In its decision, which has already drawn criticism from reproductive rights advocates, the Alabama Supreme Court ruled that frozen embryos have the same rights as living children under Alabama's Wrongful Death of a Minor Act. AdvertisementSome experts on reproductive rights are already sounding the alarm over the new ruling. "This is a cause of great concern for anyone that cares about people's reproductive rights and abortion care." AdvertisementThe case reached the Alabama Supreme Court after a lower court dismissed the couples' claims, though they later appealed. Later this year, the Supreme Court is expected to rule on access to mifepristone, a drug that can terminate a pregnancy alongside misoprostol.

The high-stakes hearings nearly 900 miles apart speak to the extraordinary entanglement of the 2024 election and Trump’s legal quagmire that now spans multiple presidential elections. Thursday will not even be the first time this week that the ex-president’s legal plight is playing out in two separate cities. The ruling could remove Trump’s capacity to do business in New York — the city where he made his name. As the expected first criminal trial, the New York case could still have important political implications. But the impact of Trump’s legal problems on a wider electorate is still to be tested.

These accusations have taken center stage in Trump's criminal prosecution, with Roman's team issuing subpoenas to Wade, Willis, and half a dozen witnesses who have worked with them. The center of Thursday's hearing will be whether either prosecutor has a conflict of interest in the case. Roman's attorneys must prove that Willis acquired a personal interest or stake in the defendant's conviction — and that it is "actual conflict" and not simply speculative. Her lawyers have written that no financial or personal conflict of interest justifies disqualification — and pointed to two ongoing relationships between defense attorneys in the case. Attorneys for Willis and Wade asked McAfee to keep them both off the witness stand on Thursday.

Others are calling for larger foundations to help grantees if they are sued or are offering legal assistance themselves. The Council on Foundations, which supports philanthropic foundations and provides legal resources to its members to help them consider potential legal risks, submitted an amicus brief in the case supporting the Fearless Fund's First Amendment argument. “If you’re committed to DEI or race-conscious or race-based giving, you should not back down on your priorities. We’re funding homelessness or employment or the wealth gap,” she said as examples of changes in wording funders have made. The Black Freedom Fund, which was founded in 2021 to fund Black community organizations in California, has started a legal defense fund for its grantees for precisely that reason.

And there’s a good chance that all three legal dramas see major movement next week. New York Attorney General Letitia James is seeking a staggering $370 million penalty from Trump. Trump is already siphoning a portion of his political donations to pay legal fees associated with the 91 criminal charges filed against him in four indictments. In 2023 alone, The New York Times reported , Trump spent roughly $50 million in donor money on legal bills and investigation-related expenses. While we await oral argument in Trump v. Anderson — the Supreme Court case that will evaluate the Colorado Supreme Court’s decision to exclude the former president from the state’s Republican primary ballot — it’s worth revisiting the arguments leveled against the Colorado court’s decision and, by extension, its interpretation of Section 3 of the 14th Amendment to the U.S. Constitution. The first and most important one is that the plot to overturn the results of the 2020 presidential election, culminating in the Jan. 6 attack on the United States Capitol, was not an insurrection. Related to this is the argument that, even if Jan. 6 was an insurrection, it’s still not clear that Donald Trump was an insurrectionist. If that isn’t persuasive, consider the evidence marshaled by the legal scholars Akhil Reed Amar and Vikram David Amar in a more recent amicus brief. They argue that top of mind for the drafters of the 14th Amendment were the actions of John B. Floyd, the secretary of war during the secession crisis of November 1860 to March 1861.

These presidents would presumably argue that in their capacities as president, they must expect some legal immunity to pursue policy and lead the country. EVEN EVENTS THAT ‘CROSS THE LINE’ MUST FALL UNDER TOTAL IMMUNITY, OR IT WILL BE YEARS OF TRAUMA TRYING TO DETERMINE GOOD FROM BAD. In arguing for total immunity, his lawyer said a president could only be prosecuted if he or she was convicted by the Senate in an impeachment trial. For six months, almost no one took notice of the brief filed quietly by Southern Baptists in a case winding its way to the Kentucky Supreme Court. The woman later sued several parties, including the Louisville Police Department, saying they knew about the abuse and had a duty to report it. None of it appeared to have anything to do with the Southern Baptist Convention, the nation’s largest Protestant denomination. The brief, reported by The Louisville Courier-Journal in October, landed like a bombshell in Southern Baptist circles. The brief, abuse survivors and those critical of the church say, offers the first clear look at the church’s true position on whether its leaders can be held accountable for abuse.

“It’s a fundamental strategic goal to present cases in the most favorable light possible, and that would include having a sympathetic and relatable person,” said Clark Neily, the senior vice president for legal studies at the Cato Institute, which has advocated gun rights. A panel of judges on the U.S. Court of Appeals for the Fifth Circuit wrote that he was “hardly a model citizen,” even as they sided with him. Mr. Rahimi’s case could expand gun rights protections by undoing a federal law that makes it a felony to possess a gun while under a domestic violence protective order. Although the case has garnered a flood of amicus briefs from groups like the National Rifle Association, the Second Amendment Foundation, and the Phyllis Schlafly Eagles, the organizations have largely shifted focus away from Mr. Rahimi. “You could imagine a different case challenging this same law with a much more sympathetic plaintiff.”

CNN —Republicans’ long public nightmare came to an end this past week when Louisiana’s Mike Johnson became the 56th speaker of the House. Their votes were outside the mainstream among all House members but not within the House Republican Conference. In other words, 37% of House Republicans are more conservative than the new speaker. That puts Johnson right in the middle third of today’s House Republican Conference. Unlike Johnson, Jordan really is out of the mainstream not just within Congress overall but the House Republican Conference, as well.

In the end, 125 House Republicans, including then-House Minority Leader Kevin McCarthy, signed on to the Supreme Court brief. House Republicans unanimously voted to elect Rep. Johnson, an unlikely candidate for speaker just weeks ago, was elected in 2016 and serves as the vice chairman of the House GOP conference.
