CNN —A judge in New Mexico denied Alec Baldwin’s motion to dismiss the involuntary manslaughter indictment against him in the “Rust” fatal shooting case, connected to the 2021 death of the film’s cinematographer, Halyna Hutchins. Baldwin’s attorneys had accused prosecutors of misconduct during the grand jury process and sought to have the case dismissed. Baldwin’s lawyers filed a motion to dismiss the indictment in March. In response to Baldwin’s team’s March motion to dismiss the indictment, special prosecutors in New Mexico defended their case, saying Baldwin’s behavior on the “Rust” movie set contributed to “safety compromises” that led to the fatal shooting. In the order to deny Baldwin’s motion to dismiss, the judge said despite the defense’s claims,there was no prosecutorial bad faith, as Baldwin’s legal team had claimed, and proper procedures were followed in the grand jury process.

A judge in New Mexico will rule next week on whether to dismiss the involuntary manslaughter indictment against Alec Baldwin in the fatal shooting of a cinematographer on the “Rust” film set, after she closely questioned the lead prosecutor on Friday about her handling of grand jury proceedings. Lawyers for Mr. Baldwin — who was rehearsing with an old-fashioned revolver on the set in 2021 when it fired a live bullet, killing the cinematographer, Halyna Hutchins — had lodged numerous objections to how the case has been handled, calling the prosecution “an abuse of an innocent person whose rights have been trampled to the extreme.”The defense claimed at a hearing on Friday that the prosecution had not sufficiently shown the jurors evidence that could have supported Mr. Baldwin’s case. That included presenting witnesses who could have bolstered the defense’s contention that Mr. Baldwin had no reason to think that the gun was loaded with live ammunition and that actors are not responsible for gun safety on film sets. “The court can have no comfort in this indictment; it can have no comfort in the way it was procured,” a lawyer representing Mr. Baldwin, Alex Spiro, argued at the hearing, which took place virtually. “It cannot possibly believe it was fair and impartial.”

A new one-page indictment delivered by the grand jury Friday alleges Baldwin caused Hutchins' death — either by negligence or “total disregard or indifference” for safety. Defense attorneys for Baldwin indicate they'll fight the charge, which carries a potential prison sentence of up to 18 months. The indictment provides prosecutors with two alternative standards for the felony involuntary manslaughter charge against Baldwin. Mangels said a grand jury indictment is by no means an assurance that prosecutors will prevail at trial. “Just getting an indictment from a grand jury in no way means the prosecution has a slam dunk case or even a strong case,” she said.

CNN —Actor Alec Baldwin has been indicted by a New Mexico grand jury on charges connected to the 2021 fatal shooting on the set of the movie “Rust,” new court documents show. Baldwin is charged with two counts of involuntary manslaughter. Armorer Hannah Gutierrez Reed also faces involuntary manslaughter charges in the case. The film’s assistant director, David Halls, was identified as the person who handed the firearm to Baldwin that fateful day. Attorney Gloria Allred, who is representing Hutchins’ family in a civil lawsuit against Baldwin, responded to Friday’s development in a statement to CNN.
