One of the Biden White House’s greatest achievements, from the perspective of its staffers, if not necessarily the country, has been to deny the press the kind of juicy leaks that were constant under Donald Trump and frequent under his predecessors. For instance, we learned that Biden hadn’t held a full cabinet meeting since last October and that his handlers expected scripted questions from his cabinet officials. We learned that his capacities peak between 10 a.m. and 4 p.m. and diminish outside that six-hour window. We learned that congressional Democrats, liberal donors and some journalists all had exposure to Biden’s decline that they didn’t discuss publicly until the debacle of the June debate. We learned that none other than Hunter Biden was acting as a close adviser to his father in the crucial days after that debate.

The legality of Justice Department special counsels has been the subject of some debate over the past two decades. Since then, the US Attorney General has appointed special counsels with less authority while relying on internal Justice Department regulations. AdvertisementDefense lawyers in special counsel investigations have routinely argued the appointment of these newer special counsels is unconstitutional. His lawyers had signaled that, on appeal, they would challenge the legality of appointing a special counsel in the first place.

There may be a path for Smith to revive the case, Cannon noted in her ruling, and Smith can appeal the decision. The GOP-led House Oversight Committee issued subpoenas Wednesday for three White House aides, requesting depositions to discuss President Joe Biden's cognitive state. The subpoenas, first reported by Axios, are for first lady Jill Biden's senior adviser Anthony Bernal, White House deputy chief of staff Annie Tomasini and White House senior adviser Ashley Williams. "President Biden is clearly unfit for office, yet his staff are trying to hide the truth from the American people," he added. When reached for comment, White House spokesperson Ian Sams criticized Comer and called the subpoenas a "baseless political stunt intended for him to get media attention instead of engage in legitimate oversight." The three aides were previously asked to appear before the committee as part of the Biden classified documents investigation, but the committee says the White House blocked their appearances.
