Even before her bombshell decision on Monday to dismiss former President Donald J. Trump’s classified documents case, Judge Aileen M. Cannon had made any number of unorthodox rulings. In fact, since Judge Cannon took control of the case in June 2023, many of her decisions have been so outside the norm that they have fueled intense criticism of her legal acumen, stoked questions about favoritism toward Mr. Trump and slowed the documents case sufficiently that it would not come to trial before Election Day. Still, almost no one, including some defense lawyers working on the case, expected Judge Cannon to throw out the charges against Mr. Trump by ruling that Jack Smith, the special counsel who filed the indictment, had been unconstitutionally appointed to his job — especially on the first day of the Republican National Convention. The ruling upended 25 years of Justice Department procedure for naming and governing special counsels and called into question decisions by previous courts reaching back to the Watergate era.

Cannon did not seem inclined to approve the limitations on Trump’s speech but did not immediately issue a ruling. I talked to Samuel Freedman, a Columbia Journalism School professor, about his recent book about Humphrey and the 1948 Democratic convention in Philadelphia. The book’s title, “Into the Bright Sunshine,” is taken from a line in Humphrey’s rousing speech on civil rights. In 1968, the Democratic Party was operating under old rules in which primary voters actually had relatively little direct effect on delegates. When Strom Thurmond and the Dixiecrats bolted from the Democratic Party in 1948, that’s the beginning of the vast majority of the White South becoming Republicans, stepping away from the Democratic Party. Show me a major Republican politician in the MAGA movement who is a fervent supporter of civil rights legislation.

The DC US Circuit Court of Appeals, in an opinion written by Barack Obama-appointed Judge Patricia Millett and joined by Judges Gregory Katsas and Neomi Rao, both Trump appointees, rejected the version of the argument put forward by Webster. “Webster asserts that the District overwhelmingly voted for President Biden and historically votes for Democratic candidates. … That may be,” Millett wrote. “Generalized disapproval of criminal conduct — even the specific conduct at issue in a defendant’s case — says nothing about a juror’s ability to be impartial in deciding whether a particular individual committed a crime or not.”

CNN —If Chief Justice John Roberts is really an institutionalist — someone deeply concerned about the integrity of the Supreme Court and public perceptions about it — then he has a big problem on his hands. The discovery also comes at a time when the Supreme Court will be making a decision about Trump’s claims of sweeping presidential immunity, his get-out-of-jail-free card for the federal cases he faces. The notion that the Supreme Court can be trusted to be an arbiter above partisan politics has suffered major blows in recent years. Supreme Court decisions have not been the only issue. The Alito flag controversy is another blow to the image of the court.

Former Vice President Mike Pence sought public financing for his failed presidential primary campaign, a highly unusual move that if successful would make him the first Republican in more than a decade to receive such funds, according to Federal Election Commission documents that have not previously been disclosed. Starting in the post-Watergate era, the federal government has allowed presidential candidates to apply for and receive public dollars. But the program has become all but obsolete as it imposes strict spending limits on anyone who participates, at a time when the cost of nationwide campaigning has skyrocketed. Even applying for the money is generally seen as a sign of desperation because the limits of the program are so onerous. Mr. Pence, who served as former President Donald J. Trump’s running mate in 2016 and 2020 before challenging him last year, struggled for traction in the 2024 Republican race from the very start.

Of the four criminal cases that Donald Trump is facing, the one now unfolding in Manhattan is generally considered the weakest. Worst of all, it doesn’t speak to Mr. Trump’s actions as president, as the other cases do. As a historian who has written about the wrenching events of the 1960s and early 1970s, I can’t help seeing Mr. Trump’s legal troubles through the lens of an earlier Republican president. But unlike Mr. Trump, Mr. Nixon never faced criminal charges himself. For that, justice suffered, and the nation suffered, too.
