ATMORE, Ala. (AP) — Alabama's first-ever use of nitrogen gas for an execution could gain traction among other states and change how the death penalty is carried out in the United States, much like lethal injection did more than 40 years ago, according to experts on capital punishment. Oklahoma and Mississippi already have laws authorizing the use of nitrogen gas for executions, and some other states, including Nebraska, have introduced measures this year to add it as an option. “This is a chapter in a long-running story in the United States,” Sarat said. A majority of states, 29, have either abolished the death penalty or paused executions, and there were just 24 executions carried out in five U.S. states in 2023, according to Washington, D.C.-based Death Penalty Information Center. “More states have abolished the death penalty since 2007 than in any other comparable 17-year period in American history,” Sarat noted.

CNN —The Colorado voters trying to disqualify Donald Trump from the state ballot told the Supreme Court on Friday that the violence the former president provoked on January 6, 2021, qualifies as an insurrection under the terms of the Constitution and bars him from holding future office. In the early pages of their 60-page filing, they also countered Trump lawyers’ warning of the “bedlam” that could follow if the justices were to allow states to block his name from upcoming primary ballots. The voters’ lawyers wrote that the mob “infiltrated the (US Capitol) building through shattered windows” and “erected gallows” outside, while chanting “Hang Mike Pence.” They noted that video of the day was on file at the court. The Supreme Court agreed earlier this month to hear the case of Trump v. Anderson, accepting the former president’s appeal of the Colorado Supreme Court decision that removed him from that state’s ballot. The Colorado trial judge disagreed, and her findings were upheld by Colorado’s high court, which concluded that he “intended that his speech would result in the use of violence.”

CNN —A retired judge hired by the Illinois State Board of Elections held a hearing Friday on whether the 14th Amendment’s “insurrectionist ban” applies to former President Donald Trump. Retired Illinois judge Clark Erickson presided over the roughly two-hour hearing in Chicago on Friday. The Illinois State Board of Elections, which is expected to vote Tuesday on whether to accept Erickson’s recommendation in the Trump case, is a bipartisan panel with four Democrats and four Republicans. Their decision can be appealed in Illinois state courts. At its Tuesday meeting, the election board is also slated to vote on a 14th Amendment challenge lodged against President Joe Biden by a group of conservative activists.

For as long as America has had the death penalty, there have been questions about how best to carry it out. The execution of Kenneth Eugene Smith in Alabama on Thursday, the first American execution in which death was caused by suffocation with nitrogen gas, gave no indication of settling the legal, moral and technical questions that have long bedeviled states as they mete out the ultimate punishment. Most recently, problems with the purchasing, administration and effects of lethal injection drugs have sent states scrambling for alternatives ranging from the old — firing squads, electric chairs and gas chambers — to the untested, like Alabama’s use of a mask to force Mr. Smith to inhale nitrogen instead of air. But after Mr. Smith’s death, the Alabama attorney general, Steve Marshall, hailed the execution as a “historic” breakthrough. He criticized opponents of the death penalty for pressuring “anyone assisting states in the process.”“They don’t care that Alabama’s new method is humane and effective, because they know it is also easy to carry out,” he said in a statement.

It marked the first time a new execution method was used in the U.S. since 1982, when lethal injection was introduced and later became the most common method. The state had predicted the nitrogen gas would cause unconsciousness within seconds and death within minutes. After he had a chance to make a final statement, the warden, from another room, was to activate the nitrogen gas. And experts appointed by the U.N. Human Rights Council cautioned they believe the execution method could violate the prohibition on torture. Smith's attorneys had raised concerns that he could choke to death on his own vomit as the nitrogen gas flows.

Alabama on Thursday is expected to perform the first execution in the U.S. with nitrogen gas, barring any last-minute intervention from courts or the state. I remain confident that the Supreme Court will come down on the side of justice, and that Smith’s execution will be carried out tomorrow,” Alabama Attorney General Steve Marshall said on social media on Wednesday. What Is a Nitrogen Gas Execution? The execution involves a mask that will be strapped to Smith’s face and deliver nitrogen gas. Alabama is one of three states where nitrogen hypoxia is an authorized execution method, but it’s the first to attempt to use it.

The state, in court records, indicated the redactions were made to maintain security. Smith’s team again Thursday morning appealed to the US Supreme Court and requested a stay of execution. “But the way that they’re constructing this, the way that they’re doing it, the way that they’re being silent, the way that they’re holding back information, yes, it’s incredibly concerning. Institutions Are (Quietly) Taking Sackler Money

When arts organizations began shunning the Sackler family over its role in the U.S. opioid crisis, it wasn’t just American institutions that cut ties. Museums in Britain that had accepted Sackler largess were among the first to take action. After the National Portrait Gallery in London canceled a $1.3 million Sackler donation in 2019, the Tate museum group announced it would not seek any more of the family’s support. Other museums began discussing removing the Sackler name from their walls. According to the Sackler Trust’s latest accounts, which were published this month, the nonprofit committed around 5.2 million pounds, or $6.6 million, in 2022, comprising 66 grants to institutions.

A surge of unexpected waves swamped the island of Roi-Namur in the Marshall Islands on Saturday, forcing evacuations from a U.S. Military base and causing damage that could take months to repair. A video from inside a building at U.S. Army Garrison Kwajalein Atoll that circulated widely on social media showed a surge of water crashing through a set of double doors, knocking them off their hinges and upending people who were standing nearby. Another burst of water rushed through the windows, forcing the people to wade through waist-high water as furniture and vegetation floated around them. Roi-Namur is a small island about 2,300 miles southwest of Hawaii and is the second-largest island of the Kwajalein Atoll, a loop of coral reefs in the Marshall Islands.
