A federal judge in Pennsylvania on Tuesday declined to block the Federal Trade Commission’s ban on noncompete agreements, diverging from another judge’s recent finding that the agency’s move was on shaky legal ground. The decision clears one obstacle to the F.T.C.’s move to prohibit virtually all noncompete agreements, which prohibit employees from switching jobs within an industry and affect roughly one in five American workers. Several business groups sued to block the ban as soon as the F.T.C. voted to adopt it in April, saying it would limit their ability to protect trade secrets and confidential information. Denying the company’s motion for a preliminary injunction, she said the lawsuit was unlikely to ultimately prevail on the merits.

A former Army National Guard police officer was sentenced to two and a half years in prison on Tuesday after admitting that he pepper-sprayed law enforcement officers, while a mob of former President Donald J. Trump’s supporters stormed the U.S. Capitol on Jan. 6, 2021. He surrendered two days later, and in April he pleaded guilty to assaulting, resisting or impeding officers during the Capitol riot, federal prosecutors said. Judge James E. Boasberg of Federal District Court in Washington, D.C., also sentenced Mr. Yetman to 18 months of supervised release and ordered him to pay $2,000 in restitution. Prosecutors had sought a 45-month prison term; Mr. Yetman’s lawyer, Nicholas D. Smith, had asked for 17 months. Mr. Smith declined to comment on the sentence.

The Federal Trade Commission is launching an investigation into so-called "surveillance pricing," seeking more information about how artificial intelligence is used to change pricing rapidly based on data about customer behavior and characteristics. The FTC says the practice allows companies to charge different customers, different prices. "Firms that harvest Americans' personal data can put people's privacy at risk," FTC Chair Lina Khan said in a news release. Kahn describes surveillance pricing as a "shadowy ecosystem of pricing middlemen." Mastercard said in a statement, "We will cooperate with the FTC in this process."

WASHINGTON — A group of Democratic senators are sounding the alarm over T-Mobile's proposal to acquire most of US Cellular, and asking the Justice Department and the Federal Communications Commission to closely scrutinize and consider challenging the deal. The $4.4 billion deal announced in May 2024 would allow T-Mobile to use part U.S. Cellular's wireless spectrum to improve its coverage in rural areas and give it access to four million new customers. Under the agreement, U.S. Cellular would retain 70% of its wireless spectrum and towers, leasing space on other towers to T-Mobile. In Monday's letter, the lawmakers also ask the Justice Department to consider unwinding that merger, arguing that it cost customers of competing wireless carriers billions of dollars. A spokesperson for T-Mobile did not immediately respond to a request for comment on the letter from CNBC.

CNN —Rudy Giuliani’s trip to Milwaukee for last week’s Republican National Convention was bankrolled by the media platform started by “My Pillow Guy” Mike Lindell, Giuliani’s lawyer told a bankruptcy court that is scrutinizing the former New York City mayor’s finances. Lindell told CNN on Tuesday that Giuliani is an employee of the media company, but declined to say how much he was being paid for the job, which he said started July 1. Judge Sean Lane of the federal bankruptcy court in White Plains, New York, is expected to issue a ruling any day on how to move forward. Lindell told CNN on Tuesday that he paid for Giuliani’s travel because the former New York mayor was hired on July 1 as a host for Lindell’s right-wing broadcast platform, FrankSpeech TV. I found our first lunch to be very uncomfortable and began to dread the next one. After a lot of back-and-forth, he finally agreed, but during the meeting told me how important it was to him to take his employees out to lunch. If he asks you why, simply tell him you want to keep things strictly professional and avoid more casual interactions.
