Elon Musk and his political action committee are seeking to move the Philadelphia District Attorney's lawsuit targeting their $1 million swing state voter daily lottery to federal court from a state-level court. It is not clear what will happen at the hearing, given the notice of removal in federal court. As a rule, federal law bars a state court proceeding from taking place if a party in the case has filed a notice of removal to federal court and a copy of that notice is filed with the state court. The notice filed in federal court by lawyers for Musk and his America PAC argue that because that PAC is registered as a federal entity, it is not subject to state law. Krasner's lawsuit, which claims Musk's $1 million giveaway is an illegal, unregulated lottery, was filed in Court of Common Pleas on Monday.

Harris also said that Biden had "clarified" the comment he made Tuesday. "Just the other day, a speaker at his rally called Puerto Rico a 'floating island of garbage,'" Biden said on the call. In this version, it seemed that Biden was saying the "garbage" was Hinchcliffe's demonization of Latinos, not Trump supporters. In 2020, Biden beat Trump in the state by fewer than 81,000 votes, a margin of less than 1.2%.

A federal judge on Friday blocked Virginia from purging its voter rolls of alleged noncitizens and ordered the state to reinstate more than 1,600 people who had already been bounced from those lists. Judge Patricia Giles in her ruling agreed with arguments by the U.S. Department of Justice, which said that the purge ordered by Gov. Federal law bars states from systematically removing people from voter rolls within 90 days of an election. The DOJ said in a court filing that 43 people in Prince William County who had been removed from voter rolls were likely U.S. citizens, and lawyers earlier this week confirmed that 18 American citizens were removed from voter rolls. Giles said it was "not happenstance" that Youngkin had issued his executive order to purge the voter rolls exactly 90 days before Election Day.

Musk has promised Tesla shareholders a robotaxi for more than a decade. However, Tesla has never produced a vehicle that is safe to use without a human ready to steer or brake at any time.

FBI agents on Thursday arrested an Alabama man for his alleged role in the Jan. 9 hack of the Securities and Exchange Commission's X account, which sent the price of bitcoin spiking by more than $1,000, the Department of Justice announced. The tweet said, "Today the SEC grants approval for #Bitcoin ETFs for listing on all registered national securities exchanges." Shortly afterward, the SEC regained control of its social media account, and announced the tweet was false and the result of a hack. A day after the hack, the SEC approved rule changes that allowed the creation of bitcoin ETFs in the United States. Council, who used the online handles "Ronin," "Easymunny," and "AGiantSchnauzer," allegedly was paid in bitcoin by co-conspirators for his role in the hack.

Philip Esformes, whose 20-year prison sentence for a massive, $1.3 billion Medicare fraud scheme was commuted in 2020 by then-President Donald Trump, was arrested over the weekend in Florida on domestic-violence related charges. Esformes is at least the seventh person who received executive clemency from Trump, and has since been charged with new crimes, according to The New York Times, which first reported this latest arrest. Court records show that Esformes was arrested Saturday and then charged with tampering with a victim or witness, and with criminal mischief involving property damage. CNBC also has requested comment from a lawyer for Esformes' ex-wife, Sherri Beth Esformes, whose divorce from him was finalized in July 2020. A federal appeals court has fast-tracked the Commodity Futures Trading Commission's case challenging the right of the event exchange Kalshi to offer U.S. political election contracts. Kalshi touted its presidential election contracts on electronic signs in New York City's Times Square over the weekend. The CFTC told the appellate court that election contracts "are susceptible to market manipulation" and also pose a risk to election integrity or how the public views the integrity of elections. Only then did Pretrial Services inform prosecutors that Jicha's ankle bracelet had ceased working, 26 hours after becoming aware of that fact, the prosecutor told the judge.
