Jon-Adrian Velazquez spent close to 27 years caught in the criminal justice system — nearly all of it behind bars in New York's Sing Sing prison, convicted of a murder he insisted he did not commit. Andrew Cuomo granted Velazquez executive clemency, citing his work in Sing Sing on an educational initiative by those incarcerated to combat gun violence, and he was freed after serving almost 24 years of a 25-year-to-life sentence. The results determined Velazquez's DNA was not on the key evidence. Since his release from prison, Velazquez has used his experience to become an advocate for criminal legal reform and even played himself in the 2023 drama "Sing Sing," based on an actual Rehabilitation Through the Arts program at the prison. Hurricane Helene ravaged western North Carolina over the weekend, leaving behind a trail of death and devastation. North Carolina emergency crews were racing Monday to deliver food and other essential supplies to areas hit hard by Helene. At least 40 people were dead in Buncombe County, home of the thriving mountain city of Asheville, according to law enforcement officials. Photos and videos from Asheville, home to some 95,000 people, captured harrowing scenes and showed neighborhoods rendered unrecognizable by Helene’s impact. The approximately 44 people dead in North Carolina represent a third of all fatalities from the storm.

A lawyer for the Kentucky sheriff accused of fatally shooting a judge in his chambers announced the law enforcement official’s retirement Monday after the state’s governor threatened to remove him from office. “Rather, Sheriff Stines has made this decision to allow for a successor to continue to protect his beloved constituents while he addresses the legal process ahead of him,” said the lawyer, Jeremy Bartley. California has become the first state in the nation to prohibit school cafeterias from serving foods that contain six artificial dyes tied to health and behavioral problems. Known as the California School Food Safety Act, it outlaws Red 40, Yellow 5, Yellow 6, Blue 1, Blue 2 and Green 3 from the meals, drinks and snacks served at public schools statewide. “We’re feeling really proud of the fact that we are changing the national conversation around food safety,” he said in a phone interview. The U.S. Department of Education has extended the deadline for its Fresh Start program for defaulted student loan borrowers until Wednesday morning, according to an agency spokesperson. The original deadline for the Fresh Start program was Sept. 30, but an issue on their website led the department to decide to give borrowers until Wednesday at 3 a.m. to apply for it, the spokesperson told CNBC. Since the pandemic-era pause on federal student loan payments ended, the Education Department has shielded borrowers from the worst consequences of missed payments, including collection efforts and negative credit reporting. CNN —Employees at the Department of Veterans Affairs improperly accessed the medical files of Sen. JD Vance and Minnesota Gov. Tim Walz, the two major party vice presidential nominees, and an investigation is under way. Two sources familiar with the situation confirmed that VA employees improperly accessed Vance’s medical records, and roughly two months ago, an employee in VA Inspector General Michael Missal’s office reached out to someone in the Ohio Republican’s operation to alert them of the breach, one of the sources said. The Washington Post, which first reported the incident, said at least a dozen employees accessed the records. Walz enlisted at 17 and served 24 years in the National Guard before retiring in 2005 to run for Congress.

CNN —A Georgia judge has struck down the state’s six-week abortion ban, declaring it unconstitutional. In a ruling issued on Monday, Judge Robert McBurney said Georgia’s Living Infants Fairness and Equality Act, or LIFE Act, infringes on a woman’s state constitutional rights. When originally signed into law, the LIFE Act criminalized most abortions after an embryo generates detectable cardiac activity, typically around six weeks into a pregnancy. When the US Supreme Court overturned Roe v. Wade in 2022 and ended a national right to abortion, it opened the door for state bans.
