☆ What the First Amendment Means for Campus Protests

Follow our live coverage of the college protests at U.C.L.A. But many legal scholars, along with university lawyers and administrators, believe at least some of those free-speech assertions muddle, misstate, test or even flout the amendment, which is meant to guard against state suppression. Whose interpretation and principles prevail, whether in the courts or among the administrators in charge of meting out discipline, will do much to determine whether protesters face punishments for campus turmoil. The First Amendment doesn’t automatically apply at private schools. Public universities, as arms of government, must yield to the First Amendment and how the courts interpret its decree that there shall be no law “abridging the freedom of speech” or “the right of the people peaceably to assemble.”

Local news footage and social media images showed scenes of chaos: Members of the clashing groups threw punches and wrestled each other to the ground. At about 3:30 a.m., officers wedged themselves between the groups, and the violence began to de-escalate. Officials at the University of California, Los Angeles, declared a pro-Palestinian encampment illegal for the first time on Tuesday night and warned protesters that they faced consequences if they did not leave. It was an abrupt turn at a campus that had been among the most tolerant in the nation, abiding by a University of California practice of avoiding law enforcement action unless “absolutely necessary to protect the physical safety of our campus community.”After protesters established the encampment on Thursday in the shadow of Royce Hall, university officials did not intervene and said they wanted to support free speech rights while minimizing campus disruption. But patience appeared to run out after violent confrontations in recent days between pro-Palestinian demonstrators and Israel supporters that required the campus police to intervene. Administrators also took issue with instances in which protesters used metal gates and human walls to control access to campus walkways and entrances, videos of which had circulated on social media.

CNN —After a trio of “Kingsman” movies, director Matthew Vaughn essentially hits the reset button with “Argylle,” another fun, highly stylized and less violent spy movie. Cast to the hilt, the film proves inventively twisty if a little convoluted, with the modest disclaimer that it’s not as good as the trailer makes it look. Bryce Dallas Howard and Sam Rockwell as an author and spy, respectively, in "Argylle." As Elly’s guide on this overwhelming journey, Rockwell steals the show, presenting a more human-scale spy who still does amazing things with smart-alecky wit and bravado. As noted, Vaughn’s work stands out for its energetic and playful approach to action, which is very much in evidence here.

Mike DeWine’s veto of a bill that would bar transgender minors from receiving puberty blockers, hormone therapy or gender transition surgery. The move by the Republican-controlled state legislature comes less than four weeks after the Republican governor’s veto. For Ohio residents, that means that only transgender minors who have already begun transition care treatments will be able to receive them. Last year, at least 20 states, all with Republican-controlled legislatures, passed bans or restrictions on gender transition care for young people. Before 2023, only three states had passed restrictions on gender transition medical care for minors, according to a New York Times analysis.

Dec 4 (Reuters) - Oilfield services firm Petrofac Ltd (PFC.L) said on Monday it was in discussions over the sale of its non-core assets and that it will no longer be able to meet its full-year guidance of "broadly neutral free cash flow" due to payment delays. "While the group has made progress in reaching contractual settlements and unwinding working capital, given delays in securing advance payment guarantees, it no longer expects to receive these advances before the year-end," Petrofac said in a statement. The company added it is exploring potential new financial options across all its classes of capital, and is actively engaged in discussions with investors to take a non-controlling position in certain other components of its business portfolio. Last week, shares in London-listed Petrofac dropped to a record low as analysts flagged concerns over its balance sheet due to payment delays. Cutting into the investment bank and reallocating to the more stable retail operations may look enticing but is hard to do without upending short-term returns. Still, the currently favoured suggestion of cutting less profitable investment bank clients sounds equally tricky, and might only shave at most a tenth off Barclays’ 219 billion pounds of corporate and investment bank risk-weighted assets. At Credit Suisse-inflated UBS (UBSG.S), which trades near book value, investment bank RWAs are 25%. Even getting Barclays’ corporate and investment RWAs back to 50% of the total would involve shrinking them by over a fifth.
