There may be a path for Smith to revive the case, Cannon noted in her ruling, and Smith can appeal the decision. Cannon left open a potential pathway in her ruling for the classified documents case to be revived. (He is being prosecuted by a separate special counsel, David Weiss.) And during the Trump-Russia investigation, multiple Trump allies similarly attempted to derail special counsel Robert Mueller’s work. Former Attorney General Edwin Meese and Citizens United argued the same, writing that Smith’s appointment “severely undermines” the constitutional order.

The GOP-led House Oversight Committee issued subpoenas Wednesday for three White House aides, requesting depositions to discuss President Joe Biden's cognitive state. The subpoenas, first reported by Axios, are for first lady Jill Biden's senior adviser Anthony Bernal, White House deputy chief of staff Annie Tomasini and White House senior adviser Ashley Williams. "President Biden is clearly unfit for office, yet his staff are trying to hide the truth from the American people," he added. When reached for comment, White House spokesperson Ian Sams criticized Comer and called the subpoenas a "baseless political stunt intended for him to get media attention instead of engage in legitimate oversight." The three aides were previously asked to appear before the committee as part of the Biden classified documents investigation, but the committee says the White House blocked their appearances.

Even so, four sources close to the Biden family said there is no active effort to shake up staffing right now. Hunter Biden's appearance in White House meetings this week was just one instance of what is expected to be the deeper Biden family involvement. From the view of some Biden aides, the family is seizing on an opportunity to try to settle old scores. President Joe Biden's family is attempting to become more involved over his campaign and White House affairs as their anger with his staff spills into public view. Hunter Biden's stepped-up involvement has confounded some White House staff members and revived a longtime sore spot.

Washington CNN —The White House on Tuesday fended off tough questions about President Joe Biden’s mental fitness, acknowledging his poor performance in last week’s debate while maintaining the president is still able to hold and run for office. The president did not have a great night,” White House press secretary Karine Jean-Pierre said. Campaign officials are scrambling to calm donors who were shocked by Biden’s halting, hoarse performance. The White House announced Tuesday that Biden is expected to meet with Democratic governors and congressional leaders Wednesday after some demanded a meeting with the president. Hunter Biden (R), son of US President Joe Biden, exits the J. Caleb Boggs Federal Building on June 10, 2024 in Wilmington, Delaware. Jury deliberations began on Monday in Hunter Biden's trial on federal gun charges, US media reported. U.S. President Joe Biden's son Hunter Biden sued conservative news outlet Fox News on Monday for publishing nude photos and videos of him in a fictionalized "mock trial" miniseries focused on his foreign business dealings. Hunter Biden alleges Fox violated New York state's so-called revenge porn law, which makes it illegal to publish intimate images of a person without their consent. Fox aired "The Trial of Hunter Biden: A Mock Trial for the American People" on its Fox Nation streaming platform in October 2022 but later took it down under threat of lawsuit by Biden's attorneys.

CNN —Hunter Biden has sued Fox News and its parent corporation, accusing the right-wing network of smearing him and unlawfully publishing his explicit images without his consent in a 2022 miniseries about his legal troubles. The miniseries, “The Trial of Hunter Biden,” was a six-part offering on the Fox Nation digital streaming network, and was also promoted on Fox News, the cable TV channel. It featured a dramatized “mock trial” about Hunter Biden’s overseas financial dealings that led in part to his federal tax indictment and that also fueled House Republicans’ struggling impeachment inquiry into his father. Fox News took down the miniseries in late April, one day after Hunter Biden threatened to file a lawsuit. “The program was removed within days of the letter, in an abundance of caution, but Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon.

President Biden’s son Hunter Biden sued Fox News on Sunday, arguing that a mini-series produced by the company broke the law by sharing explicit photos and videos of him without his permission. The program, “The Trial of Hunter Biden,” which first appeared in 2022 on Fox Nation, the network’s streaming service, presented a dramatized version of a criminal trial of Mr. Biden, with fictional charges. The mini-series integrated real-life images of Mr. Biden in the nude and engaged in sex acts, imagery that was discovered on a laptop that Mr. Biden abandoned at a computer repair shop in Delaware. The law allows people to sue anyone who shares their sexually explicit photos and videos without permission. “Fox published and disseminated these intimate images to its vast audience of millions as part of an entertainment program in order to humiliate, harass, annoy and alarm Mr. Biden and to tarnish his reputation,” the lawsuit states.

CNN —Joe Biden’s family on Sunday encouraged the president to stay in the 2024 race and privately discussed whether top aides should be fired on the heels of Biden’s stunningly poor debate performance, which has thrown his campaign into turmoil. Biden’s family, including first lady Jill Biden, son Hunter Biden and their grandchildren, convened at Camp David for a previously scheduled get-together and implored the president to keep fighting in his bid for reelection, Biden advisers told CNN. Biden, however, is known for being loyal to and protective of his close advisers, and does not like to fire aides. The admiration and support that Biden’s family showed the president Sunday mirrored the first lady’s effusive public praise for her husband in recent days. The opinion of Biden’s family would be crucial in determining his political future – even more so than the president’s famously insular inner circle of top advisers.

President Biden’s family is urging him to stay in the race and keep fighting despite last week’s disastrous debate performance, even as some members of his clan privately expressed exasperation at how he was prepared for the event by his staff, people close to the situation said on Sunday. Mr. Biden huddled with his wife, children and grandchildren at Camp David while he tried to figure out how to tamp down Democratic anxiety. While his relatives are acutely aware of how poorly he did against former President Donald J. Trump, they argued that he could still show the country that he is capable of serving for another four years. Aides were burning phone lines over the weekend to prevent major elected officials and financial supporters from abandoning him. Hunter Biden wants Americans to see the version of his father that he knows — scrappy and in command of the facts — rather than the stumbling, aging president Americans saw on Thursday night.

CNN —The Supreme Court on Wednesday said the White House and federal agencies such as the FBI may continue to urge social media platforms to take down content the government views as misinformation, handing the Biden administration a technical if important election-year victory. Republican officials in two states – Missouri and Louisiana – and five social media users sued over that practice in 2022, arguing that the White House did far more than “persuade” the tech giants to take down a few deceptive items. That might include, the justices theorized, social media threats targeting public figures or disclosures of sensitive information about US troops. The case arrived at the high court at a time when the government has repeatedly warned of foreign efforts to use social media to influence elections. The jawboning case was one of several high-profile matters the court is deciding at intersection of the First Amendment and social media.

Washington CNN —Hunter Biden’s Washington, DC, law license has been suspended, according to a newly released order from a local court that pointed to his recent conviction on three gun crimes. The order was issued by Chief Judge Anna Elizabeth Blackburne-Rigsby of the DC Court of Appeals, which is the highest appellate court in DC and oversees the DC Bar. It is typical for bars in other states to reciprocate law license suspension or disbarment orders, meaning Biden’s license is also likely to soon be suspended in any other state where he is licensed. Biden has asked for a new trial in the gun case. During closing arguments in Biden’s gun trial, one of the prosecutors described him as a “Yale-educated defendant,” referring to the school where he earned his law degree.

Differences like these lead researchers like me to wonder what factors influence the telling of lies. Figuring out the frequency of liesMost research on lying asks participants to self-report their lying behavior, say during the past day or week. This result became the benchmark finding in the field of honesty research and helped lead to an assumption among many researchers that lying is commonplace. It could be that each person in the group tells one or two lies per day. Many lies occur in the heat of the moment, so it makes sense that when there’s a delay in communication, as with email, lying would decrease.

CNN —Hunter Biden is requesting a new trial in his federal gun case, with his lawyers claiming that there was a procedural issue in the timing of the early June trial that resulted in a guilty verdict against him. His lawyers claim that the trial court did not have jurisdiction over his case because of appeals that he had filed challenging his prosecution. The defense team says that the conviction must be wiped away because, even though the appeals court had rejected the appeals by the time the trial started, it had not issued what’s known as a “mandate” – the procedural maneuver that effectively notifies a lower court of ruling made by a higher court in an appeal. Biden’s lawyers are pointing to the absence of a mandate sending the case back to the trial court after the 3rd US Circuit Court of Appeals handed down rulings rejecting two of his appeals in late May. “The Third Circuit, however, did not then and has not yet issued its mandate as to the orders dismissing either appeal,” his lawyers wrote.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. Biden, who’s battling low approval ratings, is sticking with Vice President Kamala Harris, whose polls are also bleak. There were 28, and we’ve had 11 so far this year, Bridget Johnson noted in the first of a CNN Opinion series about America’s preparedness. “It’s a measure of his hold on American society that he’s still revered a half-century later,” wrote Frederic J. On Monday, the federal judge overseeing the case will hold a hearing for both parties to present their arguments over the proposed gag order, and tensions between the two sides could quickly rise. Citing Trump’s continued mischaracterization of the FBI’s policy in place around the use of deadly force during the search, prosecutors say Trump’s false claims that he nearly escaped death from federal agents could lead to threats and harassment against them. Trump was in New York when agents searched the Florida estate. “Shortly after the execution of the search warrant at Mar-a-Lago, one of Trump’s supporters carried out an armed attack on an FBI office in the wake of Trump’s Truth Social statements regarding the search,” prosecutors wrote.
