It’s so easy,” Trump said when asked by conservative radio host Hugh Hewitt whether he would “pardon yourself” or “fire Jack Smith.”“I would fire him within two seconds,” Trump said. But Trump has suggested on multiple occasions he would weaponize the justice system against his political rivals if reelected. Trump, who frequently rails against Smith on the campaign trail, told Breitbart last July that he “wouldn’t keep” the special counsel if he were reelected. “I wouldn’t keep him,” Trump said when asked if he would fire Smith. Why would I keep him?”Trump has routinely on the campaign trail suggested he would weaponize the justice system to go after his political opponents if reelected.

CNN —Senate Minority Leader Mitch McConnell delivered a scathing assessment of the modern Republican Party in an upcoming biography, saying the “MAGA movement is completely wrong” and that Ronald Reagan “wouldn’t recognize” the party today. California, Colorado and Hawaii will soon allow their residents to vote on ballot measures that would remove language from their state constitutions prohibiting same-sex marriage. The landmark 2015 Obergefell v. Hodges ruling, guaranteeing same-sex couples across the country the right to marry, makes these state bans unenforceable. However, these ballot measures seek to proactively protect these marriage rights should Obergefell ever be overturned. Without Obergefell, there is federal legislation that would keep same-sex marriage rights mostly, but not entirely, intact: the Respect for Marriage Act. It’s a personal issue for LGBTQ couples who had to navigate a time when same-sex marriage wasn’t legal or straightforward.

First openly transgender lawyer to argue at Supreme Court
  + stars: | 2024-10-21 | by ( ) www.nbcnews.com   time to read: +4 min
An American Civil Liberties Union lawyer will make history in December as the first openly transgender attorney to argue before the U.S. Supreme Court, opposing Tennessee’s Republican-backed law banning gender-affirming medical care for transgender minors. The Supreme Court on Monday ordered that the argument time for the ban’s challengers be divided between the Justice Department and attorneys representing the original plaintiffs who sued the state. Several plaintiffs — including two transgender boys, a transgender girl and their parents — sued in Tennessee to defend the treatments they have said improved their happiness and wellbeing. The Supreme Court has confronted several cases in the past decade implicating LGBTQ rights. In 2020, it ruled that a landmark federal law forbidding workplace discrimination protects gay and transgender employees.

A highly anticipated legislative hearing began Monday but without its key witness: a Texas inmate whose execution for his daughter's "shaken baby" death was narrowly averted last week. The high court, however, said Sunday it would not rule on the manner in which Roberson must testify. Roberson, 57, has maintained his innocence in the 2002 death of his 2-year-old daughter, Nikki, based on "shaken baby syndrome." But hours later, Roberson said, he woke up and realized Nikki was not breathing and her lips looked blue. Wharton, the lead detective in the case, has also voiced his support for Roberson, telling House committee members at a hearing last week: "This is an innocent man, beyond question."

WASHINGTON — The Supreme Court on Monday rejected disbarred lawyer Michael Cohen’s last-ditch effort to revive a civil rights claim against his former boss Donald Trump. But constitutional claims against individual federal officials are notoriously difficult to bring as a result of a line of Supreme Court rulings. In a 2022 case called Egbert v. Boule, the Supreme Court effectively put “Bivens claims” on life support in a ruling that tossed out allegations against a Border Patrol agent. A federal judge in New York and the 2nd Circuit U.S. Court of Appeals both highlighted the Supreme Court’s recent ruling in throwing out Cohen’s claims. Unless Congress passes legislation to allow a form of Bivens claims, there are few legal avenues to seeking accountability when federal officials, including thousands of law enforcement officials, commit unlawful acts.

The Biden administration is proposing a rule that would provide women with private insurance access to over-the-counter birth control pills and other contraceptives at no cost, the White House said on Monday. “This rule, once finalized, will expand contraception coverage for 52 million women of reproductive age with private health insurance,” White House Gender Policy Council Director Jennifer Klein said during a briefing. “For the first time ever, women would be able to obtain over-the-counter contraception without a prescription at no additional cost, and health plans would have to cover even more prescribed contraceptives without cost sharing,” she said. Perrigo Co.’s Opill is currently the only daily birth control pill approved for sale without a prescription by the Food and Drug Administration, but the proposed rule covers other forms of over-the-counter contraceptives, including emergency contraception such as morning after pill Plan B, spermicides, birth control sponges, and condoms. The rule will also require that health plans cover all FDA-approved contraceptive drugs and some devices, including IUDs, without cost sharing in many cases.
