With his comeback victory over Vice President Kamala Harris in the books, Trump can rest easy. But he has not yet escaped from liability in a handful of high-profile civil cases, where he has been ordered to pay combined penalties of over $570 million. "In theory, there should be no effect" from Trump's election on those civil matters, former federal prosecutor Neama Rahmani told CNBC. "It's well established that while a sitting president can't be prosecuted, he can face civil cases," Rahmani said. A state-level criminal case in Georgia, alleging Trump illegally meddled in that state's 2020 election, is also on ice.

Since it is a state case, Trump does not have the power to pardon himself next year after he is sworn into office. Federal cases in DC and FloridaTrump’s election victory is poised to have the greatest impact on the two federal criminal cases brought against him by Smith in Washington, DC, and Florida. Dismissing Smith would allow the Department of Justice and Trump’s attorney general to move to drop the charges against him and end the court cases. In the DC case, Smith charged Trump over his efforts to overturn his election loss in 2020. In September, state and federal appeals courts in New York heard arguments for two of Trump’s civil appeals.

The Trump campaign and surrogates began filing lawsuits the very same day, challenging the results on a variety of grounds well before the final votes were counted. In Arizona, voters and the Trump campaign filed a lawsuit alleging thousands of people in Maricopa County had their ballots disqualified because of ink-bleed caused by Sharpies. In Wisconsin, Trump filed a lawsuit alleging widespread voter fraud and demanding a recount, which ultimately reaffirmed Joe Biden’s victory in the state. In the event that Trump wins, staffers detailed to the special counsel’s office would have the option to go back to their home divisions within the Justice Department. But former prosecutors on the Trump case could face a difficult workplace, once Trump’s appointees are running the department. If Vice President Kamala Harris wins, the choices for the department and the special counsel’s office may be much simpler. “Just think of the chaos of it all – that, he [Trump] would love,” one of the former Justice Department officials said.

Former President Donald Trump said Thursday that, if elected to a second term in November, he would immediately fire special counsel Jack Smith, who brought two federal indictments against Trump. "It's so easy — I would fire him within two seconds," said Trump, who added that he got “immunity at the Supreme Court" and called Smith a "crooked person." Firing him as special counsel potentially could end the federal government's prosecution against Trump. Judge Tanya Chutkan allowed the release of hundreds of pages of heavily redacted documents last week that contained evidence the special counsel was using for the prosecution. Last year, Trump warned that Smith and other Justice Department officials would wind up in a mental institution if he's re-elected.

CNN —Senate Minority Leader Mitch McConnell delivered a scathing assessment of the modern Republican Party in an upcoming biography, saying the “MAGA movement is completely wrong” and that Ronald Reagan “wouldn’t recognize” the party today. The Republican leader eventually voted to acquit Trump during the second impeachment trial, focused on the former president’s involvement in the January 6, 2021, attack on the Capitol. However, Tackett reports that McConnell had leaned towards voting to convict at certain points. However, McConnell has endorsed Trump, and met with him back in June of this year during Trump’s meeting with Senate Republicans off the Hill. WASHINGTON — Republican Presidential candidate Donald Trump on Friday called the judge overseeing the Jan. 6-related federal criminal case against him "the most evil person," despite threats U.S. District Judge Tanya Chutkan has already faced from his supporters.
