You can tell a lot about a person by what he or she regrets. This holds especially for Supreme Court justices, whose decisions can, with a single vote, upend individual lives and alter the course of history. Minnesota, like many states that elect judges, had imposed such a ban in order to preserve the appearance of judicial impartiality. The decision was 5 to 4, with Justice O’Connor joining the majority. What stands out for me is what she said and did after leaving the court.

Just 3 out of the 9 Supreme Court Justices are liberals. Unless Democrats are willing to risk a 7-2 GOP-held Supreme Court, it might be time to consider retirement. However, Joe Biden should be far from the Democrats' biggest worry when it comes to age. It would be tremendously bad luck, but then again, anyone who thinks that Democrats have had good luck at the Supreme Court is delusional. The question is rather, what is the maximum level of acceptable risk of a 7-2 GOP-held Supreme Court?

Corporate execs and lawyers with business before the Supreme Court mingled with some of the country's most influential jurists. Revelations about Thomas and Crow's relationship have prompted calls in Congress for the Supreme Court to adopt its first-ever binding code of ethics. But as a Supreme Court justice, Kagan is not currently bound by those rules. The Aspen Institute isn't alone in dangling Supreme Court access to lure deep-pocketed donors. Financial support for a public mission flowed one way, and scheduled private time with Supreme Court justices was dispensed in return.

What grade would you give America when it comes to making progress on race and racism today? For our latest Times Opinion focus group, held in mid-June, we were curious to get those grades from young Black Americans just before the Supreme Court issued its ruling on affirmative action in college admissions. The court was weighing, on one level, whether affirmative action was no longer necessary to foster diversity on campus, as Justice Sandra Day O’Connor predicted would be the case by 2028. Looking to the future, some hoped that enrollment at H.B.C.U.s would increase with the end of affirmative action. Still, several said they believed the country will have made progress on race 25 years from now compared with today.
