Just over 90 minutes before Roberson’s execution was set to begin, the House committee was able to secure a temporary restraining order against the state, pausing the execution. Roberson’s case is called into questionAdvocates for Roberson insist the diagnosis that his daughter died from shaken baby syndrome is inaccurate and has been discredited. Shaken baby syndrome is accepted as a valid diagnosis by the American Academy of Pediatrics and supported by child abuse pediatricians who spoke with CNN. Since 1992, courts in at least 17 states and the US Army have exonerated 32 people convicted in shaken baby syndrome cases, according to the National Registry of Exonerations.

WASHINGTON — The Biden administration announced a milestone Thursday in its effort to cancel Americans' student debt: it has provided relief to more than one million borrowers who work in public service. The Education Department said that before Biden's presidency, only 7,000 public servants had ever received student debt relief through the Public Service Loan Forgiveness Program. The milestone comes after the administration has faced legal challenges to a number of its student debt relief proposals and roadblocks put up by court rulings. Texas is preparing to put a man to death Thursday in what would be the nation’s first execution involving a case of “shaken baby syndrome,” a diagnosis that has been re-evaluated in more recent years, leading to the overturning of similar convictions. Prosecutors argued that Nikki must have been shaken to death because she had been diagnosed with “the triad” — a swollen and bleeding brain and retinal hemorrhaging — symptoms once believed to be indisputable evidence of shaken baby syndrome. In 2009, the American Academy of Pediatrics changed the name of shaken baby syndrome to the more broadly defined “abusive head trauma” to include injuries caused by mechanisms other than shaking alone. It is now medical consensus that other medical conditions, including infections, accidental trauma and pre-existing illnesses, can also cause the symptoms associated with shaken baby syndrome. Hundreds of possible shaken baby and abusive head trauma cases are reported to hospitals in the U.S. every year, according to a nonprofit advocacy group.

South Korea’s Unification Ministry, which handles ties with the North, said it “strongly condemns” the constitution change and South Korea’s characterization as a hostile state, and that it will not waver in its efforts toward peaceful reunification. It's part of the Trump team's attempt to present Trump's concerns about mass voter fraud — which were roundly rejected by independent arbiters and courts — as "reasonable" and grounded in reality. Judge Tanya Chutkan pushed back on Trump's claims on Wednesday in an order that rejected all but three of his 14 categories of requests for additional evidence. Trump's state of mind is essential to the case, and Smith's team has alleged that Trump "knew" his election lies "were false." The Supreme Court gutted part of Smith's case over the summer with its ruling on presidential immunity, but the case against Trump is — very slowly — churning towards a potential trial.

WASHINGTON — The Supreme Court on Wednesday allowed the Biden administration at least in the short term to enforce its latest attempt to curb climate-harming carbon emissions from coal- and gas-fired power plants that contribute to climate change. The Supreme Court is often skeptical of major agency actions but it has bucked that reputation in recent weeks. Under the proposed rule, the EPA wants to require “carbon capture,” a technique that uses solvents to remove carbon dioxide from a power plant’s emissions. The appeals court in July declined to block the regulation, saying the major questions doctrine did not apply on this occasion. In court papers, the challengers sought to portray the new regulation as being essentially the same as the one the Supreme Court struck down.

A Justice Department lawyer said the provision doesn’t mean that a less-qualified person would be picked, only that the government will consider all candidates. He asked the Justice Department and Boeing to respond in writing by Oct. 25.
