Washington CNN —The Supreme Court said Friday that the United States Military Academy at West Point can continue considering race as a factor in its admissions process while a legal challenge to the practice plays out. Last week, SFFA asked the high court to step in on an emergency basis to block West Point from considering race in its admissions process as the litigation unfolds. “For now, the only question is what should happen as this case proceeds – who should bear the burden of the status quo,” attorneys for SFFA told the Supreme Court. “Every year this case languishes in discovery, trial, or appeals, West Point will label and sort thousands more applicants based on their skin color – including the class of 2028, which West Point will start choosing in earnest once the application deadline closes on January 31. Or should West Point bear the burden of temporarily complying with the Constitution’s command of racial equality?” they added in part.

Delfin signs 15-year LNG supply agreement with Gunvor

Nov 27 (Reuters) - Delfin Midstream Inc said on Monday it had entered into a long-term liquefied natural gas (LNG) supply agreement with global commodity trader Gunvor. Delfin said in a news release its LNG plant in Louisiana will supply between 500,000 to 1 million tonnes of LNG per annum to Gunvor on a free-on-board basis at Delfin Deepwater Port for at least 15 years. Delfin has been developing the Delfin LNG Deepwater Port project supporting up to four floating LNG vessels with a combined export capacity of about 13.3 million tons per annum (MTPA), the release said. The company secured commercial agreements for LNG sales, liquefaction services and is in the final phase towards final investment decisions (FID) on its first three floating LNG vessels, the release added. NextEra Energy Partners' (NEP) Texas natural gas pipeline portfolio, STX Midstream, primarily consists of seven pipelines which provide natural gas to Mexico and power producers and municipalities in South Texas. "Upon closing, the proceeds would be sufficient to pay off the outstanding project-related debt," NextEra Energy Partners' CEO John Ketchum said in a statement. The sale price represents an about 10 times multiple on the estimated calendar-year 2023 adjusted core profit for the Texas natural gas pipeline portfolio, NEP said.

Independent proxy advisory firms Glass Lewis & Co and ISS had recommended a vote in favor of the sale. Magellan, in its proxy, cautions that the merger is not conditioned on the compensation vote and that if the acquisition is approved, the executive compensation is payable. Michael Mears, Magellan's previous chief executive officer, also would receive about $26.5 million in equity, while the company's current chief commercial officer and general council will receive multi-million dollar packages. Magellan, however, said it expects ONEOK to consider the outcome of the compensation vote, along with other factors, when considering future executive pay.
