Energizer was "under pressure from Walmart" to ensure that nobody sold batteries for a lower price, three lawsuits say. The lawsuits allege that Energizer inflated wholesale battery prices for Walmart competitors. The lawsuits allege that in exchange for Walmart giving Energizer "preferential treatment" at its stores, Energizer agreed to a scheme to "artificially inflate the wholesale prices it charged to Walmart's competitors for Energizer Battery Products to prevent them from undercutting Walmart's retail prices." They further allege that, as a result, prices for batteries from Energizer's chief rival, Duracell, also were artificially inflated. The group "policed Energizer's customers' retail prices and raised wholesale prices as necessary to force Energizer's customers to maintain retail prices that did not undercut Walmart's," per the lawsuits.
According to complaints filed on Friday, Energizer agreed "under pressure from Walmart" to inflate wholesale battery prices for other retailers starting around January 2018, and require those retailers not to undercut Walmart on price. Walmart rivals allegedly risked higher wholesale prices or being cut off by Energizer, the largest U.S. disposable battery maker, if they charged less at checkout than Walmart, the world's largest retailer. According to the plaintiffs, Energizer's share of the U.S. disposable battery market has risen to more than 50% from 40% in 2018. The cases in the U.S. District Court, Northern District of California, are: Copeland et al v Energizer Holdings Inc et al, No. 23-02091, and Schuman et al v Energizer Holdings Inc et al, No.

David Rosenberg sees a near-term recession, a 20% hit to stocks, and a damaging credit crunch. The economist panned the Fed for hiking interest rates and said they could hit zero again. (Rosenberg suggested S&P 500 earnings could drop by one-fifth in a recession, to about 3,200 points.) Now we have not just the cost of credit being a problem for the economy, but the availability of credit is going to compound that. Shares of movie theater chain AMC (AMC) have soared nearly 65% so far in 2023, and AMC (AMC)’s companion preferred stock (which trades under the ticker APE as a nod to the nickname AMC (AMC) fans have given themselves on social media) has more than doubled. So did investors learn nothing from last year’s market meltdown? I don’t agree with this market rally in meme stocks,” said Erik Ristuben, chief investment strategist with Russell Investments. Another strategist agrees this recent rally for meme stocks and other speculative bets may not end well. If they’re upbeat about spending, that could keep the rally in consumer stocks going.

With few economic releases and the earnings season starting to wind down, an appearance by Federal Reserve Chairman Jerome Powell Tuesday could be among the newsiest events for markets in the week ahead. Riley. Economists said Friday's surprisingly strong jobs report should encourage the Fed to push forward with planned rate hikes. Earnings, earnings, earnings But there continues to be earnings news.
Now is the time to sell shares of tech giant Microsoft , according to analysts at Guggenheim. The firm on Tuesday downgraded the shares to sell from neutral and introduced a $212 price target, implying a more than 11% downside for Microsoft. Microsoft may disappoint on upcoming earnings numbers in the second quarter of 2023 and in their full-year guidance as well. "While most investors see MSFT as a large stable business that can weather any storm, it does have vulnerabilities, some of which could be exacerbated by this macro slowdown," analyst John DiFucci wrote. The biggest headwind the firm sees is MPC business, where consensus numbers are expecting slight growth after several quarters of declines.
Two men have been charged in the Christmas Day attacks on four power substations near Tacoma, Washington, that left about 14,000 homes and businesses without power, officials said Tuesday. While federal authorities have long said the country's power grid is vulnerable to terrorists domestic and foreign, the suspects may have been motivated by the spoils of burglary, prosecutors said. The federal public defender's office for Western Washington didn't immediately respond to a request for comment. The attacks appeared to successfully target the substations' high-side switches, devices that can connect or disconnect a potent power source, authorities said in court filings. The Graham and Elk Plain substations are operated by Tacoma Power; the Kapowsin and Hemlock substations are operated by Puget Sound Energy.

The New York Post depicted Donald Trump as a nursery-rhyme character for its Thursday cover. Many Republicans saw the midterm results as a stunning rebuke of Trump's supposed hold on the GOP. The cover was shared by New York Times correspondent Maggie Haberman, a former New York Post reporter herself. At the time, The Post's editorial board wrote that Trump would bring back "explosive job creation, rising wages and general prosperity" prior to the pandemic. Piers Morgan, the controversial British journalist who joined The Post as a columnist in 2021, authored the cover story.
Compared to non-energizers, energizers are three to four times more likely to get promoted faster and receive top performance reviews...Energizers tend to do nine things more systematically than others. I maintain a balance between what I ask for and what I contribute to the people I work with. Why energizers are the most valuable employeesCompared to non-energizers, energizers are three to four times more likely to get promoted faster and receive top performance reviews, and three times as likely to successfully manage their career transitions. But that's wrong: Neither extroversion nor charisma create energizers. When a colleague of mine did an analysis for the Broad Institute of MIT and Harvard, the results were unexpected.
