With a five-vote margin in the House — and 18 House GOP members representing districts President Joe Biden won — the math just doesn’t work. The impeachment of President Andrew Johnson during Reconstruction and the impeachment inquiry into President Richard Nixon for Watergate were separated by more than a century. The impeachment of President Bill Clinton and the double impeachment of President Donald Trump were separated by a little more than 20 years. The only silver lining in this dark cloud over the Biden White House comes from independents’ take on the alternative. As our colleague Harry Enten points out, just 33% of independents think Biden did something illegal, according to a recent Fox News poll.

House Speaker Kevin McCarthy, R-Calif., plans to endorse an impeachment inquiry into President Joe Biden in an effort to seek bank records and other documents from the president and his son Hunter Biden, two Republican sources familiar with the speaker's intentions told NBC News. McCarthy has signaled for weeks that the House could take up an impeachment inquiry, which would provide additional legal power to the House's investigations into the Biden family. It is unclear whether there are sufficient votes within the GOP conference to open an impeachment inquiry into the president. The White House is ramping up a war room to lead a response to a Republican impeachment inquiry, NBC News previously reported. McCarthy's move to endorse an impeachment inquiry into Biden comes amid pressure from right-wing Republicans, who are pushing back against a short-term funding bill to avert a government shutdown at the end of the month.

Rep. Greene went after fellow Rep. Matt Gaetz over the conservative push to impeach President Biden. Gaetz on Tuesday said that he "pushed" McCarthy for weeks regarding an impeachment inquiry. The decision comes as the California Republican has faced mounting pressure over the issue from many members of the ultraconservative House Freedom Caucus, who hold immense sway in the narrow Republican House majority. AdvertisementAdvertisementThe White House on Tuesday immediately pushed back against GOP efforts to start an impeachment inquiry. "This is the same guy that wrote a book called 'Drain the Swamp', who is now arguing against an impeachment inquiry," she told the network.

WHAT IS AN IMPEACHMENT INQUIRY? An impeachment inquiry is a formal step that can precede a House vote on whether to approve articles of impeachment and eventually a trial in the Senate. It did not hold a full impeachment inquiry before bringing impeachment charges in the final weeks of Trump's presidency following the Jan. 6, 2021, Capitol attack. Weiss has said prosecutors will seek to indict Hunter Biden on tax and gun charges by Sept. 29. The criminal prosecution could mean Hunter Biden may face a trial while his father is campaigning for reelection.

House Speaker Kevin McCarthy, facing growing pressure from the right flank of his conference, announced on Tuesday he is directing committee leaders to open an impeachment inquiry into President Joe Biden, citing a “culture of corruption” around the chief executive. “Today, I am directing our House committee to open a formal impeachment inquiry into President Joe Biden,” McCarthy said at a press conference. But until now, the inquiry was not guaranteed, especially as it remained unclear whether vulnerable Republicans in swing districts that Biden won in the last election would vote to open the impeachment inquiry into the president. But other Republicans have opposed launching an impeachment inquiry. Rep. Ken Buck of Colorado has argued that the House lacks evidence connecting Biden to his son’s foreign business dealings.

That’s why, today, I am directing our House committee to open a formal impeachment inquiry into President Joe Biden,” McCarthy said. The confrontation could trigger a government shutdown in the coming months – a potential political headache for McCarthy heading into an election year. So even if he wanted to initiate impeachment against Biden to save himself, McCarthy may not have the power to do it. It’s often been impossible to see a clear path ahead in which McCarthy can appease competing political forces with the minuscule majority Republicans secured in last year’s midterm elections. Ahead of an autumn that could turn into a political migraine for McCarthy, he is back in a familiar position.

U.S. House Speaker Kevin McCarthy (R-CA) arrives at the U.S. Capitol ahead of an expected vote in the U.S. House of Representatives on a bill raising the federal government's $31.4 trillion debt ceiling, in Washington, May 31, 2023. "There's no reason for a government shutdown," White House Press Secretary Karine Jean-Pierre said Wednesday at a briefing. WASHINGTON — Concerns over a potential government shutdown have reached a fever pitch as the House of Representatives returns to session this week with little progress to show on budget negotiations. Freedom Caucus Republicans have said they oppose even passing the continuing resolution without concessions on border funding and if it includes money for Ukraine. The speaker warned his caucus that a government shutdown would have negative effects on the impeachment process as well.

House Speaker Kevin McCarthy's announcement that he has directed GOP-led House committees to open an impeachment inquiry into President Joe Biden was the long-anticipated retribution that White House aides had been waiting for, after House Democrats twice impeached Donald Trump during his term in office. Ever since Republicans retook the House majority last year, the White House has been building a team of legal experts and spokespeople to counter the congressional inquiry launched into the president and his son, Hunter Biden. Rep. Marjorie Taylor Greene, R-Ga., said she would not vote on any necessary budget bills unless the House opened an impeachment inquiry. The White House said caving to their demands would show that the exercise is a "costly, illegitimate, politically-motivated exercise not rooted in reality." "The time for impeachment is the time when there's evidence linking President Biden — if there's evidence linking President Biden — to a high crime or misdemeanor.

REUTERS/Julia Nikhinson/File Photo Acquire Licensing RightsWASHINGTON, Sept 11 (Reuters) - The U.S. House of Representatives returns this week for an expected political brawl over spending cuts and impeachment that could paralyze the Republican-controlled chamber, as Congress struggles to avoid a government shutdown. The White House and Senate leaders -- including top Republican Mitch McConnell -- have rejected that demand. The House, which Republicans control by a thin 222-212 majority, has passed only one appropriations bill so far. Other Republicans reject the idea of tying an impeachment inquiry to the spending debate. Democrats have dismissed impeachment talk as little more than an effort to distract from Trump's extensive legal woes."

“I personally would like to see the inquiry happen (this) week,” the Georgia Republican told CNN. The two chambers are hundreds of billions dollars apart and divided over controversial social issues that House Republicans have tacked on to their spending bills. “I am against a continuing resolution in any form or fashion,” Gonzales told CNN. “There is a constitutional and legal test that you have to meet with evidence,” Johnson told CNN. If McCarthy again defers an impeachment vote, it could enrage the right.

A House Freedom Caucus member said there's no evidence linking Biden to a high crime. Appearing on MSNBC on Sunday, Rep. Ken Buck also railed against Rep. Marjorie Taylor Greene. Buck noted the "time for impeachment is the time when there's evidence linking President Biden to a high crime or misdemeanor." In response to Buck's comments, Greene said it seemed like the Freedom Caucus member was pining for a job from the Democratic president. The publicized back-and-forth between Buck and Greene comes several months after the Freedom Caucus booted Greene from their ranks days after she called fellow caucus member Rep. Lauren Boebert a "bitch" on the House floor.

The House returns this week from a lengthy August recess to a jam-packed September, with an end-of-month deadline to avert a government shutdown quickly approaching, foisting intense pressure upon House Speaker Kevin McCarthy. With just one of 12 spending bills passed through the House, little time remains to take action to keep the government fully functional by the Sept. 30 deadline. And should McCarthy look to Democrats to sidestep conservative demands, some have warned that they’ll bring up a vote for his ouster. Instead, some suggest that launching a Biden impeachment inquiry is McCarthy’s only true bargaining chip with those on the right. And to complicate matters further, the two chambers have marked up the spending bills at different levels, making reconciling the legislation all the more difficult.

Trump will join the South Dakota Republican Party for a “Monumental Leaders Rally” in Rapid City. South Dakota holds a late primary and isn't competitive in a general election. That hasn’t stopped those who are keen to be considered as Trump's running mate from openly jockeying for the position and trying to curry favor with him and his aides. Despite not running for president, Noem has continued to position herself nationally. “Kristi Noem has spent more time out campaigning for I don’t know what than she has in South Dakota.

Rep. Ken Buck derided Rep. Marjorie Taylor Greene as having less of a grasp on the Constitution than him. Marjorie Taylor Greene🇺🇸 (@RepMTG) September 5, 2023Greene also hit Buck for voting to certify the 2020 election, saying it meant that he "does not support" former President Donald Trump. "When Marjorie Taylor Greene was teaching CrossFit, she learned a whole different set of values." Buck, a longtime member of the House Freedom Caucus, is no moderate — he's among the most conservative lawmakers in Congress. "She has consistently attacked other members of the Freedom Caucus in an irresponsible way, and as a result of that she was kicked out of the Freedom Caucus," Buck said at the time.

While the idea of using the 14th Amendment to keep Trump out of the White House has been bandied about by lawyers and political figures, the Colorado action is the first lawsuit demanding that a state disqualify Trump from the ballot, CREW said. The group chose Colorado because the laws there make it easier to get it before a court, he says. Some members of Congress, most recently Democratic Sen. Tim Kaine of Virginia and Democratic Rep. Adam Schiff of California, have suggested the 14th Amendment might apply to Trump. Critics of the movement to disqualify Trump say the 14th Amendment clause was written to apply to former Confederates and should not be used against contemporary would-be candidates. Still, those who want to use the 14th Amendment to disqualify Trump face significant legal hurdles, experts say, adding that the matter is likely to end up in the Supreme Court if the movement gains steam.

The Senate returns Tuesday from a month-long recess as Congress gears up for a rocky September with a whole host of to-dos – including averting a government shutdown – before the fiscal year’s end. Accordingly, congressional leaders have made clear that a stop-gap measure to keep the government funded will be necessary. But even without the demands on the CR, reconciling the House and Senate's spending bills more broadly is expected to be a heavy lift this month, and perhaps beyond. Even so, some Senate Republicans were quick to come to McConnell’s defense. But questions about the leader’s health are expected to run in the background this week as the Senate gets to work on a number of priorities.

Kevin Wurm | ReutersA deeply divided Congress returned Tuesday from a monthlong summer vacation with the clock ticking to pass spending legislation to avoid a government shutdown and boost U.S. emergency response funding following multiple natural disasters. The U.S. government will shut down at midnight on Sept. 30 if Congress fails to pass spending legislation. While the Senate is back in session Tuesday, the House will not return to work until Sept. 12, leaving nearly three weeks to pass funding before the deadline. McCarthy came out publicly in support of a continuing resolution to keep the government running during an interview with Fox News last month. Bank of America analysts in a note Tuesday put the chances of shutdown as a flip of the coin given the conditions conservative Republicans are putting on funding legislation.

More than 70,000 Burning Man attendees were stranded at the Nevada campsite following torrential floods. GOP Rep. Marjorie Taylor Greene said they're probably being 'brainwashed' about climate change. The annual weeklong Burning Man festival, which is held in Nevada's Black Rock Desert, faced a series of challenges this year. Just before 8 p.m. on Thursday, Representative Marjorie Taylor Greene posted a video of herself at a town hall in her Georgia district declaring that she “will not vote to fund the government” unless the House holds a vote to open an impeachment inquiry against President Biden. The White House, as it turns out, is not waiting for a formal inquiry to wage war against impeachment. The president’s team has been mapping out messaging, legal and parliamentary strategies for different scenarios. Officials have been reading books about past impeachments, studying law journal articles and pulling up old court decisions. They have even dug out correspondence between previous presidential advisers and congressional investigators to determine what standards and precedents have been established.

Georgia is, of course, also the place where Donald Trump called and asked a Republican to “find” votes. And Georgia is the place where the Fulton County district attorney, Fani Willis, filed criminal charges that led to the indictment of Mr. Trump and 18 others for a conspiracy to subvert the 2020 election. Representative Marjorie Taylor Greene, one of Mr. Trump’s most enduring defenders representing one of the country’s more conservative districts, posted an image of an American flag upside down, signaling distress. And in one second-floor wing of Georgia’s State Capitol, a pair of Republican executives most likely shed few tears. “The 2020 election in Georgia was not stolen,” Mr. Kemp said last month on social media in response to Mr. Trump’s claims that he would unveil a report demonstrating the state’s election was fraudulent.

U.S. Representative Marjorie Taylor Greene, R-Ga., speaks to the media near the entrance of the Fulton County Jail, as former U.S. President Donald Trump is expected to turn himself in to be processed after his Georgia indictment, in Atlanta, Aug. 24, 2023. WASHINGTON — The White House pushed back on Republican talk of impeachment as "a partisan stunt" after Rep. Marjorie Taylor Greene, R-Ga., vowed to not vote for funding the government without proceedings. "I've already decided I will not vote to fund the government unless we have passed an impeachment inquiry," Greene said. During a town hall Thursday night to her constituents and later in a post on X, formerly known as Twitter, Greene said she would not vote on necessary budget bills unless impeachment proceedings begin for President Joe Biden. The White House on Thursday asked Congress to pass a short-term continuing resolution to fund the government while long-term budget negotiations continue.

Washington CNN —Election officials in key battleground states are studying the legal viability of efforts to disqualify Donald Trump from running for president, based on the 14th Amendment’s ban on insurrectionists holding public office. A convicted January 6 rioter who was also a New Mexico county commissioner was removed from office based on 14th Amendment grounds, through a different but related legal mechanism. Their highly publicized attempts to remove GOP Reps. Marjorie Taylor Greene and Madison Cawthorn from the ballot were unsuccessful. It seems unlikely that any secretary of state would take such aggressive action like this on their own, and even if they did, it would be immediately challenged in court. He has been indicted on federal and state charges in connection with his wide-ranging attempts to subvert the 2020 election, including his role fueling the violence at the US Capitol.

The theory has been gaining momentum since two prominent conservative law professors published an article this month concluding that Mr. Trump is constitutionally disqualified from running for office. But even advocates of the disqualification theory say it is a legal long shot. If a secretary of state strikes Mr. Trump’s name or a voter lawsuit advances, Mr. Trump’s campaign is sure to appeal, possibly all the way to the Supreme Court, where the 6-3 conservative majority includes three justices nominated by Mr. Trump. But New Hampshire has jumped out as the early hotbed of the fight. The New Hampshire Republican Party said this week that it would challenge any effort to remove Mr. Trump, or any other candidates who have met requirements, from the ballot.
