Carroll wants to amend her remaining lawsuit by removing the word 'rape' and adding new alleged defamations. Trump is now fighting these amendments, and demands the word 'rape' stay in the lawsuit. His lawyers plan to argue that since a jury has now rejected her rape claim, Trump rightfully called her a liar. Carroll's proposed amended complaint "substitutes every reference of the word 'rape' and replaces it with 'sexual assault,'" Trump attorney Alina Habba writes in the filing, addressed to US District Court Judge Lewis A. Kaplan, the presiding judge for Carroll's two defamation suits. In that case, a federal jury in Manhattan found Trump indeed defamed and sexually abused Carroll and approved $5 million in damages.

Trump's team released a long statement in response to the verdict, also calling the verdict a "witch-hunt of President Trump." While the jury found Trump liable for sexually abusing and defaming Carroll after two weeks of trial testimony and arguments, they did not find that Carroll met the burden of proof in showing that he raped her. After three hours of deliberations, the jury unanimously found that the “preponderance of the evidence” — a lower threshold than that in criminal cases — supported Carroll’s accusation that Trump attacked her in a Bergdorf Goodman dressing room in the mid 1990s. It also held the former president liable for defaming Carroll, when he called her case “a Hoax and a lie.” But the jury did not find that Carroll had proved that Trump had raped her, as she has long claimed. On his Truth Social website, Trump said: “I have absolutely no idea who this woman is. This verdict is a disgrace — a continuation of the greatest witch hunt of all time!” He vowed to appeal.
The scheduled April 25 trial relates to Trump's alleged rape of Carroll in late 1995 or early 1996 in a Bergdorf Goodman department store dressing room in Manhattan. In his Oct. 12 post, Trump said he did not know Carroll, that she made up the rape claim to promote her memoir, and that the claim was a "hoax," "lie," "con job" and "complete scam." Trump said his post amounted to commentary about Carroll's earlier lawsuit and his defenses, and therefore was protected. But the judge said Trump's post was neither a "report of any judicial proceeding" nor a "fair and true report" of such a proceeding that would justify immunity.
