WASHINGTON — A team of federal prosecutors led by special counsel Jack Smith said in a filing Wednesday that Republican presidential nominee Donald Trump bears responsibility for the Jan. 6 attack on the U.S. Capitol. In a filing responding to Trump's attempt to dismiss the case, Smith's team said it "is incorrect" for Trump's team to assert that the superseding indictment returned against Trump in August does not show that Trump bears responsibility for the events of Jan. 6. "Those allegations link the defendant’s actions on January 6 directly to his efforts to corruptly obstruct the certification proceeding," Smith's team wrote. The Nebraska Supreme Court ruled that convicted felons who served their sentences are allowed to vote, after the state's top election official sought to keep them from casting ballots ahead of the Nov. 5 election. Nebraska has historically restored the voting rights of former felons two years after they completed the terms of their sentences. While Nebraska is solidly Republican state, it awards an electoral vote to the winner of each of its congressional districts. The Sentencing Project, criminal justice reform advocacy group, estimated that eliminating the waiting period for convicted felons in Nebraska would restore voting rights for 7,000 people. Far more completed their felony sentences more than two years ago, too, and were affected by the state officials prohibition on their voter registration.

CNN —Special counsel Jack Smith told a federal judge on Wednesday that the Supreme Court’s decision limiting some obstruction charges against those who stormed the US Capitol on January 6, 2021, should not apply to Donald Trump in the election subversion case against the former president. One primary reason the obstruction charge against Trump should stand, prosecutors argue, is that – unlike in the case involving a rioter that was before the Supreme Court – Trump is directly accused of creating false evidence though the plot to insert fake electors in the certification process. Trump is arguing the ruling should result in Judge Tanya Chutkan throwing out the case against him. “The defendant’s supplement ignores entirely that the superseding indictment includes allegations that involve the creation of false evidence,” prosecutors wrote Wednesday, namely, “the fraudulent electoral certificates.”Smith also urged the judge to ignore Trump’s claims of presidential immunity, calling them “deeply flawed” and “irrelevant” to the issue at hand and should wait to be argued in separate filings. The Sackler family, owners of Purdue Pharma, ultimately paid over $3 billion in settlements for misleading advertising related to their products. Purdue Pharma later filed for bankruptcy, but the Supreme Court struck down a $7 billion bankruptcy plan in June that would have given the Sackler's immunity from future civil suits. With the prospect of that federal ban looming next year, a slew of federal lawsuits helps shape public opinion and "pressure lawmakers to act," Rahmani said.
