Trump immunity ruling hands big decisions to Judge Tanya Chutkan
  + stars: | 2024-07-01 | by ( ) www.cnbc.com   time to read: +2 min
A general view of the U.S. Supreme Court as justices issue rulings in pending cases on the final day of the court's term in Washington, U.S., July 1, 2024. The U.S. Supreme Court's presidential immunity ruling on Monday sends the federal case accusing Donald Trump of attempting to overturn his 2020 defeat back to Judge Tanya Chutkan for critical decisions that will shape the future of the historic prosecution. Chutkan, a judge on the U.S. District Court in Washington, will have to decide whether a pair of Supreme Court rulings requires some of the allegations against the Republican presidential candidate be tossed out. Chutkan, born in Jamaica and nominated as a judge by former Democratic President Barack Obama, was assigned to oversee the Trump case in August 2023. She has had little to do for more than six months as Trump's bid for presidential immunity stalled any activity until the Supreme Court ruled.

Justice Sonia Sotomayor issued a lengthy and strongly worded dissent in which she excoriated the court for its decision. The chief justice said the trial court will have to assess what of Trump’s alleged conduct is immunized under the new test handed down by the high court, and the opinion said that additional briefing will be needed for the trial court to do so. Justice Amy Coney Barrett expressed frustration with how the court was sending the case back down for more proceedings. She suggested that because Trump’s wholesale challenge to the indictment had failed, at least some of the case could go forward. In that sense, if Smith narrowed his indictment, lower courts could hear the Trump trial this year.

Washington CNN —President Joe Biden on Monday condemned the Supreme Court’s decision which ruled that presidents have an absolute immunity from prosecution for core official acts, and issued a stern warning over a possible second term for former President Donald Trump. “(With) today’s Supreme Court decision on presidential immunity, that fundamentally changed. Biden repeatedly warned that the limits of the president’s power now solely rest with the holder of the office and the choices that person makes. During Monday’s speech, Biden appeared alert, reading energetically from a teleprompter in the Cross Hall of the White House. Here’s what she said – she said, ‘In every use of official power, the president is now a king above the law.

The Supreme Court heard two other cases this term concerning the Jan. 6 attack on the Capitol. Chief Justice John G. Roberts Jr., writing for the majority, said Mr. Trump had at least presumptive immunity for his official acts. If Mr. Trump prevails at the polls, he could order the Justice Department to drop the charges. After the appeals court ruled against Mr. Trump, he asked the Supreme Court to intervene. At the argument, several of the conservative justices did not seem inclined to examine the details of the charges against Mr. Trump.

The Supreme Court ruled on Monday that former President Donald J. Trump is entitled to substantial immunity from prosecution, delivering a major statement on the scope of presidential power. Chief Justice John G. Roberts Jr., writing for the majority, said Mr. Trump had at least presumptive immunity for his official acts. He added that the trial judge must undertake an intensive factual review to separate official and unofficial conduct and to assess whether prosecutors can overcome the presumption protecting Mr. Trump for his official conduct. If Mr. Trump prevails at the polls, he could order the Justice Department to drop the charges. The majority said protecting all presidents from having to second-guess their actions for fear of possible prosecution was a vital constitutional command.

CNN —At least 7 people, including children, were killed and at least 31 injured after Russia launched a missile strike on the town of Vilniansk in Ukraine’s southern Zaporizhzhia region on Saturday, according to Ukrainian officials. “[Today] is a day of mourning in Zaporizhzhia region for those killed in the enemy attack on Vilniansk,” Ivan Fedorov, the head of Zaporizhzhia regional military administration, said on Sunday. “There is unspeakable pain.”Three children were among those killed and eight children were among the injured, Fedorov said. Viktor Orban, Hungary's prime minister, arrives on day one of the European Union (EU) leaders summit at the EU Council headquarters in Brussels, Belgium, on Monday, May 30, 2022. Hungary's motto for its presidency — Make Europe Great Again — raised eyebrows for its resemblance to the famous tagline of former U.S. President Donald Trump. The EU presidency rotates among its member countries, and while the post holds little real power, it does allow countries to put their priorities high on Europe's agenda. As Hungary's takeover approached, leaders in Brussels rushed to push through important policy decisions while Belgium was still at the helm. "(A Hungarian) delay, according to most European leaders, is already calculated and being taken into consideration as if it's something which is most likely going to happen."

Lightning stops playAfter several days of hot weather, the skies above Dortmund’s Signal Iduna Park had been gathering throughout the evening. Thunder and lightning could be heard from afar, with the rain arriving after 32 minutes of Germany’s last-16 game against Denmark. Soon after, lightning flashes could be seen from inside the stadium, with two to three ear-splitting cracks of thunder. The suspension lasted for around 24 minutes — with preparations to restart occurring as soon as the lighting had moved out of the area. Players reemerged from their changing rooms five minutes before the resumption, and waited momentarily for groundstaff to test the pitch.

CNN —The Euro 2024 round of 16 clash between Denmark and host nation Germany was suspended after just over 30 minutes played due to what UEFA described as “adverse weather conditions” at the BVB Stadion in Dortmund. After a loud clap of thunder reverberated around the arena, referee Michael Oliver paused the game and led the players to the touchline. The players, staff and officials spent a few minutes taking shelter in the dugout before being led down the tunnel as lightning illuminated the sky in West Germany. Germany players walk off the pitch after its game against Denmark was suspended due to lightning and heavy rain. After an approximately 25-minute delay, the crowd welcomed the players back onto the pitch with a big cheer, going through a five-minute warmup before the match resumed goalless.

AdvertisementThis was Belgium at their finest, and Romania raised the level of their game in the second half to try to equalise. If Austria wanted to have any chance of qualifying to the round of 16 they had to beat Poland in their second group game. The wide areas were where Ukraine focused their attacks, and Oleksandr Zinchenko’s square pass to Mykola Shaparenko made it 1-1 in the second half. However, Samet Akaydin and Altay Bayindir’s mishap on the second goal decreased Turkey’s probability of a comeback. More off-ball runs in the second half led to the third, and by then the match was done and dusted.

Stephen K. Bannon, the longtime ally of former President Donald J. Trump, will have to report to federal prison on Monday after the Supreme Court rejected his final effort to stave off a four-month sentence for contempt of Congress. In a single-sentence decision issued on Friday, the court rejected Mr. Bannon’s request to remain free while he challenges his conviction on charges of defying a subpoena from the House committee that investigated the Jan. 6, 2021, attack on the Capitol. Mr. Bannon had filed a last-ditch petition to Chief Justice John G. Roberts Jr. last week, asking for permission to hold off on surrendering to the authorities. In July 2022, Mr. Bannon was found guilty at a trial in Washington of ignoring the subpoena, which sought information about his role in the events of Jan. 6. Even though he was sentenced to four months in prison, he was initially allowed to remain free while he pursued a lengthy appeals process.

Boeing's crew flight test represents the first time Starliner is carrying people, flying NASA astronauts Butch Wilmore and Suni Williams. Before launching on June 5, Boeing and NASA planned for Starliner to be in space for nine days. As of Friday, the Starliner flight has tallied 24 days and counting. NASA and Boeing say the delay for testing is solely to gather more data about the spacecraft's performance, in particular its thruster system. The Starliner crew flight test represents a final major step before NASA certifies Boeing to fly crew on operational, six-month missions.

Charges against Trump not likely affectedThe people who pushed their way into the Capitol aren’t the only ones who are facing the obstruction charge. But even before the court’s decision was handed down, Smith made clear that the charge was based on different circumstances in Trump’s case. The Supreme Court’s opinion did not address the fake electors scheme specifically. What is far more important for Trump is the Supreme Court’s pending decision on immunity. The Justice Department has taken steps for months in its prosecutions of rioters to shore up the obstruction charges.

Washington CNN —Donald Trump used to tell his fans that he’d win so much, they’d get tired of winning. The ex-president’s lawyers are already signaling they will seek to get evidence tossed and obstruction counts against the ex-president dismissed. The court released its decision ahead of an even more critical case that will bear more directly on Trump’s criminal entanglements. A second 2020 election case, in Georgia, is also stalled – partly over a controversy and appeals process triggered by a relationship between District Attorney Fani Willis and a prosecutor she appointed. Superficially, abortion rights had a good run at the Supreme Court this term. Two weeks ago, the justices unanimously let an abortion pill remain widely available. Some supporters of abortion rights called the rulings Pyrrhic victories, ones they feared would set the stage for more restrictions, whether from the courts or from a second Trump administration. In Dobbs v. Jackson Women’s Health Organization, the 2022 decision that overturned Roe v. Wade, the Supreme Court signaled that it sought to get out of the abortion business. “The authority to regulate abortion must be returned to the people and their elected representatives,” Justice Samuel A. Alito Jr. wrote for the majority.

At issue in the case was a state law that banned abortions except for the life of the pregnant woman. The Biden administration argued that a federal law required hospitals to also provide abortions in cases where the health of a pregnant woman is at stake. “Today’s decision is not a victory for pregnant patients in Idaho,” Jackson wrote.
