A new one-page indictment delivered by the grand jury Friday alleges Baldwin caused Hutchins' death — either by negligence or “total disregard or indifference” for safety. Defense attorneys for Baldwin indicate they'll fight the charge, which carries a potential prison sentence of up to 18 months. The indictment provides prosecutors with two alternative standards for the felony involuntary manslaughter charge against Baldwin. Mangels said a grand jury indictment is by no means an assurance that prosecutors will prevail at trial. “Just getting an indictment from a grand jury in no way means the prosecution has a slam dunk case or even a strong case,” she said.

SANTA FE, N.M. (AP) — A grand jury indicted Alec Baldwin on Friday on an involuntary manslaughter charge in a 2021 fatal shooting during a rehearsal on a movie set in New Mexico, reviving a dormant case against the A-list actor. Special prosecutors brought the case before a grand jury in Santa Fe this week, months after receiving a new analysis of the gun that was used. Baldwin, the lead actor and a co-producer on the Western movie “Rust,” was pointing a gun at cinematographer Halyna Hutchins during a rehearsal on a movie set outside Santa Fe in October 2021 when the gun went off, killing her and wounding director Joel Souza. Baldwin has said he pulled back the hammer, but not the trigger, and the gun fired. They later pivoted and began weighing whether to refile a charge against Baldwin after receiving a new analysis of the gun.

(AP) — Alec Baldwin didn't have to pay anything to resolve a $25 million lawsuit filed by family members of a Marine killed in Afghanistan after the actor chastised them on social media over the Jan. 6, 2021, insurrection at the U.S. Capitol, Baldwin's attorney said. Rylee McCollum, of Jackson, Wyoming, When the McCollum family didn’t file an amended lawsuit as Ramos invited to do before a September deadline, the judge closed the case in October. SANTA FE, N.M. (AP) — Prosecutors are preparing to present evidence to a grand jury against Alec Baldwin in the fatal 2021 shooting of a cinematographer on the set of a Western movie in New Mexico. A grand jury did not take up the case Thursday and a decision on whether to revive criminal charges against Baldwin still could be weeks away. They later pivoted after receiving a new analysis of the gun and will ask a grand jury to consider recharging Baldwin. NEXT STEPSA grand jury could weigh whether there is “probable cause” to bring charges against Baldwin as the target of the investigation. A case can’t be brought twice before a grand jury on the same evidence, so if they don't proceed this time a second grand jury is less likely.

New Mexico prosecutors intend to recharge actor Alec Baldwin with involuntary manslaughter in connection with the fatal 2021 "Rust" shooting, two sources familiar with the matter tells NBC News. The source adds that Baldwin's case will be brought before a grand jury in mid-November. When the involuntary manslaughter charges were dropped earlier this year, prosecutors said the gun might have been modified before the shooting and malfunctioned. A gun analysis report commissioned by the special prosecutors released in August found that the gun had not been modified. The film's armorer, Hannah Gutierrez Reed, was also charged in January with involuntary manslaughter.

SANTA FE, N.M. (AP) — Special prosecutors are seeking to recharge actor Alec Baldwin in the fatal shooting of a cinematographer on the set of a Western movie in 2021, describing Tuesday their preparations to present new information to a grand jury. Political Cartoons View All 1211 ImagesAttorneys for Baldwin said the latest move by prosecutors is misguided. Special prosecutors initially dismissed an involuntary manslaughter charge against Baldwin in April, saying they were informed the gun might have been modified before the shooting and malfunctioned. The weapons supervisor on the movie set, Hannah Gutierrez-Reed, has pleaded not guilty to involuntary manslaughter and evidence tampering in the case. In the revived case against Baldwin, a grand jury would “determine whether probable cause exists to bind Baldwin over on criminal charges,” special prosecutors said.

At the time, special prosecutors Kari Morrissey and Jason Lewis said Baldwin could still face culpability and charges could be refiled. “The charges against Alec Baldwin were dismissed without prejudice because a possible malfunction of the gun significantly affects causation with regard to Baldwin, not with regard to Gutierrez. If it is determined that the gun did not malfunction, charges against Mr. Baldwin will proceed. When reached by CNN Wednesday, Morrissey said charges against Baldwin are still being considered and a final decision had not been made. According to the report attached to Gutierrez Reed’s motion, the experts say the trigger was in fact pulled on the weapon, which Baldwin has consistently denied.

REUTERS/Bing Guan/File PhotoAug 4 (Reuters) - “Rust” armorer Hannah Gutierrez on Friday waived her right to a preliminary hearing, allowing charges against her over the 2021 shooting death of the movie's cinematographer, Halyna Hutchins, to move toward a possible trial. Actor Alec Baldwin was rehearsing when he fired a live round that killed cinematographer Hutchins and wounded director Joel Souza. Prosecutors Andrea Reeb and Mary Carmack-Altwies, who handled the case until March, declined to comment on plea bargains. Prosecutor Kari Morrissey, who took over the case, said in a statement she expected the case to be set for trial in the future. Under New Mexico law, to convict Gutierrez of involuntary manslaughter prosecutors must prove she showed willful disregard for firearms safety.

CNN —The armorer on the set of the movie “Rust” likely was hungover when she loaded a prop gun used by actor Alec Baldwin that fired a live round of ammunition during a rehearsal, killing cinematographer Halyna Hutchins, prosecutors said in a court filing. Witnesses told investigators Hannah Gutierrez Reed “was drinking heavily and smoking marijuana in the evenings during the shooting of Rust,” prosecutors said in the Friday filing. Gutierrez Reed will plead not guilty to two counts of involuntary manslaughter in connection with the October 2021 shooting, an attorney for her has said. A final decision on charges against Baldwin would be made before August 8, prosecutors said in the Friday filing. Through their respective attorneys, both Gutierrez Reed and Halls accused Baldwin of deflecting blame onto others.

CNN —Prosecutors in the “Rust” fatal shooting case plan to file a notice to dismiss involuntary manslaughter charges against Alec Baldwin, his attorney, Luke Nikas, tells CNN. CNN has contacted the special prosecutor in the Santa Fe, New Mexico case for comment. Baldwin and “Rust” armorer Hannah Gutierrez Reed were both charged with involuntary manslaughter in January. April 20 (Reuters) - New Mexico prosecutors have decided to drop criminal charges against actor Alec Baldwin in the fatal shooting of cinematographer Halyna Hutchins on the set of the Western movie "Rust" in 2021, Baldwin's lawyers said on Thursday. Baldwin, 65, was charged in January with two counts of involuntary manslaughter in connection with Hutchins' death and the injury of "Rust" director Joel Souza, who was also shot. He pleaded not guilty in February after prosecutors downgraded the seriousness of the charges, reducing the potential prison time. Baldwin settled a lawsuit in October with the cinematographer's husband, Matt Hutchins, in a deal that made Hutchins an executive producer on the movie. Gutierrez-Reed has blamed the shooting on other factors including possible sabotage, Baldwin's lack of training and a failure by Halls and Baldwin to ask her for extra checks.

CNN —Filming of the movie “Rust” will resume this week. On Tuesday, a spokesperson for Rust Movie Productions told CNN that principal photography of “Rust” is set to resume Thursday at Yellowstone Film Ranch in Montana. Production on the western starring Alec Baldwin came to a halt in 2021, when cinematographer Halyna Hutchins was fatally shot when a prop gun Baldwin was holding fired a live round of ammunition during rehearsal. Baldwin and Souza will also return to finish the project, according to Rust Movie Productions. Baldwin and “Rust” armorer Hannah Gutierrez Reed were charged with involuntary manslaughter in Hutchins’ death in January.
March 27 (Reuters) - Cinematographer Halyna Hutchins was killed on the New Mexico set of Western movie "Rust" in 2021 after live ammunition was mixed with dummy rounds. Five other live rounds were later found on the set by investigators. Investigators have not been able to establish where the live rounds found on the "Rust" set came from. Kenney has denied that the live rounds on set came from his company. Charging documents held Gutierrez-Reed responsible for "allowing live ammunition on the set," but not for bringing them to the production.
New Mexico prosecutors denied the claim that Alec Baldwin's lawyers made on Thursday that state authorities had destroyed the firearm that killed cinematographer Halyna Hutchins on the set of the movie "Rust." Prosecutors didn't respond to Spiro's assertion during the hearing, but in a statement to CNBC said that Spiro's claim is false. "The gun Alec Baldwin used in the shooting that killed Halyna Hutchins has not been destroyed by the state. Baldwin, star and producer of "Rust," was holding the gun when it killed Hutchins. The defendants are charged with two different types of involuntary manslaughter following the October 2021 fatal shooting of cinematographer Halyna Hutchins.
Feb 23 (Reuters) - Actor Alec Baldwin entered a not guilty plea on Thursday to a charge of involuntary manslaughter stemming from a fatal shooting on the New Mexico set of the film "Rust," court documents show. Baldwin made the plea while exercising his right to waive a first court appearance that was set for Friday, according to a court filing. New Mexico First Judicial District Attorney Mary Carmack-Altwies in January charged Baldwin and the movie's set armorer, Hannah Gutierrez-Reed, with two counts of involuntary manslaughter for the 2021 death of cinematographer Halyna Hutchins. First assistant director Dave Halls also plead not guilty in a Thursday court filing in which he waived a Feb. 24 first court appearance. Baldwin and Gutierrez-Reed now faces a maximum of 18 months in prison if convicted.
Feb 20 (Reuters) - Prosecutors have downgraded the involuntary manslaughter charges against Alec Baldwin, reducing the possible prison time the Hollywood star may face for the 2021 fatal shooting on the set of the movie "Rust," charging documents showed. Carmack-Altwies filed altered charges for Baldwin and Gutierrez-Reed on Friday, removing the firearm enhancement and reducing their possible prison sentence from a minimum of five years to a maximum of 18 months. “We applaud the decision of the district attorney to dismiss the firearm enhancement and it was the right call, ethically, and on the merits," said Jason Bowles, an attorney for Gutierrez-Reed. In 2022, the criteria for applying the firearm enhancement -with the 5-year minimum prison sentence - was expanded to include when a weapon was simply "discharged" in the commission of a noncapital felony. Baldwin and Gutierrez-Reed are both expected to make an initial court appearance in Santa Fe, New Mexico, on Feb. 24.
