Montana voters approved a ballot measure enshrining abortion in the state constitution, NBC News projects, delivering a victory to advocates for reproductive rights in a Western red state. The amendment will not change current law on abortion in Montana: Abortion is legal in the state until fetal viability, around the 23rd or 24th week of pregnancy, backed up by a 1999 ruling by the state Supreme Court. But advocates for the ballot measure wanted to guard against potential changes by the Legislature or state Supreme Court justices in the heavily Republican state. The measure also prevents the government from “penalizing patients, healthcare providers, or anyone who assists in exercising their right to make and carry out voluntary decisions about their pregnancy.”The ballot measure required a simple majority to pass. Nine other states considered constitutional amendments concerning abortion rights in this election: Arizona, Colorado, Florida, Maryland, Missouri, Nebraska, Nevada, New York and South Dakota.

The Trump campaign and surrogates began filing lawsuits the very same day, challenging the results on a variety of grounds well before the final votes were counted. In Arizona, voters and the Trump campaign filed a lawsuit alleging thousands of people in Maricopa County had their ballots disqualified because of ink-bleed caused by Sharpies. WASHINGTON — The Supreme Court on Friday handed a loss to Republicans by allowing Pennsylvania voters who sent mail-in ballots that were flagged as being potentially defective to submit a separate provisional in-person ballot. The justices rejected, with no noted dissents, a Republican request to put on hold a Pennsylvania Supreme Court ruling from last week. The Supreme Court action does not definitively resolve the legal issue, which could yet return to the justices. Many of Pennsylvania's counties, which administer elections, already allowed for voters to cast provisional ballots if their mail-in ballots lacked a secrecy envelope even before the recent state Supreme Court ruling. Genser and Matis lost in a trial court, but an intermediate appeals court and the Pennsylvania Supreme Court ruled in their favor, prompting Republicans to appeal again to the U.S. Supreme Court.

In states where tensions have long boiled over reproductive rights, family planning experts say women face mounting barriers to getting birth control. In June, Senate Republicans blocked a bill that would have enshrined a national right to birth control into law. States have been left to decide if they will protect access to birth control. Mexico City Reuters —Eight of 11 justices on Mexico’s Supreme Court have resigned and declined to participate in an election for the court scheduled for June, the court said on Wednesday. Seven of the jurists’ resignations are effective August 31, 2025, while Aguilar will leave office on November 30. The slate of resignations heightens tensions between Mexico’s Supreme Court and the ruling bloc, increasing the risk of a constitutional crisis as Congress and the presidency remain at odds with the judiciary over the reform. In her letter to the Senate on Wednesday, Rios said her resignation “should not be seen as an implicit endorsement of a (reform) framework that remains controversial.”The 11-member Supreme Court will see its number reduced to nine as part of the reform. WASHINGTON — The Supreme Court on Wednesday allowed Republican officials in Virginia to revive a plan aimed at removing noncitizen voters from the rolls ahead of next week’s election. Virginia has same-day voter registration, meaning that any eligible voter who was removed from the rolls should still be able to vote. The Justice Department said that while states can review its voter rolls, it cannot do so right before an election. States are barred from systematically removing people from voters rolls within 90 days of an election under the National Voter Registration Act. In court papers, the groups said that "the record makes clear that citizens are being removed from the voter rolls."
