DENVER (AP) — A Colorado judge has rejected an attempt by former President Donald Trump to dismiss a lawsuit that seeks to keep him off the state ballot, ruling that his objections on free-speech grounds did not apply. Trump’s attorneys argued that a Colorado law protecting people from being sued over exercising their free speech rights shielded him from the lawsuit, but Colorado District Judge Sarah Wallace said that law doesn’t apply in this case. They also assert that the 14th Amendment requires an act of Congress to be enforced and that it doesn't apply to Trump, anyway. “The framers of the 14th Amendment never intended for it to apply to the President,” he wrote. The trial to determine Trump's eligibility for the Colorado ballot is scheduled to start Oct. 30.

Sequoia Capital managing partner Roelof Botha has a strategy for making tough decisions. He cited Dorsey's own payments business Block, where Botha sits on the company's board, as an example. The company officially launched Square Cash, now known as Cash App, in October 2013. Costco on Tuesday reported quarterly earnings that topped Wall Street's expectations, as shoppers turned to the membership club for groceries but bought fewer big-ticket items. As of the end quarter, Costco had 32.3 million paid executive memberships, an increase of 981,000 since the end of the prior quarter. Those higher-tier members now account for slightly over 45% of all paid membership, Galanti said. Costco echoed a trend seen at rival retailers, including Walmart and Target : Groceries are the category driving sales. In the year-ago fiscal fourth quarter, comparable sales rose 15.8% in the U.S., but since then they have largely decelerated.

Yelp (YELP.N) and News/Media Alliance, which are not defendants in the litigation but are targets of Google's subpoenas, argue that law firm Paul, Weiss, Rifkind, Wharton & Garrison should be disqualified. A spokesperson for Paul Weiss said the "firm's representation of Google is appropriate in all respects." Yelp said it hired Paul Weiss in 2016 for counsel on antitrust issues. The Justice Department's antitrust head, Jonathan Kanter, was on the Paul Weiss team representing Yelp. New York-based Paul Weiss, which has about 1,000 lawyers globally, is also representing Amazon.com in various antitrust lawsuits.

Put into bat, Australia were all out for 276 in exactly 50 overs even though 300 looked within their reach before Shami polished off their tail. Nearly all of Australia's frontline batters got the starts in the match but only David Warner (52) managed a half-century. Australia still looked poised for a bigger total with Josh Inglis (45) and Marcus Stoinis (29) scoring freely. After Adam Zampa removed both the openers and Shreyas Iyer ran himself out in between, Australia looked back in the contest. Rahul made 58 not out, staying put till the end to secure India's victory by hitting Abbott for a four and a six.
