CNN —As Supreme Court justices try to resolve more than a dozen major cases over the next month, including whether Donald Trump must stand trial for election subversion, they appear mired in antagonism and distrust. Conservatives, who indeed hold the upper hand on the 6-3 court, nonetheless spike their writing and remarks with derision for the left. When the court majority allowed Louisiana state officials to use a map with a second majority-Black congressional district (over the protest of a GOP-backed group of White voters), the three liberals dissented. (A lower US court had referred to it as the “bleaching of African American voters” from the district.) Dissenting liberals emphasized that the decision reversing the lower court undercut a 2017 Supreme Court ruling, Cooper v. Harris, issued before the far-right majority took hold.

I won’t even opine whether my flying the flag upside-down flag at my house would have constituted a violation of the Code of Ethics that binds me and all federal judges — except the justices. The fact is that, regardless of its legality, displaying the flag in that way, at that time, shouldn’t have happened. To put it bluntly, any judge with reasonable ethical instincts would have realized immediately that flying the flag then and in that way was improper. The same goes with the flying of an “Appeal to Heaven” flag at Justice Alito’s vacation house along the New Jersey shore. Like the upside-down flag, this flag is viewed by a great many people as a banner of allegiance on partisan issues that are, or could be, before the court.

CNN —Uzbekistan gymnast Oksana Chusovitina had been aiming to compete at her ninth consecutive Olympic Games later this year, but the 48-year-old’s hopes of securing a spot in Paris have been dashed by injury. “Yesterday, while training on the podium of the Asian Championships, which is taking place in Tashkent and is a qualifying event for the Olympic Games in Paris, I was injured during the floor exercise. She won a gold medal in the team all-around competition that year and has competed in every Summer Games since then. However, even if she had qualified for Paris 2024, she would not have been a record holder for very long. With the Supreme Court just weeks away from issuing decisions on two major cases concerning former President Donald J. Trump’s efforts to overturn the 2020 election and the events of Jan. 6, lawmakers said the symbolism of the flags called into question Justice Alito’s neutrality. In an interview on Thursday, Representative Steve Cohen, a Democrat from Tennessee who has introduced a resolution to censure Justice Alito, said Congress needed to take the firm position that the justice’s actions were a violation of judicial propriety. “He’s not going to resign, he’s not going to recuse himself, and I don’t think Justice Roberts is going to be able to influence him in that regard,” he said, referring to Chief Justice John G. Roberts Jr. “So the best we can do is to kind of put a scarlet letter on him.”

CNN —Nine people were killed and a presidential candidate was briefly taken to hospital after a stage collapsed under heavy winds at a campaign rally in Mexico on Wednesday. Candidate Jorge Álvarez Máynez said he was not injured in the incident, which happened during his campaign event in the northeastern city of San Pedro Garza García. The governor of Mexico’s Nuevo Leon state said at least 54 people were injured and rescue operations were ongoing to save some of the people trapped under the collapsed stage. Álvarez Máynez later said he was suspending all campaign activities after the collapse but would remain in the state to monitor the situation and victims. The presidential candidate said an investigation into the incident would take place.

A stage in northern Mexico where a presidential candidate was campaigning collapsed after a gust of wind blew through the area on Wednesday night, leaving at least five people dead and at least 50 others injured, a state governor said. The stage collapsed in a suburb of Monterrey, in the state of Nuevo León, during an event attended by the progressive candidate Jorge Álvarez Máynez and other members of the Citizens’ Movement party. The collapse was caused by strong wind, President Andrés Manuel López Obrador of Mexico said on social media. Samuel García, the governor of Nuevo León, announced the deaths and injuries in a news conference. The stage, which had been erected on a baseball field in the city of San Pedro Garza García, was the site of a campaign event for the Citizens’ Movement party’s candidate for the city’s mayoral election, Lorenia Canavati.

The Supreme Court’s conservative majority cleared the way today for South Carolina to keep using a congressional map that a lower court had deemed an unconstitutional racial gerrymander. All three liberal justices dissented. The ruling handed a victory to the state’s Republicans by allowing them to maintain a stronghold on a district in Charleston County. The immediate effect will be limited: This year’s elections were already set to take place under the contested map. In dissent, the liberal justices argued that it could become all but impossible to challenge voting maps as racial gerrymanders.

CNN —If Chief Justice John Roberts is really an institutionalist — someone deeply concerned about the integrity of the Supreme Court and public perceptions about it — then he has a big problem on his hands. The discovery also comes at a time when the Supreme Court will be making a decision about Trump’s claims of sweeping presidential immunity, his get-out-of-jail-free card for the federal cases he faces. The notion that the Supreme Court can be trusted to be an arbiter above partisan politics has suffered major blows in recent years. Supreme Court decisions have not been the only issue. To the Editor:Re “We’re Suddenly Living in a ‘My Wife Did It’ Moment,” by Gail Collins and Bret Stephens (The Conversation, May 21):Mr. Stephens goes on at length about why Justice Samuel Alito’s wife has “the constitutional right” to express a “Stop the Steal” opinion by hanging a flag upside-down in the Alitos’ front yard, as well as “a moral right” to express her opinion independently of her Supreme Court justice husband. Then, when Ms. Collins challenges the propriety of a political symbol at the home of a justice who might someday have to decide on that very election’s validity, Mr. Stephens demurs with a mild “OK.”Mr. Stephens’s argument is deeply disturbing. Our Supreme Court justices are expected to maintain not just the reality of no conflicts of interest that might influence their rulings, but also the “appearance” of no such conflicts. To neighbors and now the nation, the flag made it appear that Justice Alito believes Donald Trump’s lies about a stolen election, and thus would rule in favor of Mr. Trump in related cases. Blaming his wife makes a sham of his own responsibility not to appear political.

Last summer, two years after an upside-down American flag was flown outside the Virginia home of Justice Samuel A. Alito Jr., another provocative symbol was displayed at his vacation house in New Jersey, according to interviews and photographs. This time, it was the “Appeal to Heaven” flag, which, like the inverted U.S. flag, was carried by rioters at the Capitol on Jan. 6, 2021. Also known as the Pine Tree flag, it dates back to the Revolutionary War, but largely fell into obscurity until recent years and is now a symbol of support for former President Donald J. Trump, for a religious strand of the “Stop the Steal” campaign and for a push to remake American government in Christian terms. Three photographs obtained by The New York Times, along with accounts from a half-dozen neighbors and passers-by, show that the Appeal to Heaven flag was aloft at the Alito home on Long Beach Island in July and September of 2023. A Google street view image from late August also shows the flag.

An earlier generation of Supreme Court justices seemed to possess the capacity for shame. In 1969, Justice Abe Fortas resigned his seat for accepting a $20,000 consulting fee (which he returned) from a foundation led by a man who was convicted of securities fraud. Whatever Justice Fortas believed about his own honor and morality, he understood that the Supreme Court is an inherently fragile institution, and that its nine justices cannot afford the slightest whiff of bias or corruption. They are saying, in effect, that they don’t care if any of this bothers you. To go by recent polls showing that this court’s public approval has approached record lows, it bothers many millions of Americans.
