A Pennsylvania judge on Monday declined an effort by the Philadelphia district attorney to stop Elon Musk’s America PAC from doling out cash prizes to registered voters. The judge's injunction means Musk's PAC will be able to do one last giveaway on Tuesday, the last day of the offer. The America PAC giveaway has promised million-dollar checks to some voters and $47 and $100 payments to other registered voters who signed a political pledge in swing states. Philadelphia District Attorney Larry Krasner sued Musk and America PAC last month, alleging that the giveaways were an illegal, unregulated lottery, but at a hearing Monday, America PAC attorney Chris Gober said it wasn’t a lottery because winners aren’t determined by chance. Musk’s legal team delayed this hearing last week, filing to move the case to federal court.

The number of E. coli cases linked to McDonald’s Quarter Pounders has risen to 90, the Centers for Disease Control and Prevention said Wednesday, up from 75 reported cases last Friday. The slivered onions used on the burgers are the “likely source” of the outbreak, the CDC said. The true number of cases linked to the Quarter Pounders is likely much higher than the 90 reported so far. Thirteen states have reported cases: Colorado, Iowa, Kansas, Michigan, Missouri, Nebraska, New Mexico, Montana, Oregon, Utah, Washington, Wisconsin and Wyoming. A federal appeals court ruled Friday that a Mississippi law allowing mail-in ballots to be counted if they are postmarked before Election Day — but received up to five days after Election Day — is pre-empted by federal law. It does, however, pave the way for a possible challenge that could go up to the U.S. Supreme Court, which could have ramifications for states that do allow ballots postmarked before Election Day to be counted. The appeals court ruling says that no such ballots should be counted. "Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days," the ruling said.

A federal judge on Friday granted a Department of Justice request to block Virginia from systematically removing alleged noncitizens from the voter rolls this close to an election. "All of the eligible voters who were wrongfully purged from the voter rolls will now be able to cast their ballots," Snow said. The Justice Department said in a previous filing that 43 people removed from rolls in Prince William County were likely U.S. citizens. States are barred from systematically removing people from voters rolls within 90 days of an election under the National Voter Registration Act.
