Pursuant to a 2013 Supreme Court decision, DOJ monitors only go inside polling places with the agreement of local officials, unless they have a court order. In their federal lawsuits, Missouri and Texas officials argued that their state laws did not permit federal officials to be present at polling places. Florida did not file a lawsuit, but Secretary of State Cord Byrd told the Justice Department in a letter Friday that state law does not allow DOJ officials in polling places. The DOJ was allowed to monitor polling places, he wrote, but was not allowed to send observers inside without a federal court order. Armed federal law enforcement officers are generally prohibited from entering polling places, which are secured by local law enforcement agencies.

CNN —While Tropical Storm Rafael winds remained consistent Monday night, the storm is forecast to strengthen Tuesday and become a hurricane Wednesday, bringing destructive winds and heavy rainfall to the western Caribbean and southern Florida by midweek. Tropical storm watch alerts were issued for the Florida Keys on Monday, joining the existing warnings for Cuba, Jamaica and the Cayman Islands. New York CNN —Journalists from multiple news organizations have been denied credentials to former President Donald Trump’s election night watch event in West Palm Beach, Florida, in retaliation for their coverage of Trump’s campaign. Reporters at Politico, Axios, Puck, Voice of America and Mother Jones were among those denied credentials. Some, like Politico, had been previously granted access to the Tuesday night event only to have the decision reversed. But around the time Palmeri published a piece about “anxiety” within the Trump campaign, her credential was denied. The Trump campaign and his former administration have a history of revoking credentials for reporters, often in retribution over their coverage.

Exit polls are conducted by Edison Research for the National Election Pool on behalf of a consortium of media companies: CNN, ABC, CBS and NBC. The polling locations were themselves selected through random sampling, meaning the resulting interviews should be representative of Election Day voters across the state or nationally.
