WASHINGTON — A team of federal prosecutors led by special counsel Jack Smith said in a filing Wednesday that Republican presidential nominee Donald Trump bears responsibility for the Jan. 6 attack on the U.S. Capitol. In a filing responding to Trump's attempt to dismiss the case, Smith's team said it "is incorrect" for Trump's team to assert that the superseding indictment returned against Trump in August does not show that Trump bears responsibility for the events of Jan. 6. "Those allegations link the defendant’s actions on January 6 directly to his efforts to corruptly obstruct the certification proceeding," Smith's team wrote. WASHINGTON — The Supreme Court on Monday rejected an appeal brought by X, Elon Musk's social media company, declining to decide whether prosecutors should have been able to obtain data from former President Donald Trump's Twitter account without him being notified. The case arose as part of special counsel Jack Smith’s investigation into Trump over alleged election interference in 2020, which the Supreme Court stymied earlier this year by ruling that presidents have broad immunity from prosecution for official acts taken in office. Smith has already obtained the data at issue in the appeal brought by X, as Twitter is now known following Musk’s takeover of the social media company. A federal judge approved the warrant, as well as a nondisclosure order that prevents X from telling Trump or anyone else about it. During the litigation, Smith agreed that Trump could be notified about the warrant.

Three former Memphis police officers were convicted Thursday of federal witness tampering charges related to the deadly beating of Tyre Nichols in 2023, according to NBC News affiliate WMC. Demetrius Haley, Justin Smith and Taddarius Bean were accused of depriving Nichols of his rights through excessive force, obstructing justice through witness tampering and other crimes. Haley was found guilty of one count of conspiracy to witness tamper and one count of obstruction of justice for witness tampering. Bean and Smith were found guilty on only one count, obstruction of justice for witness tampering, WMC reported. The witness tampering charges carry possible sentences of up to 20 years in prison.

Colorado and web designer Lorie Smith’s lawyers at conservative law firm Alliance Defending Freedom disclosed the accord in a court filing last week. Alliance Defending Freedom senior counsel Bryan Neihart in a statement on Monday said it was common for the prevailing party in a civil rights case to ask for and receive legal fees after winning in court. Arizona-based Alliance Defending Freedom is a faith-based legal advocacy organization that pursues lawsuits related to religious liberty. In Smith’s bid for fees, Alliance Defending Freedom said its $2 million request would reimburse them for 2,174.4 hours of work on the litigation. CNN —Former President Donald Trump is again claiming that special counsel Jack Smith is trying to influence the November presidential election by seeking to make new evidence and witness testimony public as voters start to go to the polls. The brief is aimed at convincing the trial judge in the case – and eventually, higher courts – that Smith’s case can survive under the Supreme Court’s recent ruling that said Trump had at least some presidential immunity in the prosecution. The filing is expected to reveal new evidence against Trump, including what several witnesses testified to in the grand jury proceedings. Sources say the proposed redactions are minimal, blacking the sources of the information and removing witness names, but leaving the substance of what they said about Trump for public view.
