Companies Tesla Inc FollowNov 15 (Reuters) - Tesla Inc (TSLA.O) did not violate U.S. labor law by prohibiting workers at its flagship Fremont, California, assembly plant from wearing pro-union t-shirts, a federal appeals court has ruled. The electric vehicle maker adopted its uniform policy in 2017 amid an organizing campaign by the United Auto Workers union (UAW). President Joe Biden said last week that he supported the union's efforts to organize workers at Tesla and Toyota. Tesla's "team wear" policy required employees to wear black shirts imprinted with the Tesla logo. A three-judge 5th Circuit panel in March had affirmed the labor board's decision.

Circuit Court of Appeals ruling means the lease sale — once set for September, but postponed multiple times amid legal fights — will be held in December. And it must cover 73 million acres (30 million hectares), as originally planned when the administration announced the sale in the spring. The administration later scaled back the area covered by the lease sale to 67 million acres (27 million hectares) as part of an agreement to protect the endangered Rice’s whale. "Ghost guns" seized in federal law enforcement actions are displayed at the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) field office in Glendale, California on April 18, 2022. A federal appeals court on Thursday ruled that the Biden administration lacked authority to adopt a regulation aimed at reining in privately made firearms called "ghost guns" that are difficult for law enforcement to trace. Circuit Court of Appeals sided with a group of firearm owners, gun rights groups and manufacturers in declaring the Bureau of Alcohol, Tobacco, Firearms and Explosives' 2022 rule "unlawful." The administration has said that ghost guns are attractive to criminals and others prohibited from lawfully buying firearms, including minors. There were about 20,000 suspected ghost guns reported in 2021 to the ATF as having been recovered by law enforcement in criminal investigations — a tenfold increase from 2016, according to the White House.

(AP) — The Louisiana Legislature has until Jan. 15 to enact a new congressional map after a lower court last year ruled that the current political boundaries dilute the power of the state’s Black voters, a federal New Orleans appeals court said Friday. Louisiana is among states still wrangling over congressional districts after the U.S. Supreme Court in June ruled that Alabama had violated the Voting Rights Act. They argue that Black populations in the state are too dispersed to be united into a second majority Black district. Lawmakers now have until mid-January to draw and pass a new map, which would have to be done through a special session. However, in the appeals court’s order it does say that the district court will have discretion to grant “limited additional time” if requested.

Washington, DC CNN —Federal Reserve Chair Jerome Powell is leaving the door open for additional interest rate hikes to defeat inflation, he said Thursday in prepared remarks. However, investors are bullish about another pause in rate hikes next month, according to fed funds rate futures. As Powell began to deliver his speech, he was interrupted by climate protesters who made their way onto the stage. That could potentially be a headache for the Fed, since strong demand could be maintaining some upward pressure on prices. Richmond Fed President Thomas Barkin hinted that the Fed could forgo additional action because the economy perhaps hasn’t felt the full impact of the Fed’s previous 11 rate hikes just yet.

NEW ORLEANS (AP) — The Biden administration asked a federal appeals court Tuesday to uphold health care guidance issued in 2022 that says hospitals must provide abortions for women whose lives are at risk due to pregnancy. A federal judge blocked enforcement of the guidance last year after the state of Texas and abortion opponents sued. Opponents of the guidance say Texas law already allows abortions to save the life of the mother, but that the federal guidance went too far, calling for abortions when an emergency condition is not present and eliminating obligations to treat the unborn child. Judge Leslie Southwick appeared skeptical, noting that the guidance was issued shortly after the Supreme Court’s Dobbs v. Jackson Women’s Health Organization ruling that overturned abortion rights. Judge Cory Wilson questioned whether the law applied to abortion care.

Circuit Court of Appeals concluded that the measure failed a stringent test set by the Supreme Court in a 2022 ruling that required gun laws to be "consistent with the nation's historical tradition of firearm regulation" in order to survive a Second Amendment challenge. Violating the law initially was punishable by up to 10 years in prison but has since been raised to 15 years. A federal judge rejected Rahimi's Second Amendment challenge and sentenced him to more than six years in prison. Biden's administration has said the law should survive because of the long tradition in the United States of taking guns from people deemed dangerous. Supporters of Rahimi have argued that judges too easily issue restraining orders in an unfair process that results in the deprivation of the constitutional gun rights of accused abusers.
