Nondisclosure Agreements Get Trickier Under New SEC Scrutiny

Provisions that impede an individual from communicating with the SEC are unlawful under the Dodd-Frank Act. Photo: Spencer Platt/Getty ImagesCompanies have long used employee nondisclosure agreements to protect proprietary information. Now, regulators are trying to ensure that clauses in those agreements don’t also serve to inhibit whistleblowers from reporting potential corporate wrongdoing. In recent months, the U.S. Securities and Exchange Commission has taken a number of actions against companies whose various employment contracts have language that might hold employees back from reporting misconduct to regulators. A watershed moment came in September, when the SEC fined hedge fund D.E.

How Jewish People Built the American Theater
  + stars: | 2023-11-29 | by ( Jesse Green | ) www.nytimes.com   time to read: +46 min
Let Us Tell You A Story How Jewish people built the American theater as we know it. The theater, which for many Jews was a major way of becoming American in the first place, seems unable to acknowledge that the danger that American Jews face is not just historical, and not just onstage. (Both of Adler’s parents were Yiddish theater stars — her father, Jacob Adler, was a renowned Shylock in 1903.) Embedding their own observation and experience within Stanislavsky’s, along with the best of Yiddish theater and a generous dollop of Freud, they converted the American theater to Judaism. Sara Krulwich/The New York TimesThe Jewish contribution to the creation of the American theater was built on the acknowledgment of a larger humanity alive within each of us, available to some, with natural empathy and rigorous training.

Investors cautioned that tax breaks would not be sufficient to raise business investment while UK interest rates stayed high. But Wednesday, equity markets focused on Hunt's business boosts, such as a move to make full expensing on investment permanent. UK stock markets have underperformed their European and U.S. peers in 2023. The FTSE 100 index 12-month forward price-to-earnings ratio is around 10.7, about half that of U.S. stocks, with Hunt's budget unlikely to move the dial too far. If embraced in its entirety, the nondelegation doctrine could spell the end of agency power as we know it, turning the clock back to before the New Deal. but would also “invalidate much of the federal budget.” It might also throw into question the constitutionality of other federal agencies, including potentially the Federal Reserve. The Supreme Court has put on hold lower court rulings that invalidated parts of the F.D.A.’s approval, but that’s no guarantee of how the court would ultimately rule in the case. It would furthermore likely destabilize the F.D.A.’s approval process, which has long been seen as the global “gold standard” of drug safety. But embracing these arguments would not result in the court returning power to Congress but claiming enormous and novel powers for itself.

[1/5] Chancellor of the Exchequer Jeremy Hunt leaves 11 Downing Street for the House of Commons to deliver his autumn statement, in London, Britain, November 22, 2023. "After a global pandemic and energy crisis, we have taken difficult decisions to put our economy back on track," Hunt told parliament on Wednesday in his Autumn Statement fiscal update. Hunt pointed to OBR forecasts showing the government would meet its targets for the public finances, leaving open the possibility of further pre-election giveaways to voters in his full budget statement expected in early 2024. Sunak this week promised "responsible" tax cuts, mindful of last year's "mini-budget" turmoil in financial markets triggered by his predecessor Liz Truss's plans for much bigger tax cuts. This time last year, the newly installed Sunak and Hunt raised taxes sharply to quell the bond market mayhem.

CNN —Let’s face it, people generally don’t come to Godzilla-related projects for the actors and drama, which is basically the leap that “Monarch: Legacy of Monsters” asks viewers to make. Stretched into a multi-generational Apple TV+ series, the show is as much a Titan-ic soap opera as a monster mash, proving mildly watchable but without enough of the city-leveling antics for which the big guy is known. Godzilla appears, occasionally, in the Apple TV+ series "Monarch: Legacy of Monsters." For that latter contingent, “Legacy of Monsters” should be mildly entertaining, but even with Apple’s sizable investment, it too often feels like a gigantic donut with a Godzilla-shaped hole in the middle. “Monarch: Legacy of Monsters” premieres November 17 on Apple TV+.

In Dobbs, the conservative justices said that a right to abortion was not explicit in constitutional text and was not deeply rooted in the history or traditions of this country. In withdrawing the longstanding right to abortion, the court relied on a history in which women were not considered full members of the polity to justify imposing on women today a crabbed vision of equal citizenship. In this regard, Rahimi is not only a sequel to Bruen, but also a sequel to Dobbs. The court may seem poised to uphold the law, but the conservative justices did not appear interested in revisiting the history-and-tradition test announced in Bruen. Only Justices Elena Kagan and Ketanji Brown Jackson appeared openly skeptical of the test.

Tracey Emin carried around a giant tote decades before enormous handbags were fashionable. “Ironic now, thinking about that, right?” she says, in her soft, working-class-accent, on a chilly afternoon, as she tries to find a comfortable position on a sofa in her recently renovated townhouse on Fitzroy Square, a genteel, central-London pocket that was once home to both Virginia Woolf and George Bernard Shaw. She reaches into the large canvas carryall at her feet to pull out a plastic pouch of urine, which is connected under her loose cotton shift by a long tube to a stoma in her abdomen. She waves it slightly, a white flag, maybe, though because this is Emin, surrender has never been an option. “I made them leave my clitoris,” she says.

They see legal disputes as an opportunity to plead their case to judges they believe are more sympathetic than California’s legislators — especially judges at the federal level. But he allowed the district to notify parents if children ask to change their school records. The current legal dispute is not the test case that conservatives might have wished for, because it is a matter of state, not federal, law. But one of the California notification policies may eventually be contested in a federal venue, said Erwin Chemerinsky, an expert in constitutional law and the dean of the law school at the University of California, Berkeley. (AP) — An Indiana Moms for Liberty chapter has followed the conservative group’s national playbook, challenging diversity, equity and inclusion efforts in school districts as part of its “parental rights” mission. Democratic candidate and Carmel city councilman Miles Nelson asked his opponent on stage earlier this month to denounce the local Moms for Liberty chapter. The local chapter is relatively new, but its June newsletter attracted wide condemnation after quoting Hitler on its front cover. “It’s a clear example of how opposition to Moms for Liberty can galvanize people to vote against conservative candidates,” Valant said. Tuesday’s data showed that the labor market was continuing to cool, following the same trend as the previous month, with more unemployment and fewer job vacancies. The Bank of England has raised interest rates to their highest level since 2008, and officials have signaled they will remain high well into next year. But the latest labor market release needs to be taken “with a huge pinch of salt,” Philip Shaw, an economist at Investec, wrote in an analyst note. Policymakers at the Bank of England have “lost another important set of figures” to guide them in setting interest rates, he argued. Last month, the statistics office issued a particularly large upward revision to the size of the economy after pandemic lockdowns.

The new portals, equipped with high-speed cameras, will take hundreds of pictures of every passing locomotive and rail car. Unlike previous versions, these new inspection portals will be able to capture all sides of a train that passes through them with well-lit images. University of Delaware professor Allan Zarembski, who leads the Railroad Engineering and Safety Program there, said it's significant that Norfolk Southern is investing in so many of the portals. The Atlanta-based railroad didn't say how much it is investing in the technology it worked with Georgia Tech to develop.
