And accidents went up. Derailments rose at the top five freight railroads in 2023, according to regulatory reports for the first 10 months of the year, the most recent period for which data exists for all five companies. And there was a steep increase in the mechanical problem — an overheated wheel bearing — that regulators think caused the derailment of the 1.75-mile-long train in East Palestine. Norfolk Southern, the operator of the train and the owner of the track that runs through the town, was the only railroad among the five to report a decline in accidents in the period.

(AP) — Alabama's first-ever use of nitrogen gas for an execution could gain traction among other states and change how the death penalty is carried out in the United States, much like lethal injection did more than 40 years ago, according to experts on capital punishment. Oklahoma and Mississippi already have laws authorizing the use of nitrogen gas for executions, and some other states, including Nebraska, have introduced measures this year to add it as an option. “This is a chapter in a long-running story in the United States,” Sarat said. A majority of states, 29, have either abolished the death penalty or paused executions, and there were just 24 executions carried out in five U.S. states in 2023, according to Washington, D.C.-based Death Penalty Information Center. “More states have abolished the death penalty since 2007 than in any other comparable 17-year period in American history,” Sarat noted.

(AP) — Union Pacific's fourth-quarter profit crept up 1% as the railroad delivered more fertilizer, imported goods and vehicles. The Omaha, Nebraska-based railroad said it earned $1.65 billion, or $2.71 per share, in the quarter. The results topped the estimates of the analysts surveyed by FactSet Research that called for earnings of $2.60 per share as Union Pacific hauled 3% more shipments. But Union Pacific's topped Wall Street's predictions for $6.05 billion. Union Pacific is one of the nation’s largest railroads and operates more than 30,000 miles of track in 23 western states.

London CNN —Germany is bracing for widespread disruption to rail services after train drivers embarked on a record six-day strike Wednesday, which will further strain crucial supply chains and deal a new blow to the sputtering economy. The state-owned rail operator said the action would cause “massive disruptions” to long-distance, regional and city commuter services until Monday. That was a major drag on the economy overall, with gross domestic product falling 0.3% in 2023, likely the weakest performance among Europe’s big countries.
