CNN —A federal judge paused some filing deadlines in the classified documents case against former President Donald Trump in a brief order Saturday, and agreed to additional briefings on whether she should pause the case to consider what effect the Supreme Court’s immunity ruling may have on the criminal proceedings in Florida. Judge Aileen Cannon set a two-week briefing schedule for those arguments and paused three unrelated filing deadlines that were scheduled to take place during that period. Trump is charged in the case with taking classified documents from the White House and resisting the government’s attempts to retrieve the materials. The Supreme Court ruled Monday that Trump may claim immunity from criminal prosecution for some of the actions he took in the waning days of his presidency. The court’s decision directly applies to his federal election subversion case in Washington, DC, but it could impact all four of the criminal cases against the former president.

CNN —Attorneys for former President Donald Trump are now seeking to use the Supreme Court’s presidential immunity decision to help him in his criminal case in Florida over the mishandling of classified documents. In a new court filing Friday, Trump’s team said they want an updated schedule in the federal classified documents case so they can argue points related to the Supreme Court decision. The decision “guts the Office’s position that President Trump has ‘no immunity’ and further demonstrates the politically-motivated nature of their contention that the motion is ‘frivolous,’” Trump’s attorneys wrote. The Supreme Court’s decision directly applies to the federal case over 2020 election subversion efforts in Washington, DC, but it could impact all four of the criminal cases against the former president. Trump’s attorneys argue the concurrence “adds force” to motions Trump has filed against how Smith was appointed and funded.

CNN —The Supreme Court handed down a landmark decision Monday granting Donald Trump partial immunity from special counsel Jack Smith’s election subversion case, handing the former president a significant win during his reelection bid. For starters, the Supreme Court ruled that for “core” presidential activity, Trump has the absolute immunity he had sought. The analysis about what’s immune and what isn’t “ultimately is best left to the lower courts to perform,” Roberts wrote. Immune, immune, immune,” she wrote. In a significant break from the court’s other conservatives, Barrett seemed to suggest Trump should go to trial quickly.

President Biden will respond on Monday night to the Supreme Court’s ruling on immunity for former President Donald J. Trump, White House officials said, his first public remarks since hunkering down at Camp David amid calls from some Democrats to drop out of the 2024 election. The Supreme Court ruled on Monday that Mr. Trump has significant immunity against prosecution on charges of trying to overturn the 2020 election. A spokesman for the White House Counsel’s Office said earlier that “as President Biden has said, nobody is above the law.”Mr. Biden’s response to the ruling is likely to signal how his campaign will handle the issue of Mr. Trump’s criminal cases, which have been a central part of the president’s argument for re-election. During a rally on Friday, he cited the numerous court cases against Mr. Trump as proof that he is a “one-man crime wave.”But the president’s appearance in Cross Hall, the stately venue used for many previous addresses to the nation, will be closely watched for the president’s vigor and mental acuity in the wake of his disastrous debate performance in Atlanta on Thursday.

CNN —The biggest question now that the Supreme Court has decided Donald Trump is entitled to some immunity from prosecution: What happens next in special counsel Jack Smith’s election interference case against the former president? Those are likely to come in the days after the Supreme Court hands the opinion down formally to the federal courts in DC. The Supreme Court said that that Trump’s pressure campaign on Vice President Mike Pence to help him overturn the election is “presumptively” immune, and put the burden on the prosecutors to rebut the presumptive immunity. The Supreme Court’s ruling strongly suggests that those appeals would need to be resolved pre-trial, making it unlikely this case goes to a jury before Americans cast their ballots for president. Jack Smith’s options going forwardIt’s also possible that Smith’s office winnows down his case to bring it in line with the Supreme Court’s opinion.

Washington CNN —Donald Trump used to tell his fans that he’d win so much, they’d get tired of winning. The ex-president’s lawyers are already signaling they will seek to get evidence tossed and obstruction counts against the ex-president dismissed. The court released its decision ahead of an even more critical case that will bear more directly on Trump’s criminal entanglements. A second 2020 election case, in Georgia, is also stalled – partly over a controversy and appeals process triggered by a relationship between District Attorney Fani Willis and a prosecutor she appointed. Trump is only three years younger than Biden and often lapses into gibberish in campaign events.

CNN —Judge Aileen Cannon wants to hold additional hearings on Donald Trump’s attempts to challenge key evidence in his classified documents case and will allow the former president’s lawyers to question witnesses about the investigation and search of Mar-a-Lago. Those issues were argued in hearings on Tuesday, but Cannon did not rule on the matters. The judge did not say when additional hearings would be held. The special counsel’s office has strongly opposed the need for additional hearings and Trump’s attempts to cut out parts of the case. Cannon has not set dates for the additional hearings yet.

CNN —Federal Judge Aileen Cannon said Tuesday she had “a hard time seeing” any problems with the warrant the FBI obtained to search former President Donald Trump’s Mar-a-Lago estate in the summer of 2022. Trump’s attorney Emil Bove had argued that the warrant was overly broad and unjustly allowed agents to search the entire Mar-a-Lago premises. Bove, like in other recent hearings in the classified documents case, wants the judge to hold even more hearings that could probe into the investigators’ work. “They purported to look for classified documents in a gym and a kitchen,” he added. Investigators say they found classified documents in various places at the resort, including a public ballroom, a bathroom and a bedroom.

Special Counsel Jack Smith delivers remarks on a recently unsealed indictment including four felony counts against former President Donald Trump on August 1, 2023 in Washington, DC. Drew Angerer/Getty ImagesAttorneys for Donald Trump will continue their legal efforts to throw off special counsel Jack Smith and the classified documents case against the former president in Florida on Monday. Trump’s attorneys will battle prosecutors in court on the second part of Trump’s argument that Smith’s appointment was illegitimate, focusing on how he’s being funded. On Friday, prosecutors, defense attorneys and third parties fought over whether Smith was legitimately appointed as special counsel, an argument district Judge Aileen Cannon seemed skeptical of during the hearing. “President Biden’s DOJ is paying for this politically motivated prosecution of Biden’s chief political rival ‘off the books,’ without accountability or authorization,” Trump’s attorneys argued in their filing earlier this year.

Cannon did not seem inclined to approve the limitations on Trump’s speech but did not immediately issue a ruling. The judge also heard arguments on Trump’s long-shot motion alleging that the special counsel’s office is being improperly funded. He said that while Trump is welcome to campaign, there should be certain limits when it comes to the safety of FBI agents on the case. “Steve Bannon making a comment is potentially the kind of thing that could send President Trump to jail,” Blanche said. Republicans on Capitol Hill have also tried to buckle down on the DOJ’s use of the special counsel’s office and its funding.

Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

For those looking for the hidden hand of politics in what the Supreme Court does, there’s plenty of reason for suspicion on Donald Trump’s as-yet-decided immunity case given its urgency. That eight-week interval is much quicker than the ordinary Supreme Court briefing process, which usually extends for at least 10 weeks. Nearly two months have passed since the justices heard lawyers for the former president and for the special counsel’s office argue the immunity case. The immunity case is not the only big case hanging fire. Some two dozen remain undecided that were argued even before the April 25 oral argument over Mr. Trump’s immunity.

CNN —Donald Trump’s attorneys on Friday ridiculed special counsel Jack Smith’s gag order request in the former president’s classified documents case in Florida, calling it an unconstitutional attack on the 2024 Republican candidate and a ploy to help Joe Biden keep the presidency. “In Jack Smith’s most recent shocking display of overreach and disregard for the Constitution, the Special Counsel’s Office asks the Court to enter an unconstitutional gag order as one of the release conditions on the leading candidate in the 2024 presidential election,” Trump’s attorneys wrote in a new filing, repeating their previous arguments against gag orders. The former president was in New York at the time. Prosecutors’ original ask for a gag order was thrown out by Federal Judge Aileen Cannon, who determined that they had not fully conferred with Trump’s attorneys before filing the request. Trump’s false claims “invite” threats and harassment against law enforcement agents involved in the case, prosecutors wrote, similar to those “that have occurred when other participants in legal proceedings against Trump have been targeted by his invective.”

CNN —Judge Aileen Cannon had been on the federal bench for little more than a year when a senior judge offered to preside over one of her first criminal trials in her isolated south Florida courthouse. In her seven years as a Justice Department attorney, Cannon participated on the trial teams of just four criminal cases. Still, Cannon has asked questions in the Trump case that appear out of left field. Her orientation toward such legal rabbit holes is not distinct to the Trump case, veterans of her courtroom say. Ultimately, nearly every attorney CNN spoke to said that Cannon, despite the criticism, is unwavering in her beliefs about how each case in her courtroom should proceed.

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority. Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue. Cannon’s signal of willingness to entertain challenges to the special counsel comes in the same week Republicans are bearing down on Attorney General Merrick Garland for his use of special counsels. A third group says the Department of Justice’s use of a special counsel should be upheld. Cannon still agreed to the hearing Trump wanted.

CNN —Federal Judge Aileen Cannon on Tuesday rejected special counsel Jack Smith’s request for a gag order against Donald Trump in the classified documents case, saying that prosecutors’ efforts to confer with the defendant was “wholly lacking in substance and professional courtesy.”In a brief order, Cannon slammed prosecutors for not following the court’s rules by failing to meaningfully confer with Trump’s defense lawyers about a potential gag order before making the request. Prosecutors can ask for a gag order again, Cannon said, once they give “sufficient time” to Trump’s defense team to read the motion and discuss it with prosecutors. Trump’s campaign, for instance, sent a fundraising email on Tuesday that claimed FBI agents were “locked and loaded” and that he “nearly escaped death” at Mar-a-Lago. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. In a blistering court filing late on Memorial Day, attorneys for Trump said that the gag order request was an “extraordinary, unprecedented, and unconstitutional censorship application” to target Trump’s speech as he runs for president.

Wilmington, Delaware CNN —The judge in Hunter Biden’s gun case issued a series of pretrial rulings Friday, handing wins to both sides and setting the contours of the upcoming trial. Federal Judge Maryellen Noreika sided with prosecutors on a key question about what they need to prove about Biden’s drug use when he bought a gun in 2018. Prosecutors said in court that they only want to introduce a small slice of the laptop material at trial. Lawyers said the trial could last up to two weeks, including jury selection, with the potential to go longer. She also limited what references prosecutors could make at trial to his lavish spending habits at the time of the gun purchase, narrowing such evidence to spending connected to drug use.

CNN —Special counsel’s office prosecutors on Friday asked a federal judge in Florida to place a gag order on Donald Trump that would limit his ability to comment about law enforcement that searched his Mar-a-Lago resort. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. The prosecutors say the gag order is needed to protect the integrity of the criminal case and law enforcement officers associated with it. Prosecutors noted that Trump has been amplifying accusations about the FBI in the search on his Truth Social account Friday. In a notably direct pushback to Trump, Attorney General Merrick Garland on Thursday addressed the claims that Trump has made about the FBI search at Mar-a-Lago.

US District Judge Aileen Cannon will hear arguments from defense attorneys on two separate bids to throw out charges in the case. Trump is accused by special counsel Jack Smith of taking classified national defense documents from the White House after he left office and of resisting the government’s attempts to retrieve the materials. Trump has obtained permission from the judge to skip Wednesday’s proceedings, which will start at 10 a.m. On Tuesday, hundreds of pages of previously sealed court filings were posted publicly as part of efforts by the former president to have the charges against him thrown out. She expressed “concern” the special counsel’s office had sought redactions of information in the newly unsealed filings after previously giving its OK for that information to be published in full in earlier court filings.

CNN —House Republicans will take their first step towards holding Attorney General Merrick Garland in contempt of Congress on Thursday for refusing to turn over the audio recordings of special counsel Robert Hur’s interviews with President Joe Biden. The House Oversight and Judiciary committees will each hold markups on their respective reports recommending a contempt of Congress resolution against Garland for failing to comply with a congressional subpoena. If passed out of the committees, the resolutions would next go to the House floor for a vote by the whole chamber. While Hur’s probe led to no charges against the president, Republicans have seized on Hur’s description of Biden as a “well-meaning, elderly man with a poor memory” in his final report. DOJ has also outlined distinct privacy concerns related to an audio recording of an interview compared to a written transcript, and how the release of such an audio file could dissuade cooperation from future witnesses in criminal investigations.

Barrett pins Trump down on his absolute immunity argumentsAs the second-least senior justice, Barrett sits at the far end of the Supreme Court’s mahogany bench. That was a notable break from earlier arguments Trump submitted that called for “absolute” immunity on a much wider scale of acts. A party turns to a private attorney, Barrett hypothesized, “who was willing to spread knowingly false claims of election fraud” to spearhead his challenges to an election. That appeared to be a reference to former Trump attorney Rudy Giuliani, identified by CNN as “co-conspirator 1” in Smith’s indictment. “This is where someone like Justice Barrett gets to pressure test an advocate’s points,” she said.
