal with provisional ballots in some battleground states, votes will not be fully tabulated on election night. Projections of who won a close presidential race might not come for days, similar to the 2020 election. The 1980 Mercedes was previously owned by famed actress Lauren Bacall, for instance, and one of the watches belonged to Giuliani's grandfather. Another watch was gifted to Giuliani by the president of France after the Sept. 11, 2001, terrorist attacks, when Giuliani was mayor of New York City. Giuliani repeatedly targeted the two women with false election fraud claims as part of his efforts to overturn Trump's loss to President Joe Biden in the 2020 election. Giuliani filed a Chapter 11 bankruptcy petition to shield himself from sudden financial ruin, but a New York federal bankruptcy judge dismissed his case. Judge Lewis Liman of the federal court in Manhattan said Giuliani must turn over his interest in the property to the women in seven days, to a receivership they will control. The judge’s turnover order of the luxury items is swift and simple, but the penthouse apartment will have its control transferred so Freeman and Moss can sell it, potentially for millions of dollars. The women, who counted Georgia ballots after the 2020 election, will also be entitled to about $2 million in legal fees Giuliani has said the Trump campaign still owes him, the judge ruled. Additionally, the judge ordered that Giuliani turn over his television, items of furniture and jewelry. Neither Giuliani’s spokesman nor lawyers for Freeman and Moss immediately responded to requests for comment.

“So, there’s always a question of, like, say, the Dominion voting machines. Fact: Hand counts and audits of such paper ballots have repeatedly proven that Dominion machines produce accurate results. Regardless, Dominion machines were used in 2020 in Maricopa County, Arizona, home to the state’s largest city, Phoenix. The city used machines from ES&S, according to Verified Voting, which tracks which voting equipment used in counties across the country. Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

Washington CNN —Sen. JD Vance, the Republican vice presidential nominee, falsely claimed Sunday that former President Donald Trump “didn’t go after his political opponents” during his presidency – an assertion that is contradicted by a mountain of evidence. As president, Trump publicly and privately pressured the Justice Department, and others in his administration, to investigate or prosecute numerous political opponents. Trump made extensive behind-the-scenes efforts to get his political opponents charged with crimes. But you don’t have to rely on investigative reporting or the memoirs of former administration officials to know that Trump went after political opponents as president. As CNN reporter Marshall Cohen has noted, there is a long list of political opponents whom Trump publicly called for the Justice Department and others to investigate or prosecute.

Nonetheless, Trump told his advisers that he would claim victory before the ballots were fully counted, prosecutors say. One private political adviser, three days before Election Day 2020, described Trump’s plan as: “He’s going to declare victory. When Trump told the staffer he would not pay the private lawyer spearheading his legal challenges unless the challenges were successful, the staffer told Trump that the private attorney would never be paid. WASHINGTON — Former New York City Mayor Rudy Giuliani has been disbarred from practicing law in Washington, D.C., according to an order filed Thursday by the Court of Appeals for the District of Columbia. Both panels had pointed to Giuliani trying to get thousands of votes for President Joe Biden tossed out in the battleground state of Pennsylvania that year. The D.C. Bar's Board on Professional Responsibility said in a report in June that there was "clear and convincing evidence" that Giuliani "violated Pennsylvania Rules of Professional Conduct" and therefore "should be disbarred." Giuliani also lost his law license in New York state in July over his actions to disseminate lies about voter fraud in the 2020 election. Separately, he faces charges in Arizona and Georgia over his efforts to overturn the 2020 election results in those states.

A settlement has been reached in a defamation lawsuit pitting an electronic voting machine manufacturer targeted by allies of former President Donald Trump against a conservative news outlet that aired accusations of vote manipulation in the 2020 election. The Delaware lawsuit, which takes issue with Newsmax reports over a five-week period in late 2020, is one of several stemming from reports by conservative news outlets following the election. Smartmatic also is suing Fox News for defamation in New York and recently settled a lawsuit in the District of Columbia against the One America News Network, another conservative outlet. Dominion Voting Systems similarly filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Trump's loss. Last year, in a case presided over by Davis, Fox News settled with Dominion for $787 million.

It is the latest indignity for Giuliani, who has been shoved out of the legal profession after promoting conspiracy theories about the 2020 election following Donald Trump's election loss, and was previously disbarred in New York. The Washington, DC, Court of Appeals handed down the disbarment order with "reciprocal discipline," finding Giuliani was unable to show why the New York decision to take away his law license was wrong.

Washington CNN —Jury selection is set to begin Thursday in a closely watched defamation trial pitting voting technology company Smartmatic against the right-wing cable network Newsmax, in a high-stakes case over the airing of false 2020 election claims. The Newsmax case revolves around the same false claims, championed by former President Donald Trump and his Republican allies, that the 2020 election was rigged by Smartmatic software and others. The Florida-based company sued Newsmax and other right-wing outlets and figures in 2021, alleging that its reputation was destroyed by the lies. The Newsmax case will test the legal limits of publishing lies about the 2020 election, and the trial will play out during the final stretch of the 2024 campaign. ‘Dozens’ of defamatory reportsAfter mainstream news outlets – and even Fox News – projected that Democratic nominee Joe Biden would win the 2020 election, Trump and his surrogates falsely claimed that he won.

CNN —Former New York City Mayor Rudy Giuliani is disbarred in Washington, DC, the district’s highest local court said Thursday, a move stemming from the ethics proceedings Giuliani faced in New York because of his efforts to help former President Donald Trump try to overturn the 2020 election. Those New York proceedings led to Giuliani losing his license to practice there this summer, and because the DC Bar has a reciprocal relationship with the New York Bar, he is now being disbarred in the district. According to the new order from the DC Court of Appeals, Giuliani did not respond to an opportunity to object to his disbarment in Washington. Meanwhile, two Georgia election workers obtained a $148 million defamation judgment against him for false allegations he made about them after the 2020 election. The New York disciplinary attorney ethics proceedings against Giuliani played out mostly behind closed doors.

Giuliani's law license had been suspended in D.C. in July 2021 as a result of his then-active disciplinary proceedings in New York.
